71- Be it enacted by the Legislature of the State of Arizona: Section 1. Title 12, chapter 1, article 1.2, Arizona Revised Statutes, is amended by adding section 12-120.25, to read: START_STATUTE12-120.25. Panel rehearing; en banc determination A. A party may seek rehearing of a decision through a petition for rehearing en banc. B. A petition for rehearing en banc must begin with a statement that the panel decision conflicts with a decision of the court to which the petition is addressed, with citation to the conflicting case or cases, and the full court's consideration is therefore necessary to secure or maintain uniformity of the court's decisions. c. On their own or in response to a party's petition, a majority of the appellate judges who are in regular active service and who are not disqualified may order that an appeal or other proceeding be reheard en banc. Unless a judge calls for a vote, a vote need not be taken to determine whether the case will be so reheard. Rehearing en banc is not favored and ordinarily will be allowed only if the criteria in subsection B of this section are met. D. any petition for rehearing en banc must be filed within fourteen days after judgment is entered or, if the panel later amends its decision, on rehearing or otherwise, within fourteen days after the amended decision is entered. E. If a petition for rehearing en banc is granted, the court may do any of the following: 1. dispose of the case without further briefing or argument. 2. order additional briefing or argument. 3. issue any other appropriate order. 78+ Be it enacted by the Legislature of the State of Arizona: Section 1. Section 32-1299.25, Arizona Revised Statutes, is amended to read: START_STATUTE32-1299.25. Informed consent; information for patients A. The permit holder of a mobile dental facility or portable dental unit must obtain appropriate informed consent, in writing or by verbal communication, that is recorded by an electronic or digital device from the patient or the parent or guardian of the patient authorizing specific treatment before it is performed. The signed consent form or verbal communication shall be maintained as part of the patient's record as required in section 32-1264. B. If services are provided to a minor, the signed consent form or verbal communication must inform the parent or guardian that the treatment of the minor by the mobile dental facility or portable dental unit may affect future benefits the minor may receive under private insurance, the Arizona health care cost containment system or the children's health insurance program. C. At the conclusion of each patient's visit, the permit holder of a mobile dental facility or portable dental unit shall provide each patient with an information sheet that must contain: 1. Pertinent contact information as required by this section article. 2. The name of the dentist or dental hygienist, or both, who provided services. 3. A description of the treatment rendered, including billed service codes, fees associated with treatment and tooth numbers if appropriate. 4. If necessary, referral information to another dentist as required by this article. D. If the patient or the minor patient's parent or guardian has provided written consent to an institutional facility to access the patient's dental health records, the permit holder shall provide the institution with a copy of the information sheet provided in subsection C of this section.
