Existing law requires the Energy Commission to develop and adopt an investment plan to determine priorities and opportunities for the program. Existing law requires the Energy Commission, in consultation with the State Air Resources Board, as part of the development of the investment plan, to assess whether charging station infrastructure is disproportionately deployed, as specified, and, upon finding disproportionate deployment, to use moneys from the Alternative and Renewable Fuel and Vehicle Technology Fund, as well as other mechanisms, including incentives, to more proportionately deploy new charging station infrastructure, except as specified.Existing law requires the State Energy Resources Conservation and Development Commission, in consultation with the Public Utilities Commission, to develop uptime recordkeeping and reporting standards for electric vehicle chargers and charging stations by January 1, 2024, as specified. Existing law requires the Energy Commission, beginning January 1, 2025, and biennially thereafter, to assess the uptime of charging station infrastructure, including, at a minimum, an assessment of equitable access to reliable charging stations in low-, moderate-, and high-income communities. Existing law repeals these provisions on January 1, 2035.This bill would require the Energy Commission, on or before an unspecified date, to develop and make publicly accessible an open data portal, as defined, with live data on zero-emission vehicle charging stations. The bill would require zero-emission require, on and after June 1, 2024, owners and operators of electric vehicle charging stations for which their owners or operators are awarded a state grant to support the zero-emission electric vehicle charging stations, including related infrastructure, on or after January 1, 2024, and authorize other zero-emission owners and operators of electric vehicle charging stations, to participate in the open data portal. interface:(1) Each unique charging station name or identifier.(2) The address, including the street address, city, and ZIP Code, of the property where each charging station is located.(3) The geographic coordinates, in decimal degrees, of each charging stations exact location.(4) Each charging station operators name.(5) Each charging network providers name.(6) Each charging stations status, such as operational, under construction, planned, or decommissioned.(7) Each charging stations access information, including both of the following:(A) Each charging stations access type, such as public or limited to commercial vehicles.(B) The days and times each charging station is accessible and each charging stations hours of operation.(8) Each charging stations port information, including all of the following:(A) The number of charging ports.(B) The unique port identifier.(C) The connector types available by port.(D) Each ports charging level, such as direct current fast charging or alternating current level 2.(E) The electricity delivery rating in kilowatts and by port.(F) The accessibility of the charging station, including whether it is accessible to a vehicle with a trailer by means of a pull-through stall.(G) The real-time status of each charging station, by port, in terms defined by Open Charge Point Interface 2.2.1.(9) Real-time charging station information, including all of the following:(A) Each charging stations pricing structure.(B) The real-time price to charge at each charging port, in terms defined by Open Charge Point Interface 2.2.1.(C) The payment methods accepted at each charging station.(D) Real-time information on whether each charging station is currently in use or available for use.(E) Real-time information on whether each charging station is in operation or out of service, and, if it is out of service, how long it has been out of service.(10) The date and time that the information described in paragraph (9) was last updated.(b) An owner or operator of an electric vehicle charging station that is not subject to subdivision (a) may otherwise ensure that the data fields specified in subdivision (a) for the owners or operators entire network of electric vehicle charging stations in California are made available, free of charge, to third-party software developers through an application programming interface.SECTION 1.Section 25231.6 is added to the Public Resources Code, to read:25231.6.(a)For purposes of this section, both of the following definitions apply:(1)Open data portal means a database accessible to the public that supports interoperability through a secure application programming interface or comparable technology.(2)Zero-emission vehicle charging station means _____.(b)On or before _____, the commission shall develop and make publicly accessible an open data portal with live data on zero-emission vehicle charging stations.(c)(1)A zero-emission vehicle charging station for which its owner is awarded a state grant to support the zero-emission vehicle charging station, including related infrastructure, on or after January 1, 2024, shall participate in the open data portal.(2)Any other zero-emission vehicle charging station not subject to paragraph (1) may otherwise participate in the open data portal.(d)The operator of a zero-emission vehicle charging station participating in the open data portal pursuant to subdivision (c) shall provide all of the following information to the commission:(1)The zero-emission vehicle charging stations location.(2)Whether the zero-emission vehicle charging station is currently in use or available for use.(3)Whether the zero-emission vehicle charging station is publicly available.(4)The rate charged to use the zero-emission vehicle charging station.(5)Whether the zero-emission vehicle charging station is in operation or out of service, and, if it is out of service, how long it has been out of service.(6)The zero-emission vehicle charging stations name or affiliation and charger type.(7)The type of charger connector used by the zero-emission vehicle charging station.(8)The number of charging ports on the zero-emission vehicle charging station.(9)The customer service information to be contacted if the zero-emission vehicle charging station is nonoperational or malfunctioning.(10)The date and time that the information described in this subdivision was last updated.(e)(1)The commission shall require the operator of a zero-emission vehicle charging station participating in the open data portal pursuant to subdivision (c) to provide information to the commission in the format and manner that the commission determines to be necessary.(2)The operator of a zero-emission vehicle charging station shall not be required to provide information to the commission pursuant to paragraph (1) until the open data portal is developed pursuant to subdivision (b).(f)Data made available pursuant to this section is provided for informational purposes only. The state does not warrant the completeness, accuracy, content, or fitness for any particular purpose or use of data made available on the open data portal. No warranties may be implied or inferred with respect to the publishable data made available on the open data portal. The state is not liable for any deficiencies in the completeness, accuracy, content, or fitness for any particular purpose or use of publishable data made available on the open data portal or by any third-party application using its publishable data.

