HB 2741: state licensing; fee waiver
Sponsor: Representative Osborne, LD 13
Senate Engrossed
Overview
Includes an active-duty military service member's spouse and a honorably discharged veteran as
persons eligible to receive a business licensing fee waiver. Appropriates monies to reimburse
agencies who waive licensing fees.
History
Statute currently states that except for an individual applying for a license for an abortion clinic or
medical marijuana, an agency must waive any initial business licensing fees for an applicant
whose family income does not exceed 200 percent of the federal poverty guidelines A.R.S. 41-
1080.01).
Statute defines an agency as any agency, department, board or commission of Arizona that
issues a license for the purposes of operating a business in Arizona or to an individual who
provides a service to any person (A.R.S. 41-1080).
A license is defined as any agency permit, certificate, approval, registration or charter issued by
any agency for the purposes of operating a business in Arizona or to an individual who provides
a service to a person (A.R.S. 41-1080).
Provisions
1. Requires any agency that issues a business license to waive initial licensing fees, for first time
applicants, for any spouse of an active-duty service member and any honorably discharged
veteran who had been discharged within two years of submitting the application. (Sec. 1)
2. Appropriates $300,000 from the state General Fund (GF) to the Arizona Department of
Administration (ADOA) each fiscal year to reimburse any agency that waives initial licensing
fees. (Sec. 1)
Senate Amendments
1. Removes the $300,000 appropriation from the GF in each fiscal year to ADOA for reimbursing
an agency for licensing fee waivers.
2. Removes the requirement for an agency to apply to ADOA for reimbursement of licensing
fees.
3. Requires ADOA, by March 1 of each year, to report the total number of waived licensing fees
by each agency, and specify for which purpose the fee was waived to:
a) The President of the Senate;
b) The Speaker of the House of Representatives;
c) The Joint Legislative Budget Committee; and
d) The Governor's Office of Strategic Planning and Budgeting.
