2727 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25

2929 SECTION 1. Arkansas Code § 23 -99-422(a)(2), concerning the definition 27
3030 of "psychiatric collaborative care model" under the Arkansas Health Care 28
3131 Consumer Act, is amended to read as follows: 29
3232 (2) “Psychiatric collaborative care model” means the delivery of 30
3333 care that is: 31
3434 (A) An evidence-based, integrated behavioral health 32
3535 service delivery method described at 81 Fed. Reg. 80230 -80239, as it existed 33
3636 on March 31, 2023 January 1, 2025, and the MLN Booklet for Behavioral Health 34
3737 Integration Services published by the Centers for Medicare & Medicaid 35
3838 Services, as it existed on March 31, 2023 January 1, 2025; and 36 SB309

4141 (B)(i) A method typically used by a primary care team 1
4242 consisting of a primary care provider and a care manager who works in 2
4343 collaboration with a psychiatric consultant, including without limitation a 3
4444 psychiatrist. 4
4545 (ii)(a) A primary care team under subdivision 5
4646 (a)(2)(B)(i) of this section may include an individual providing clinical 6
4747 psychiatric pharmacist services if the individual: 7
4848 (1) Possesses a pharmacy degree 8
4949 from a program accredited by the Accreditation Council for Pharmacy 9
5050 Education; 10
5151 (2) Utilizes a protocol of disease 11
5252 state management as defined under § 17 -92-101 with a supervising provider or 12
5353 provides independent services as a consultant with drug information and 13
5454 medication therapy expertise; and 14
5555 (3) Holds his or her pharmacist 15
5656 license in good standing with the Arkansas State Board of Pharmacy. 16
5757 (b) An individual providing clinical 17
5858 psychiatric pharmacist services may hold a national board certification. 18