(a) On and after June 1, 2024, an owner or operator of an electric vehicle charging station for which the owner or operator was awarded a state grant to support the electric vehicle charging station, including related infrastructure, on or after January 1, 2024, shall, consistent with Section 680.116 of Title 23 of the Code of Federal Regulations, ensure that all of the following data fields for the owners or operators entire network of electric vehicle charging stations in California are made available, free of charge, to third-party software developers through an application programming interface:(1) Each unique charging station name or identifier.(2) The address, including the street address, city, and ZIP Code, of the property where each charging station is located.(3) The geographic coordinates, in decimal degrees, of each charging stations exact location.(4) Each charging station operators name.(5) Each charging network providers name.(6) Each charging stations status, such as operational, under construction, planned, or decommissioned.(7) Each charging stations access information, including both of the following:(A) Each charging stations access type, such as public or limited to commercial vehicles.(B) The days and times each charging station is accessible and each charging stations hours of operation.(8) Each charging stations port information, including all of the following:(A) The number of charging ports.(B) The unique port identifier.(C) The connector types available by port.(D) Each ports charging level, such as direct current fast charging or alternating current level 2.(E) The electricity delivery rating in kilowatts and by port.(F) The accessibility of the charging station, including whether it is accessible to a vehicle with a trailer by means of a pull-through stall.(G) The real-time status of each charging station, by port, in terms defined by Open Charge Point Interface 2.2.1.(9) Real-time charging station information, including all of the following:(A) Each charging stations pricing structure.(B) The real-time price to charge at each charging port, in terms defined by Open Charge Point Interface 2.2.1.(C) The payment methods accepted at each charging station.(D) Real-time information on whether each charging station is currently in use or available for use.(E) Real-time information on whether each charging station is in operation or out of service, and, if it is out of service, how long it has been out of service.(10) The date and time that the information described in paragraph (9) was last updated.(b) An owner or operator of an electric vehicle charging station that is not subject to subdivision (a) may otherwise ensure that the data fields specified in subdivision (a) for the owners or operators entire network of electric vehicle charging stations in California are made available, free of charge, to third-party software developers through an application programming interface.

(D) Real-time information on whether each charging station is currently in use or available for use.

(E) Real-time information on whether each charging station is in operation or out of service, and, if it is out of service, how long it has been out of service.

(10) The date and time that the information described in paragraph (9) was last updated.

(b) An owner or operator of an electric vehicle charging station that is not subject to subdivision (a) may otherwise ensure that the data fields specified in subdivision (a) for the owners or operators entire network of electric vehicle charging stations in California are made available, free of charge, to third-party software developers through an application programming interface.





(a)For purposes of this section, both of the following definitions apply:



(1)Open data portal means a database accessible to the public that supports interoperability through a secure application programming interface or comparable technology.



(2)Zero-emission vehicle charging station means _____.



(b)On or before _____, the commission shall develop and make publicly accessible an open data portal with live data on zero-emission vehicle charging stations.



(c)(1)A zero-emission vehicle charging station for which its owner is awarded a state grant to support the zero-emission vehicle charging station, including related infrastructure, on or after January 1, 2024, shall participate in the open data portal.



(2)Any other zero-emission vehicle charging station not subject to paragraph (1) may otherwise participate in the open data portal.



(d)The operator of a zero-emission vehicle charging station participating in the open data portal pursuant to subdivision (c) shall provide all of the following information to the commission:



(1)The zero-emission vehicle charging stations location.



(2)Whether the zero-emission vehicle charging station is currently in use or available for use.



(3)Whether the zero-emission vehicle charging station is publicly available.



(4)The rate charged to use the zero-emission vehicle charging station.



(5)Whether the zero-emission vehicle charging station is in operation or out of service, and, if it is out of service, how long it has been out of service.



(6)The zero-emission vehicle charging stations name or affiliation and charger type.



(7)The type of charger connector used by the zero-emission vehicle charging station.



(8)The number of charging ports on the zero-emission vehicle charging station.



(9)The customer service information to be contacted if the zero-emission vehicle charging station is nonoperational or malfunctioning.



(10)The date and time that the information described in this subdivision was last updated.



(e)(1)The commission shall require the operator of a zero-emission vehicle charging station participating in the open data portal pursuant to subdivision (c) to provide information to the commission in the format and manner that the commission determines to be necessary.



(2)The operator of a zero-emission vehicle charging station shall not be required to provide information to the commission pursuant to paragraph (1) until the open data portal is developed pursuant to subdivision (b).



(f)Data made available pursuant to this section is provided for informational purposes only. The state does not warrant the completeness, accuracy, content, or fitness for any particular purpose or use of data made available on the open data portal. No warranties may be implied or inferred with respect to the publishable data made available on the open data portal. The state is not liable for any deficiencies in the completeness, accuracy, content, or fitness for any particular purpose or use of publishable data made available on the open data portal or by any third-party application using its publishable data.
