2424 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

2626 SECTION 1. Arkansas Code Title 21, Chapter 8, Subchapter 1, is amended 24
2727 to add an additional section to read as follows: 25
2828 21-8-105. Disclosure by former state employees and former elected 26
2929 officials – Definitions. 27
3030 (a) As used in this section: 28
3131 (1) "Former elected official" includes without limitation a 29
3232 person previously elected to the following offices: 30
3333 (A) Governor; 31
3434 (B) Lieutenant Governor; 32
3535 (C) Secretary of State; 33
3636 (D) Attorney General; 34
3737 (E) Treasurer of State; 35

4141 (G) Commissioner of State Lands; or 1
4242 (H) Member of the General Assembly; 2
4343 (2) "Former state employee" means a person who was previously 3
4444 regularly appointed or employed in a position of state service by a state 4
4545 agency, for which he or she was compensated on a full -time basis; and 5
4646 (3) "State agency" means every department, division, office, 6
4747 board, commission, and institution of this state, including state -supported 7
4848 institutions of higher education. 8
4949 (b)(1) For a period of four (4) years from the end of his or her 9
5050 employment or his or her term of elected office, a former state employee or 10
5151 former elected official shall disclose the following activities to the 11
5252 Arkansas Ethics Commission: 12
5353 (A) Entering into employment with an individual, business, 13
5454 or other entity that was awarded a contract by his or her state agency or 14
5555 elected office during his or her employment or his or her term of elected 15
5656 office; or 16
5757 (B) Selling a good or commodity to an individual, 17
5858 business, or other entity that was awarded a contract by his or her state 18
5959 agency or elected office during his or her employment or his or her term of 19
6060 elected office. 20
6161 (2) The disclosure under subdivision (b)(1) of this section 21
6262 shall be filed within thirty (30) days of the employment or sale. 22
6363 (3) Once the initial disclosure is filed under subdivision 23
6464 (b)(2) of this section, the former state employee or former elected official 24
6565 shall file a disclosure quarterly until he or she: 25
6666 (A) Is no longer employed with an individual, business, or 26
6767 other entity that was awarded a contract by his or her state agency or 27
6868 elected office during his or her employment or his or her term of elected 28
6969 office; 29
7070 (B) Is no longer selling a good or commodity to an 30
7171 individual, business, or other entity that was awarded a contract by his or 31
7272 her state agency or elected office during his or her employment or his or her 32
7373 term of elected office; or 33
7474 (C) Has been a former state employee or former elected 34
7575 official for a period of more than four (4) years from the end of his or her 35

7979 (c) The commission shall promulgate rules to implement this section, 1
8080 including without limitation a rule creating the form for the disclosure 2
8181 required under subsection (b) of this section. 3
