9-Be it enacted by the General Assembly of the State of Colorado:
10-SECTION 1. In Colorado Revised Statutes, 1-3-103, add (13) as
11-follows:

21-SECTION 2. In Colorado Revised Statutes, 1-12-206, amend (2)
22-and (3) as follows:
23-1-12-206. Vacancies in the office of county commissioner. (2) If
24-NOTE: This bill has been prepared for the signatures of the appropriate legislative
25-officers and the Governor. To determine whether the Governor has signed the bill
26-or taken other action on it, please consult the legislative status sheet, the legislative
27-history, or the Session Laws.

43-commissioner district central committee of the same district and political
44-party as the vacating commissioner shall appoint a vacancy committee
45-whose sole purpose shall be to name a successor to the position of county
46-commissioner. I

60-SECTION 3. In Colorado Revised Statutes, 22-2-105.5, amend
61-(3)(a) as follows:
62-22-2-105.5. State board of education - definitions - vacancies -
63-procedure for filling. (3) (a) Any vacancy occurring on the state board,
64-other than a vacancy in a seat filled by a member elected from the state at
65-large, shall be filled by the vacancy committee of the party congressional
66-central committee of the same political party as the vacating board member
67-for the congressional district represented by the vacating board member.

75-the party congressional central committee shall perform the functions of the
76-vacancy committee.

78-applicability. (1) This act takes effect at 12:01 a.m. on the day following
79-the expiration of the ninety-day period after final adjournment of the
80-general assembly; except that, if a referendum petition is filed pursuant to
81-section 1 (3) of article V of the state constitution against this act or an item,
82-section, or part of this act within such period, then the act, item, section, or
83-part will not take effect unless approved by the people at the general
84-election to be held in November 2022 and, in such case, will take effect on
85-the date of the official declaration of the vote thereon by the governor.

22+Under current law, a vacancy in the office of many political
23+officials is filled by a vacancy committee. A vacancy committee is
24+selected by the relevant central committee. The bill requires central
25+committees to include on the vacancy committee at least all of the
26+precinct committeepersons of the central committee's political party for
27+each election precinct within the district administered by the central

99+vacating board member. FOR PURPOSES OF THIS SECTION, IN SELECTING24
100+THE MEMBERS OF A VACANCY COMMITTEE, THE CENTRAL COMMITTEE OF25
101+A JURISDICTION SHALL SELECT, AT A MINIMUM, THE MEMBERS OF THE26
102+JURISDICTION'S CENTRAL COMMITTEE. If no vacancy committee of the27

105+central committee shall perform the functions of the vacancy committee. 2
106+SECTION 4. Act subject to petition - effective date -3
107+applicability. (1) This act takes effect at 12:01 a.m. on the day following4
108+the expiration of the ninety-day period after final adjournment of the5
109+general assembly; except that, if a referendum petition is filed pursuant6
110+to section 1 (3) of article V of the state constitution against this act or an7
111+item, section, or part of this act within such period, then the act, item,8
112+section, or part will not take effect unless approved by the people at the9
113+general election to be held in November 2022 and, in such case, will take10
114+effect on the date of the official declaration of the vote thereon by the11
115+governor.12
116+(2) This act applies to vacancies occurring on or after the13
117+applicable effective date of this act.14
