This bill creates requirements for vacancy committee composition and member selection, and notes that certain vacancies on the State Board of Education must be filled by a vacancy committee. The bill has no impact on state or local government revenue or expenditures. Appropriation Summary: No appropriation is required. Fiscal Note Status: The fiscal note reflects the introduced bill. Summary of Legislation Under current law, a political party central committee of a jurisdiction is required to appoint a vacancy committee, or if none is appointed, the central committee serves as the vacancy committee. This bill specifies that vacancy committees, at a minimum, include all precinct committeepersons and all delegates selected to the county assembly from within the relevant district. In addition, the bill applies a similar standard for vacancy committees for the office of county commissioner. The vacancy committee criteria in the bill apply when a central committee fails to appoint a vacancy committee, or serve as the minimum membership when the central committee chooses to make appointments for a vacancy committee. Lastly, the bill removes the ability of a party congressional central committee to serve as a vacancy committee when there is a vacancy on the State Board of Education if a vacancy committee does not exist. Assessment of No Fiscal Impact While governed by state law, the creation and operation of vacancy committees is managed by political parties. Thus, this bill does not impact the workload, revenue, or expenditures of any state agencies or local government and it is assessed as having no fiscal impact. Page 2 February 8, 2022 HB 22-1044 Effective Date The bill takes effect 90 days following adjournment of the General Assembly sine die, assuming no referendum petition is filed. It applies to vacancies occurring on or after this effective date.
