An act to add Part 4 (commencing with Section 1000) to Division 1 of the Health and Safety Code relating to public health, and declaring the urgency thereof, to take effect immediately. Existing law permits the modification of contracts by state agencies in specified instances. This bill would provide that, notwithstanding any other provision of law, any state agency that has entered into a contract where the agency has or may be unable to comply with the terms of that contract because of the suspension of programs by the Pooled Money Investment Board as described in California Department of Finance Budget Letter 08-33 shall have authority to amend the terms of the contract to address contract deadlines and deliverables that may not be met because of that suspension. Under existing law, the State Department of Public Health is charged with various duties with respect to protection of the public health, including the prevention and control of communicable disease. This bill would require every primary care clinic and general acute care hospital to enroll and participate in the California Health Alert Network administered by the Emergency Preparedness Office in the State Department of Public Health. This bill would declare that it is to take effect immediately as an urgency statute. Vote: 2/3. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Part 4 (commencing with Section 1000) is added to Division 1 of the Health and Safety Code , to read: PART 4. CALIFORNIA HEALTH ALERT NETWORK 1000. Every primary care clinic, as described in subdivision (a) of Section 1204, and general acute care hospital, as defined in subdivision (a) of Section 1250, shall enroll and participate in the California Health Alert Network administered by the Emergency Preparedness Office in the State Department of Public Health. SEC. 2. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: In order to ensure that the California Health Alert Network is fully utilized, at the earliest possible time, thus enabling the state to adequately prepare for a public health emergency, it is necessary this act to take effect immediately. SECTION 1. Notwithstanding any other provision of law, any state agency that has entered into a contract where the agency has or may be unable to comply with the terms of that contract because of the suspension of programs by the Pooled Money Investment Board as described in California Department of Finance Budget Letter 08-33 shall have authority to amend the terms of the contract to address contract deadlines and deliverables that may not be met because of that suspension. SEC. 2.
