25	24		BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

27	26		SECTION 1. Arkansas Code § 12 -12-913(a), concerning a disclosure of a 24
28	27		person's status as a registered sex offender, is amended to add an additional 25
29	28		subdivision read as follows: 26
30	29		(4) Registration records shall be open to the Office of Motor 27
31	30		Vehicle of the Department of Finance and Administration for the issuance of a 28
32	31		driver's license or identification card to a registered sex offender under § 29
33	32		27-16-819. 30

35	34		SECTION 2. Arkansas Code Title 27, Chapter 16, Subchapter 8, is 32
36	35		amended to add an additional section to read as follows: 33
37	36		27-16-819. Designation for registered sex offender. 34
38	37		(a)(1) Before the Office of Driver Services issues a driver's license 35
39	38		or identification card to an applicant, the applicant shall provide 36 HB1984

42	41		information to the office concerning whether the applicant is: 1
43	42		(A) Required to register as a sex offender under the Sex 2
44	43		Offender Registration Act of 1997, § 12 -12-901 et seq.; 3
45	44		(B) Currently registered as a sex offender under the Sex 4
46	45		Offender Registration Act of 1997, § 12 -12-901 et seq.; and 5
47	46		(C) Classified as a Level 3 or Level 4 sex offender by the 6
48	47		Community Notification Assessment. 7
49	48		(2) The office shall place a designation on an applicant's 8
50	49		driver's license or identification card sufficient to enable a law 9
51	50		enforcement officer to identify the holder of the driver's license or 10
52	51		identification card as a registered sex offender subject to the Sex Offender 11
53	52		Registration Act of 1997, § 12 -12-901 et seq., if the applicant is: 12
54	53		(A) Required to register as a sex offender; and 13
55	54		(B) Classified as a Level 3 or Level 4 sex offender by the 14
56	55		Community Notification Assessment. 15
57	56		(3) Before the office issues a driver's license or 16
58	57		identification card to an applicant who is required to have a designation 17
59	58		placed on his or her driver's license or identification card under this 18
60	59		section and who has not previously had a designation placed on his or her 19
61	60		driver's license or identification card under this section, the applicant 20
62	61		shall provide proof to the office that the applicant is registered as a sex 21
63	62		offender in compliance with the Sex Offender Registration Act of 1997, § 12 -22
64	63		12-901 et seq. 23
65	64		(b) The office may: 24
66	65		(1) Determine the appropriate placement and design of the 25
67	66		registered sex offender designation on a driver's license or identification 26
68	67		card authorized under this section; and 27
69	68		(2) Promulgate rules for the administration of this section. 28
