13		-	SECTION 1. In Colorado Revised Statutes, 42-1-211, amend (2)
14		-	as follows:

	46	+	(department) uses the fund primarily to fund the issuance of those
	47	+	documents.
	48	+	The Colorado DRIVES vehicle services account (DRIVES
	49	+	account) of the highway users tax fund consists mainly of vehicle title and
	50	+	registration fees and specific ownership tax transaction fees. The
	51	+	department uses the DRIVES account for the development and operation
	52	+	of the department's driver and motor vehicles services software platform
	53	+	commonly known as Colorado DRIVES.
	54	+	Effective July 1, 2022, the bill merges the fund into the DRIVES
	55	+	account, which involves:
	56	+	! Repealing the fund and requiring all money in the fund to
	57	+	be credited to the DRIVES account;
	58	+	! Requiring all fees that had been credited to the fund to
	59	+	instead be credited to the DRIVES account; and
	60	+	! Requiring all functions that had been funded from the fund
	61	+	to instead be funded from the DRIVES account.
	62	+	The bill also requires DRIVES account investment earnings to be
	63	+	credited to the account.
	64	+	Sections 1, 2, and 21 of the bill contain its substantive provisions.
	65	+	Sections 3 through 20 make conforming amendments.
	66	+	Be it enacted by the General Assembly of the State of Colorado:1
	67	+	SECTION 1. In Colorado Revised Statutes, 42-1-211, amend (2)2
	68	+	as follows:3
	69	+	42-1-211. Driver's license, record, identification, and vehicle4
16	70		enterprise solution. (2) (a) Repealed.
17		-	(b) (I) There is hereby created the Colorado DRIVES vehicle
18		-	services account in the highway users tax fund for the purpose of providing
19		-	funds for the development and operation of Colorado DRIVES, including
20		-	operations performed under articles 2, 3, 4, 6, 7, and 12 of this title 42, to
21		-	cover the costs of administration and enforcement of the motorist insurance
22		-	NOTE: This bill has been prepared for the signatures of the appropriate legislative
23		-	officers and the Governor. To determine whether the Governor has signed the bill
24		-	or taken other action on it, please consult the legislative status sheet, the legislative

	80	+	1339-2- fees imposed by section SECTIONS 38-29-138 (1), (2), (4), and (5), and1
	81	+	sections 42-1-206 (2)(a), 42-1-210 (1)(a)(II), 42-1-231, 42-1-233 (3)(b),2
	82	+	42-2-107 (1)(a)(I), 42-2-114 (2)(b), (2)(c)(I), (2)(c)(II), (2)(e), and3
	83	+	(4)(a), 42-2-114.5 (1), 42-2-117 (1), 42-2-118 (1)(b)(I)(C) and (1.5)(b),4
	84	+	42-2-133 (2), 42-2-306 (2), 42-2-406 (1), (2), (3)(d), and (6), 42-2-5085
	85	+	(1), 42-3-107 (22), 42-3-213 (1)(b)(IV), 42-3-304 (18)(d)(I)(B), 42-3-3066

	89	+	private or public sources for the purposes of this section, shall be credited10
	90	+	by the state treasurer to the Colorado DRIVES vehicle services account.11

