DISABILITY; TO AUTHORIZE THE ISSUANCE OF A TEMPORARY 11 
SPECIAL CERTIFICATE TO PREGNANT WOMEN; AND FOR OTHER 12 
PURPOSES. 13

TO AMEND THE LAW CONCERNING PARKING FOR 18 
A PERSON WITH A DISABILITY; AND TO 19 
AUTHORIZE THE ISSUANCE OF A TEMPORARY 20 
SPECIAL CERTIFICATE TO PREGNANT WOMEN. 21

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23 
 24 
 SECTION 1.  Arkansas Code Title 27, Chapter 15, Subchapter 3, is 25 
amended to add an additional section to read as follows: 26 
 27-15-318.  Pregnancy Parking Act — Temporary special certificate 27 
during and after pregnancy. 28 
 (a)  This act shall be known and may be cited as the "Pregnancy Parking 29 
Act". 30 
 (b)  A woman who is pregnant, as determined by a licensed physician, 31 
may apply to the Office of Motor Vehicle for a temporary person -with-a-32 
disability special certificate. 33 
 (c)  The temporary special certificate shall: 34 
 (1)  Conform to the requirements under § 27 -15-304(a)-(c); and 35 
 (2)  Expire one (1) year following the date the pregnant woman 36    	HB1770

gives birth. 1 
 (d)  The Office of Motor Vehicles shall: 2 
 (1)  Develop an appropriate form, including a provision for a 3 
sworn statement of pregnancy, for use by an applicant to request issuance of 4 
the temporary special person -with-a-disability certificate for a pregnant or 5 
post-partum woman; 6 
 (2)  Distribute a copy of this subchapter to all appropriate law 7 
enforcement agencies charged with enforcement of the Motor Vehicle Code; 8 
 (3)  Adopt procedures and promulgate rules to advise and inform 9 
the general public of the provisions of this subchapter and the availability 10 
of the temporary special certificates; 11 
 (4)  Maintain accurate records of the annual number of temporary 12 
special certificates issued and in inventory; 13 
 (5)  Enter into the permanent record of each applicant, the 14 
temporary special certificate number, and type of allowable disability of the 15 
applicant in a manner that will allow retrieval of the information for 16 
statistical use; and 17 
 (6)  Include a notice with each application for a temporary 18 
special certificate informing the applicant and any other person driving for 19 
the applicant of the requirements of this subchapter and further informing 20 
the applicant that the privilege to park in spaces reserved for persons with 21 
disabilities shall be available only when the person for whom the temporary 22 
special certificate was issued or a person with a disability is actually in 23 
the vehicle. 24 
 (e)  The Office of Motor Vehicle may promulgate rules to administer the 25 
provisions of this section. 26
