King 5 6 7 For An Act To Be Entitled 8 AN ACT TO AMEND THE LAW CONCERNING PUBLIC OFFICERS 9 AND EMPLOYEES; TO REQUIRE DISCLOSURE OF EMPLOYMENT 10 FOR FORMER STATE EMPLOYEES AND FORMER ELECTED 11 OFFICIALS; AND FOR OTHER PURPOSES. 12 13 14 Subtitle 15 TO AMEND THE LAW CONCERNING PUBLIC 16 OFFICERS AND EMPLOYEES; AND TO REQUIRE 17 DISCLOSURE OF EMPLOYMENT FOR FORMER 18 STATE EMPLOYEES AND FORMER ELECTED 19 OFFICIALS. 20 21 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22 23 SECTION 1. Arkansas Code Title 21, Chapter 8, Subchapter 1, is amended 24 to add an additional section to read as follows: 25 21-8-105. Disclosure by former state employees and former elected 26 officials – Definitions. 27 (a) As used in this section: 28 (1) "Former elected official" includes without limitation a 29 person previously elected to the following offices: 30 (A) Governor; 31 (B) Lieutenant Governor; 32 (C) Secretary of State; 33 (D) Attorney General; 34 (E) Treasurer of State; 35 (F) Auditor of State; 36 SB410 2 03/10/2025 9:53:26 AM SSS027 (G) Commissioner of State Lands; or 1 (H) Member of the General Assembly; 2 (2) "Former state employee" means a person who was previously 3 regularly appointed or employed in a position of state service by a state 4 agency, for which he or she was compensated on a full -time basis; and 5 (3) "State agency" means every department, division, office, 6 board, commission, and institution of this state, including state -supported 7 institutions of higher education. 8 (b)(1) For a period of four (4) years from the end of his or her 9 employment or his or her term of elected office, a former state employee or 10 former elected official shall disclose the following activities to the 11 Arkansas Ethics Commission: 12 (A) Entering into employment with an individual, business, 13 or other entity that was awarded a contract by his or her state agency or 14 elected office during his or her employment or his or her term of elected 15 office; or 16 (B) Selling a good or commodity to an individual, 17 business, or other entity that was awarded a contract by his or her state 18 agency or elected office during his or her employment or his or her term of 19 elected office. 20 (2) The disclosure under subdivision (b)(1) of this section 21 shall be filed within thirty (30) days of the employment or sale. 22 (3) Once the initial disclosure is filed under subdivision 23 (b)(2) of this section, the former state employee or former elected official 24 shall file a disclosure quarterly until he or she: 25 (A) Is no longer employed with an individual, business, or 26 other entity that was awarded a contract by his or her state agency or 27 elected office during his or her employment or his or her term of elected 28 office; 29 (B) Is no longer selling a good or commodity to an 30 individual, business, or other entity that was awarded a contract by his or 31 her state agency or elected office during his or her employment or his or her 32 term of elected office; or 33 (C) Has been a former state employee or former elected 34 official for a period of more than four (4) years from the end of his or her 35 employment or his or her term of elected office. 36 SB410 3 03/10/2025 9:53:26 AM SSS027 (c) The commission shall promulgate rules to implement this section, 1 including without limitation a rule creating the form for the disclosure 2 required under subsection (b) of this section. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36
