27	27	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25

29	29	SECTION 1. Arkansas Code § 23 -99-422(a)(2), concerning the definition 27
30	30	of "psychiatric collaborative care model" under the Arkansas Health Care 28
31	31	Consumer Act, is amended to read as follows: 29
32	32	(2) “Psychiatric collaborative care model” means the delivery of 30
33	33	care that is: 31
34	34	(A) An evidence-based, integrated behavioral health 32
35	35	service delivery method described at 81 Fed. Reg. 80230 -80239, as it existed 33
36	36	on March 31, 2023 January 1, 2025, and the MLN Booklet for Behavioral Health 34
37	37	Integration Services published by the Centers for Medicare & Medicaid 35
38	38	Services, as it existed on March 31, 2023 January 1, 2025; and 36 SB309

41	41	(B)(i) A method typically used by a primary care team 1
42	42	consisting of a primary care provider and a care manager who works in 2
43	43	collaboration with a psychiatric consultant, including without limitation a 3
44	44	psychiatrist. 4
45	45	(ii)(a) A primary care team under subdivision 5
46	46	(a)(2)(B)(i) of this section may include an individual providing clinical 6
47	47	psychiatric pharmacist services if the individual: 7
48	48	(1) Possesses a pharmacy degree 8
49	49	from a program accredited by the Accreditation Council for Pharmacy 9
50	50	Education; 10
51	51	(2) Utilizes a protocol of disease 11
52	52	state management as defined under § 17 -92-101 with a supervising provider or 12
53	53	provides independent services as a consultant with drug information and 13
54	54	medication therapy expertise; and 14
55	55	(3) Holds his or her pharmacist 15
56	56	license in good standing with the Arkansas State Board of Pharmacy. 16
57	57	(b) An individual providing clinical 17
58	58	psychiatric pharmacist services may hold a national board certification. 18
