Wallace 5 By: Representative Gazaway 6 7 For An Act To Be Entitled 8 AN ACT TO CREATE MAIGHEN'S LAW; TO AMEND THE SEX 9 OFFENDER REGISTRATION ACT OF 1997; AND FOR OTHER 10 PURPOSES. 11 12 13 Subtitle 14 TO AMEND THE SEX OFFENDER REGISTRATION 15 ACT OF 1997. 16 17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18 19 SECTION 1. DO NOT CODIFY. This act shall be known and may be cited as 20 "Maighen's Law". 21 22 SECTION 2. Arkansas Code § 12 -12-919(a), concerning lifetime 23 registration for certain sex offenders, is amended to read as follows: 24 (a) Lifetime registration is required for a sex offender who: 25 (1) Was found to have committed an aggravated sex offense; 26 (2) Was determined by the court to be or assessed as a Level 4 27 sexually dangerous person; 28 (3) Has pleaded guilty or nolo contendere to or been found 29 guilty of a second or subsequent sex offense under a separate case number, 30 not multiple counts on the same charge; 31 (4) Was convicted of rape by forcible compulsion, § 5 -14-32 103(a)(1), or other substantially similar offense in another jurisdiction; or 33 (5) Has pleaded guilty or nolo contendere to or been found 34 guilty of failing to comply with registration and reporting requirements 35 under § 12-12-904 three (3) or more times ; or 36 SB393 2 03/05/2025 1:47:28 PM CEB095 (6) At the time of the offense was more than twenty -four (24) 1 years of age and the victim of the offense was less than fifteen (15) years 2 of age. 3 4 5 APPROVED: 3/20/25 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
