2423 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

2625 SECTION 1. Arkansas Code § 27 -16-701(a)(2), concerning the application 23
2726 for a driver's license or instruction permit, is amended to read as follows: 24
2827 (2) The commercial driver's license or noncommercial driver's 25
2928 license shall include the: 26
3029 (A) An intermediate driver's license issued to persons who 27
3130 are less than eighteen (18) years of age ; and the 28
3231 (B) A learner's license issued to persons who are less 29
3332 than sixteen (16) years of age. 30

3534 SECTION 2. Arkansas Code § 27 -16-704(b)(7), concerning the examination 32
3635 of an application for a driver's license, is amended to read as follows: 33
3736 (7) In addition, the applicant for a learner's license and an 34
3837 intermediate driver's license shall have the student's applicant's driving 35
3938 record checked to verify that the student applicant has been free of a 36 HB1913

4241 serious accident and conviction of a serious traffic violation for the last 1
4342 six (6) months and that an applicant with an intermediate driver's license 2
4443 applying for a regular license has been free of a serious accident and 3
4544 conviction of a serious traffic violation for the last twelve (12) months. 4

4746 SECTION 3. Arkansas Code § 27 -16-801(a)(1)(A)(ii), concerning the 6
4847 requirement that the Office of Driver Services issue certain licenses, is 7
4948 amended to read as follows: 8
5049 (ii) An intermediate Class D license or an 9
5150 intermediate Class M license to each applicant between who is sixteen (16) 10
5251 and eighteen (18) years of age or older, for a period of up to two (2) years, 11
5352 upon payment of twelve dollars ($12.00); 12

5554 SECTION 4. Arkansas Code § 27 -16-804(g)(1)(A), concerning the issuance 14
5655 of intermediate driver's licenses, is amended to read as follows: 15
5756 (g)(1)(A) The Office of Driver Services shall have authority to issue 16
5857 to those persons under eighteen (18) who are at least sixteen (16) years of 17
5958 age a restricted driver's license to be known as an “intermediate driver's 18

6261 SECTION 5. Arkansas Code § 27 -16-901(a)(1)(B)(ii), concerning the 21
6362 expiration and renewal of driver's licenses, is amended to read as follows: 22
6463 (ii) Any person sixteen (16) years of age or older 23
6564 may apply for an intermediate driver's license, provided that his or her 24
6665 driving record is free of a serious accident and conviction of a serious 25
6766 traffic violation for the most recent six -month period. 26

6968 SECTION 6. Arkansas Code § 27 -16-901(a)(1)(C), concerning the 28
7069 expiration and renewal of driver's licenses, is amended to read as follows: 29
7170 (C)(i) An intermediate driver's license shall be issued 30
7271 for no more than a two -year period and shall expire immediately upon the: 31
7372 (a) The driver's reaching eighteen (18) years 32
7473 of age, and if: 33
7574 (1) The intermediate driver has been 34
7675 free of a serious accident and conviction of a serious traffic violation for 35

8180 (2) The intermediate driver's license 2
8281 was issued to the intermediate driver before his or her eighteenth birthday; 3

8483 (b) If the intermediate driver was eighteen 5
8584 (18) years of age or older when his or her intermediate driver's license was 6
8685 issued, the time at which the intermediate driver has been free of a serious 7
8786 accident and conviction of a serious traffic violation for at least twelve 8
8887 (12) months. 9
8988 (ii) An intermediate driver's license may be renewed 10
9089 at that the time of expiration or within thirty (30) days following the 11
9190 expiration date of the intermediate driver's license as a: 12
9291 (a) A regular driver's license for eight (8) 13
9392 years, so long as the intermediate driver has been free of a serious accident 14
9493 and conviction of a serious traffic violation for at least twelve (12) months 15
9594 before arriving at his or her eighteenth birthday if the conditions stated in 16
9695 subdivision (a)(1)(C)(i) of this section are met; or 17
9796 (b) An intermediate driver's license for two 18
9897 (2) years if the conditions stated in subdivision (a)(1)(C)(i) of this 19
9998 section are not met. 20
