2222 With certain exceptions, current law prohibits a concealed carry
2323 permit holder from carrying a concealed handgun on public elementary,
2424 middle, junior high, or high school grounds. The bill removes this
2525 limitation. The bill prohibits a local government from prohibiting carrying
2626 a concealed handgun on school grounds by a person who has a valid
2727 concealed carry permit.

3535 SECTION 1. In Colorado Revised Statutes, 18-12-214, add2

4242 TO CARRY A CONCEALED HANDGUN , INCLUDING A VALID TEMPORARY8
4343 EMERGENCY PERMIT, FROM CARRYING A CONCEALED HANDGUN ONTO THE9
4444 REAL PROPERTY, OR INTO ANY IMPROVEMENTS ERECTED THEREON , OF A10
4545 PUBLIC ELEMENTARY, MIDDLE, JUNIOR HIGH, OR HIGH SCHOOL.11
4646 (3) A permit issued pursuant to this part 2 does not authorize a

4848 person to carry a concealed handgun onto the real property, or into any13
4949 improvements erected thereon, of a public elementary, middle, junior14
5050 high, or high school; except that:15
5151 (a) A permittee may have a handgun on the real property of the16
5252 public school so long as the handgun remains in his or her vehicle and, if17
5353 the permittee is not in the vehicle, the handgun is in a compartment within18
5454 the vehicle and the vehicle is locked;19
5555 (b) A permittee who is employed or retained by contract by a20
5656 school district or charter school as a school security officer may carry a21
5757 concealed handgun onto the real property, or into any improvement22
5858 erected thereon, of a public elementary, middle, junior high, or high23
5959 school while the permittee is on duty;24
6060 (c) A permittee may carry a concealed handgun on undeveloped25
6161 real property owned by a school district that is used for hunting or other26

6363 SECTION 2. In Colorado Revised Statutes, 18-12-105.5, amend2
6464 (3) introductory portion and (3)(d.5); and repeal (3)(d) as follows:3
6565 18-12-105.5. Unlawfully carrying a weapon - unlawful4
6666 possession of weapons - school, college, or university grounds. (3) It5
6767 shall not be IS NOT an offense under this section if:6
6868 (d) The person, at the time of carrying a concealed weapon, held7
6969 a valid written permit to carry a concealed weapon issued pursuant to8
7070 section 18-12-105.1, as said section existed prior to its repeal; except that9
7171 it shall be an offense under this section if the person was carrying a10
7272 concealed handgun in violation of the provisions of section 18-12-21411
7373 (3); or12
7474 (d.5) The weapon involved was a handgun and the person held a13
7575 valid permit to carry a concealed handgun or a temporary emergency14
7676 permit issued pursuant to part 2 of this article; except that it shall be an15
7777 offense under this section if the person was carrying a concealed handgun16
7878 in violation of the provisions of section 18-12-214 (3) ARTICLE 12; or17
7979 SECTION 3. Safety clause. The general assembly hereby finds,18
8080 determines, and declares that this act is necessary for the immediate19
8181 preservation of the public peace, health, or safety.20
