With certain exceptions, current law prohibits a concealed carry permit holder from carrying a concealed handgun on public elementary, middle, junior high, or high school grounds. The bill removes this limitation. The bill prohibits a local government from prohibiting carrying a concealed handgun on school grounds by a person who has a valid concealed carry permit. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 18-12-214, add2 (1)(c)(III); and repeal (3) as follows:3 18-12-214. Authority granted by permit - carrying restrictions4 - local authority. (1) (c) (III) N OTWITHSTANDING THE AUTHORITY5 GRANTED PURSUANT TO SUBSECTION (1)(c)(I) OF THIS SECTION, A LOCAL6 GOVERNMENT MAY NOT PROHIBIT A PERSON WHO HOLDS A VALID PERMIT7 TO CARRY A CONCEALED HANDGUN , INCLUDING A VALID TEMPORARY8 EMERGENCY PERMIT, FROM CARRYING A CONCEALED HANDGUN ONTO THE9 REAL PROPERTY, OR INTO ANY IMPROVEMENTS ERECTED THEREON , OF A10 PUBLIC ELEMENTARY, MIDDLE, JUNIOR HIGH, OR HIGH SCHOOL.11 (3) A permit issued pursuant to this part 2 does not authorize a 12 person to carry a concealed handgun onto the real property, or into any13 improvements erected thereon, of a public elementary, middle, junior14 high, or high school; except that:15 (a) A permittee may have a handgun on the real property of the16 public school so long as the handgun remains in his or her vehicle and, if17 the permittee is not in the vehicle, the handgun is in a compartment within18 the vehicle and the vehicle is locked;19 (b) A permittee who is employed or retained by contract by a20 school district or charter school as a school security officer may carry a21 concealed handgun onto the real property, or into any improvement22 erected thereon, of a public elementary, middle, junior high, or high23 school while the permittee is on duty;24 (c) A permittee may carry a concealed handgun on undeveloped25 real property owned by a school district that is used for hunting or other26 HB22-1106-2- shooting sports.1 SECTION 2. In Colorado Revised Statutes, 18-12-105.5, amend2 (3) introductory portion and (3)(d.5); and repeal (3)(d) as follows:3 18-12-105.5. Unlawfully carrying a weapon - unlawful4 possession of weapons - school, college, or university grounds. (3) It5 shall not be IS NOT an offense under this section if:6 (d) The person, at the time of carrying a concealed weapon, held7 a valid written permit to carry a concealed weapon issued pursuant to8 section 18-12-105.1, as said section existed prior to its repeal; except that9 it shall be an offense under this section if the person was carrying a10 concealed handgun in violation of the provisions of section 18-12-21411 (3); or12 (d.5) The weapon involved was a handgun and the person held a13 valid permit to carry a concealed handgun or a temporary emergency14 permit issued pursuant to part 2 of this article; except that it shall be an15 offense under this section if the person was carrying a concealed handgun16 in violation of the provisions of section 18-12-214 (3) ARTICLE 12; or17 SECTION 3. Safety clause. The general assembly hereby finds,18 determines, and declares that this act is necessary for the immediate19 preservation of the public peace, health, or safety.20 HB22-1106 -3-
