Leding 6 7 For An Act To Be Entitled 8 AN ACT TO AMEND THE LAW CONCERNING DRIVER'S LICENSES; 9 TO AMEND THE LAW CONCERNING THE QUALIFICATIONS FOR AN 10 INTERMEDIATE DRIVER'S LICENSE; AND FOR OTHER 11 PURPOSES. 12 13 14 Subtitle 15 TO AMEND THE LAW CONCERNING DRIVER'S 16 LICENSES; AND TO AMEND THE LAW 17 CONCERNING THE QUALIFICATIONS FOR AN 18 INTERMEDIATE DRIVER'S LICENSE. 19 20 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 21 22 SECTION 1. Arkansas Code § 27 -16-701(a)(2), concerning the application 23 for a driver's license or instruction permit, is amended to read as follows: 24 (2) The commercial driver's license or noncommercial driver's 25 license shall include the: 26 (A) An intermediate driver's license issued to persons who 27 are less than eighteen (18) years of age ; and the 28 (B) A learner's license issued to persons who are less 29 than sixteen (16) years of age. 30 31 SECTION 2. Arkansas Code § 27 -16-704(b)(7), concerning the examination 32 of an application for a driver's license, is amended to read as follows: 33 (7) In addition, the applicant for a learner's license and an 34 intermediate driver's license shall have the student's applicant's driving 35 record checked to verify that the student applicant has been free of a 36 HB1913 2 03/31/2025 11:25:41 AM ZRC108 serious accident and conviction of a serious traffic violation for the last 1 six (6) months and that an applicant with an intermediate driver's license 2 applying for a regular license has been free of a serious accident and 3 conviction of a serious traffic violation for the last twelve (12) months. 4 5 SECTION 3. Arkansas Code § 27 -16-801(a)(1)(A)(ii), concerning the 6 requirement that the Office of Driver Services issue certain licenses, is 7 amended to read as follows: 8 (ii) An intermediate Class D license or an 9 intermediate Class M license to each applicant between who is sixteen (16) 10 and eighteen (18) years of age or older, for a period of up to two (2) years, 11 upon payment of twelve dollars ($12.00); 12 13 SECTION 4. Arkansas Code § 27 -16-804(g)(1)(A), concerning the issuance 14 of intermediate driver's licenses, is amended to read as follows: 15 (g)(1)(A) The Office of Driver Services shall have authority to issue 16 to those persons under eighteen (18) who are at least sixteen (16) years of 17 age a restricted driver's license to be known as an “intermediate driver's 18 license”. 19 20 SECTION 5. Arkansas Code § 27 -16-901(a)(1)(B)(ii), concerning the 21 expiration and renewal of driver's licenses, is amended to read as follows: 22 (ii) Any person sixteen (16) years of age or older 23 may apply for an intermediate driver's license, provided that his or her 24 driving record is free of a serious accident and conviction of a serious 25 traffic violation for the most recent six -month period. 26 27 SECTION 6. Arkansas Code § 27 -16-901(a)(1)(C), concerning the 28 expiration and renewal of driver's licenses, is amended to read as follows: 29 (C)(i) An intermediate driver's license shall be issued 30 for no more than a two -year period and shall expire immediately upon the: 31 (a) The driver's reaching eighteen (18) years 32 of age, and if: 33 (1) The intermediate driver has been 34 free of a serious accident and conviction of a serious traffic violation for 35 at least twelve (12) months before arriving at his or her eighteenth 36 HB1913 3 03/31/2025 11:25:41 AM ZRC108 birthday; and 1 (2) The intermediate driver's license 2 was issued to the intermediate driver before his or her eighteenth birthday; 3 or 4 (b) If the intermediate driver was eighteen 5 (18) years of age or older when his or her intermediate driver's license was 6 issued, the time at which the intermediate driver has been free of a serious 7 accident and conviction of a serious traffic violation for at least twelve 8 (12) months. 9 (ii) An intermediate driver's license may be renewed 10 at that the time of expiration or within thirty (30) days following the 11 expiration date of the intermediate driver's license as a: 12 (a) A regular driver's license for eight (8) 13 years, so long as the intermediate driver has been free of a serious accident 14 and conviction of a serious traffic violation for at least twelve (12) months 15 before arriving at his or her eighteenth birthday if the conditions stated in 16 subdivision (a)(1)(C)(i) of this section are met; or 17 (b) An intermediate driver's license for two 18 (2) years if the conditions stated in subdivision (a)(1)(C)(i) of this 19 section are not met. 20 21 22 APPROVED: 4/21/25 23 24 25 26 27 28 29 30 31 32 33 34 35 36
