CARE CONSUMER ACT; TO INCLUDE CERTAIN CLINICAL 12 
PSYCHIATRIC PHARMACIST SERVICES IN THE PSYCHIATRIC 13 
COLLABORATIVE CARE MODEL; AND FOR OTHER PURPOSES. 14

CONSUMER ACT; TO REVISE THE DEFINITION 19 
OF "PSYCHIATRIC COLLABORATIVE CARE 20 
MODEL"; AND TO INCLUDE CERTAIN CLINICAL 21 
PSYCHIATRIC PHARMACIST SERVICES IN THE 22 
PSYCHIATRIC COLLABORATIVE CARE MODEL. 23

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 25 
 26 
 SECTION 1.  Arkansas Code § 23 -99-422(a)(2), concerning the definition 27 
of "psychiatric collaborative care model" under the Arkansas Health Care 28 
Consumer Act, is amended to read as follows: 29 
 (2)  “Psychiatric collaborative care model” means the delivery of 30 
care that is: 31 
 (A)  An evidence-based, integrated behavioral health 32 
service delivery method described at 81 Fed. Reg. 80230 -80239, as it existed 33 
on March 31, 2023 January 1, 2025, and the MLN Booklet for Behavioral Health 34 
Integration Services published by the Centers for Medicare & Medicaid 35 
Services, as it existed on March 31, 2023 January 1, 2025; and 36    	SB309

 (B)(i) A method typically used by a primary care team 1 
consisting of a primary care provider and a care manager who works in 2 
collaboration with a psychiatric consultant, including without limitation a 3 
psychiatrist. 4 
 (ii)(a)  A primary care team under subdivision 5 
(a)(2)(B)(i) of this section may include an individual providing clinical 6 
psychiatric pharmacist services if the individual: 7 
 (1)  Possesses a pharmacy degree 8 
from a program accredited by the Accreditation Council for Pharmacy 9 
Education; 10 
 (2)  Utilizes a protocol of disease 11 
state management as defined under § 17 -92-101 with a supervising provider or 12 
provides independent services as a consultant with drug information and 13 
medication therapy expertise; and 14 
 (3)  Holds his or her pharmacist 15 
license in good standing with the Arkansas State Board of Pharmacy. 16 
 (b)  An individual providing clinical 17 
psychiatric pharmacist services may hold a national board certification. 18
