OFFENDER ON A DRIVER'S LICENSE OR IDENTIFICATION 10 
CARD; TO AMEND THE LAW CONCERNING THE SEX OFFENDER 11 
REGISTRATION ACT OF 1997; TO AMEND THE LAW CONCERNING 12 
THE ISSUANCE OF LICENSES AND PERMITS; AND FOR OTHER 13 
PURPOSES. 14

SEX OFFENDER ON A DRIVER'S LICENSE OR 19 
IDENTIFICATION CARD. 20 
 21 
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22 
 23 
 SECTION 1.  Arkansas Code § 12 -12-913(a), concerning a disclosure of a 24 
person's status as a registered sex offender, is amended to add an additional 25 
subdivision read as follows: 26 
           (4)  Registration records shall be open to the Office of Motor 27 
Vehicle of the Department of Finance and Administration for the issuance of a 28 
driver's license or identification card to a registered sex offender under § 29 
27-16-819. 30 
 31 
 SECTION 2.  Arkansas Code Title 27, Chapter 16, Subchapter 8, is 32 
amended to add an additional section to read as follows: 33 
 27-16-819.  Designation for registered sex offender. 34 
 (a)(1)  Before the Office of Driver Services issues a driver's license 35 
or identification card to an applicant, the applicant shall provide 36    	HB1984

information to the office concerning whether the applicant is: 1 
 (A)  Required to register as a sex offender under the Sex 2 
Offender Registration Act of 1997, § 12 -12-901 et seq.; 3 
 (B)  Currently registered as a sex offender under the Sex 4 
Offender Registration Act of 1997, § 12 -12-901 et seq.; and 5 
 (C)  Classified as a Level 3 or Level 4 sex offender by the 6 
Community Notification Assessment. 7 
 (2)  The office shall place a designation on an applicant's 8 
driver's license or identification card sufficient to enable a law 9 
enforcement officer to identify the holder of the driver's license or 10 
identification card as a registered sex offender subject to the Sex Offender 11 
Registration Act of 1997, § 12 -12-901 et seq., if the applicant is: 12 
 (A)  Required to register as a sex offender; and 13 
 (B)  Classified as a Level 3 or Level 4 sex offender by the 14 
Community Notification Assessment. 15 
 (3)  Before the office issues a driver's license or 16 
identification card to an applicant who is required to have a designation 17 
placed on his or her driver's license or identification card under this 18 
section and who has not previously had a designation placed on his or her 19 
driver's license or identification card under this section, the applicant 20 
shall provide proof to the office that the applicant is registered as a sex 21 
offender in compliance with the Sex Offender Registration Act of 1997, § 12	-22 
12-901 et seq. 23 
 (b)  The office may: 24 
 (1)  Determine the appropriate placement and design of the 25 
registered sex offender designation on a driver's license or identification 26 
card authorized under this section; and 27 
 (2)  Promulgate rules for the administration of this section. 28
