SB 1405: state parks board; volunteers; fingerprinting

Overview
Allows the State Parks Board (Board) to require certain volunteers submit their fingerprints for a
state and federal criminal records check.
History
Arizona State Parks Board
The Board has a variety of duties, including the management of state parks, monuments and
trails, the administration of a historic preservation program and the administration of the statewide
parks and recreation program (A.R.S. § 41-511.04). To that end, it manages 32 parks covering
over 60,000 acres of land owned by the state or leased from federal or state entities. There are
four types of parks: environmental education parks, historic parks, natural areas and recreation
areas (A.R.S. § 41-511.03).
Criminal Records Check
A criminal record check queries data in state and federal criminal justice databases to compile a
person's criminal history, or a list of crimes the person has been charged with and the dispositions
of those cases. The Federal Bureau of Investigation can exchange identification records with state
and local agencies for licensing and employment purposes provided the state law authorizes the
exchange of records (Pub. L. 92-544). Additionally, the Arizona Department of Public Safety
operates and maintains the central state repository which is a system designed to collect, store
and disseminate Arizona criminal justice information such as criminal records (A.R.S. § 41-1750
et seq.).
Provisions
1. Authorizes the Board to require volunteers submit a full set of their fingerprints for a state and
federal criminal record check if the volunteer collects fees or interacts with children or
vulnerable adults. (Sec. 1)
