24	23		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21

26	25		SECTION 1. Arkansas Code § 27 -16-701(a)(2), concerning the application 23
27	26		for a driver's license or instruction permit, is amended to read as follows: 24
28	27		(2) The commercial driver's license or noncommercial driver's 25
29	28		license shall include the: 26
30	29		(A) An intermediate driver's license issued to persons who 27
31	30		are less than eighteen (18) years of age ; and the 28
32	31		(B) A learner's license issued to persons who are less 29
33	32		than sixteen (16) years of age. 30

35	34		SECTION 2. Arkansas Code § 27 -16-704(b)(7), concerning the examination 32
36	35		of an application for a driver's license, is amended to read as follows: 33
37	36		(7) In addition, the applicant for a learner's license and an 34
38	37		intermediate driver's license shall have the student's applicant's driving 35
39	38		record checked to verify that the student applicant has been free of a 36 HB1913

42	41		serious accident and conviction of a serious traffic violation for the last 1
43	42		six (6) months and that an applicant with an intermediate driver's license 2
44	43		applying for a regular license has been free of a serious accident and 3
45	44		conviction of a serious traffic violation for the last twelve (12) months. 4

47	46		SECTION 3. Arkansas Code § 27 -16-801(a)(1)(A)(ii), concerning the 6
48	47		requirement that the Office of Driver Services issue certain licenses, is 7
49	48		amended to read as follows: 8
50	49		(ii) An intermediate Class D license or an 9
51	50		intermediate Class M license to each applicant between who is sixteen (16) 10
52	51		and eighteen (18) years of age or older, for a period of up to two (2) years, 11
53	52		upon payment of twelve dollars ($12.00); 12

55	54		SECTION 4. Arkansas Code § 27 -16-804(g)(1)(A), concerning the issuance 14
56	55		of intermediate driver's licenses, is amended to read as follows: 15
57	56		(g)(1)(A) The Office of Driver Services shall have authority to issue 16
58	57		to those persons under eighteen (18) who are at least sixteen (16) years of 17
59	58		age a restricted driver's license to be known as an “intermediate driver's 18
60	59		license”. 19

62	61		SECTION 5. Arkansas Code § 27 -16-901(a)(1)(B)(ii), concerning the 21
63	62		expiration and renewal of driver's licenses, is amended to read as follows: 22
64	63		(ii) Any person sixteen (16) years of age or older 23
65	64		may apply for an intermediate driver's license, provided that his or her 24
66	65		driving record is free of a serious accident and conviction of a serious 25
67	66		traffic violation for the most recent six -month period. 26

69	68		SECTION 6. Arkansas Code § 27 -16-901(a)(1)(C), concerning the 28
70	69		expiration and renewal of driver's licenses, is amended to read as follows: 29
71	70		(C)(i) An intermediate driver's license shall be issued 30
72	71		for no more than a two -year period and shall expire immediately upon the: 31
73	72		(a) The driver's reaching eighteen (18) years 32
74	73		of age, and if: 33
75	74		(1) The intermediate driver has been 34
76	75		free of a serious accident and conviction of a serious traffic violation for 35
77	76		at least twelve (12) months before arriving at his or her eighteenth 36 HB1913

81	80		(2) The intermediate driver's license 2
82	81		was issued to the intermediate driver before his or her eighteenth birthday; 3

84	83		(b) If the intermediate driver was eighteen 5
85	84		(18) years of age or older when his or her intermediate driver's license was 6
86	85		issued, the time at which the intermediate driver has been free of a serious 7
87	86		accident and conviction of a serious traffic violation for at least twelve 8
88	87		(12) months. 9
89	88		(ii) An intermediate driver's license may be renewed 10
90	89		at that the time of expiration or within thirty (30) days following the 11
91	90		expiration date of the intermediate driver's license as a: 12
92	91		(a) A regular driver's license for eight (8) 13
93	92		years, so long as the intermediate driver has been free of a serious accident 14
94	93		and conviction of a serious traffic violation for at least twelve (12) months 15
95	94		before arriving at his or her eighteenth birthday if the conditions stated in 16
96	95		subdivision (a)(1)(C)(i) of this section are met; or 17
97	96		(b) An intermediate driver's license for two 18
98	97		(2) years if the conditions stated in subdivision (a)(1)(C)(i) of this 19
