44 | 44 | | health-care facility is required to allow compassionate care visits if |
---|
45 | 45 | | specific circumstances apply. A health-care facility may require |
---|
46 | 46 | | compassionate care visitors to pass a health screening and wear personal |
---|
47 | 47 | | protective equipment. |

48 | 48 | | Be it enacted by the General Assembly of the State of Colorado:1 |
---|
49 | 49 | | SECTION 1. Legislative declaration. (1) The general assembly2 |
---|
50 | 50 | | hereby finds and declares that:3 |
---|
51 | 51 | | (a) The COVID-19 pandemic has caused great uncertainty and4 |
---|
52 | 52 | | anxiety across our state and has significantly affected patients and5 |
---|
53 | 53 | | residents in health-care facilities;6 |
---|
54 | 54 | | (b) Health-care facilities have made efforts to keep patients,7 |
---|
55 | 55 | | residents, and employees safe;8 |
---|
56 | 56 | | (c) As a result of COVID-19 prevention measures, patients and9 |
---|
57 | 57 | | residents of health-care facilities have faced many unintended10 |
---|
58 | 58 | | consequences;11 |
---|
59 | 59 | | (d) Numerous patients and residents of health-care facilities across12 |
---|
60 | 60 | | this state have been prohibited, as a result of visitation policies, from13 |
---|
61 | 61 | | having any visitors, including a spouse, parent, close family member,14 |
---|
62 | 62 | | guardian, health-care agent, clergy member, or caregiver;15 |
---|
63 | 63 | | (e) Many families have been unable to be physically present with16 |
---|
64 | 64 | | their loved ones while in a hospital, nursing care facility, assisted living17 |
---|
65 | 65 | | HB22-1199-2- residence, hospice care facility, or residential treatment setting for1 |
---|
66 | 66 | | individuals with a mental health disorder, developmental or intellectual2 |
---|
67 | 67 | | disability, or substance use disorder, and families have been limited to3 |
---|
68 | 68 | | electronic video communications, if any, with their loved ones;4 |
---|
69 | 69 | | (f) The patients and residents who have been affected by lack of5 |
---|
70 | 70 | | visitation rights at health-care facilities encompass all ethnicities, genders,6 |
---|
71 | 71 | | and races in our society and include adults, minors, and individuals with7 |
---|
72 | 72 | | intellectual or developmental disabilities; and8 |
---|
73 | 73 | | (g) Patients who experience social isolation and loneliness are at9 |
---|
74 | 74 | | a much greater risk of early mortality.10 |
---|
75 | 75 | | (2) The general assembly finds that it is in the interest of the state11 |
---|
76 | 76 | | that patients and residents of health-care facilities, in compliance with12 |
---|
77 | 77 | | state laws and local ordinances, should not be denied visitors of their13 |
---|
78 | 78 | | choosing throughout their period of hospitalization, residency, or14 |
---|
79 | 79 | | residential treatment.15 |
