DISQUALIFICATION OF AN OCCUPATIONAL LICENSE BASED ON 11 
A PRIOR CONVICTION OF AN OFFENSE IN CERTAIN 12 
CIRCUMSTANCES; AND FOR OTHER PURPOSES. 13

TO AMEND THE LAW CONCERNING OCCUPATIONAL 17 
AND CRIMINAL BACKGROUND CHECKS; AND TO 18 
PROHIBIT THE DISQUALIFICATION OF AN 19 
OCCUPATIONAL LICENSE BASED ON A PRIOR 20 
CONVICTION OF AN OFFENSE IN CERTAIN 21 
CIRCUMSTANCES 22

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

 SECTION 1.  Arkansas Code Title 17, Chapter 3 is amended to add an 26 
additional section to read as follows: 27 
 17-3-105.  Prohibited disqualification from licensure. 28 
 An individual shall not be disqualified from pursuing, practicing, or 29 
engaging in any occupation or profession for which licensure is required 30 
solely or in part because of a prior conviction of a crime, unless the crime 31 
for which the individual was convicted directly relates to the duties and 32 
responsibilities of the occupation or profession. 33