56		-	SECTION 2. In Colorado Revised Statutes, 42-2-114.5, amend (1)
57		-	and (3); and add (5) and (6) as follows:
58		-	42-2-114.5. Fees for drivers' licenses, identification cards, and
59		-	related services - crediting to DRIVES account - fee setting procedures
60		-	- rules - repeal. (1) The licensing services cash fund is hereby created in
61		-	the state treasury. The general assembly shall appropriate moneys in the
62		-	fund to the department for the cost of implementing this article ALL NET
63		-	REVENUE RECEIVED BY THE DEPARTMENT FROM THE FEES SPECIFIED IN
64		-	SUBSECTION
65		-	(2) OF THIS SECTION, AS SUCH FEES MAY BE RAISED OR
66		-	LOWERED BY THE DEPARTMENT IN ACCORDANCE WITH SUBSECTION
67		-	(3) OF
68		-	THIS SECTION
69		-	, SHALL BE CREDITED TO THE COLORADO DRIVES VEHICLE
70		-	SERVICES ACCOUNT CREATED IN SECTION
71		-	42-1-211 (2).
72		-	(3) (a) Except as set forth in paragraph (b) of this subsection (3),
73		-	beginning July 1, 2015, The department may raise or lower the fees listed
74		-	PAGE 2-HOUSE BILL 22-1339 in subsection (2) of this section, but the department shall not increase the
75		-	fee by more than twenty percent before July 1, 2016, or by more than five
76		-	percent per year. on or after July 1, 2016.
77		-	(b) The department shall not raise or lower the fees listed in
78		-	paragraphs (a), (b), (f), (g), (n), and (o) of subsection (2) of this section
79		-	before July 1, 2017, and the fee listed in paragraph (d) of subsection (2) of
80		-	this section before July 1, 2019.
81		-	(5) (a) ON JULY 1, 2022, THE STATE TREASURER SHALL TRANSFER
82		-	ALL MONEY IN THE LICENSING SERVICES CASH FUND THAT WAS CREATED IN
83		-	SUBSECTION
84		-	(1) OF THIS SECTION AS IT EXISTED PRIOR TO JULY 1, 2022, TO
85		-	THE
86		-	COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED IN SECTION
87		-	42-1-211 (2).

	103	+	SECTION 2. In Colorado Revised Statutes, 42-2-114.5, amend21

114		-	SECTION 4. In Colorado Revised Statutes, 39-28.8-501, amend
115		-	PAGE 3-HOUSE BILL 22-1339 (7)(a) as follows:
116		-	39-28.8-501. Marijuana tax cash fund - creation - distribution
117		-	- legislative declaration - repeal. (7) (a) On July 1, 2022, and on July 1 of
118		-	each year thereafter, the state treasurer shall make the following transfers
119		-	from the fund:
120		-	(I) Seven hundred fifty-three thousand dollars to the licensing
121		-	services cash fund created in section 42-2-114.5 COLORADO DRIVES
122		-	VEHICLE SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2) for use by
123		-	the hearings division; and
124		-	(II) Six hundred forty-eight thousand dollars to the licensing
125		-	services cash fund created in section 42-2-114.5 COLORADO DRIVES
126		-	VEHICLE SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2) for use by
127		-	the division of motor vehicles.
128		-	SECTION 5. In Colorado Revised Statutes, 42-1-206, amend (2)(a)
129		-	as follows:
130		-	42-1-206. Records open to inspection - furnishing of copies -
131		-	rules. (2) (a) Except as provided in subsection (6) of this section, upon
132		-	written application and the payment of a fee per copy, or a record search for
133		-	each copy requested, the department shall furnish to any person a
134		-	photostatic copy of any specified record or accident report specifically made
135		-	a public record by this title and shall, if requested, certify the same. The
136		-	department shall set the fee in accordance with section 42-2-114.5. The
137		-	department shall transfer the fee to the state treasurer, who shall credit the
138		-	fee to the licensing services cash fund; except that the treasurer shall credit:
139		-	(I) Ten cents of each fee collected by the authorized agent to the
140		-	special purpose account established under section 42-1-211; and
141		-	(II) The entire fee for vehicle and manufactured home records, if
142		-	collected directly by the department, to the special purpose account
143		-	established under section 42-1-211 COLORADO DRIVES VEHICLE SERVICES
144		-	ACCOUNT CREATED IN SECTION
145		-	42-1-211 (2).
146		-	SECTION 6. In Colorado Revised Statutes, 42-1-233, amend
147		-	(3)(b) as follows:

149		-	providing services to register Class A commercial vehicles - rules.
150		-	(3) (b) The department shall transfer any money accepted under this
151		-	subsection (3) to the state treasurer, who shall credit it to the Colorado
152		-	DRIVES vehicle services account created in section 42-1-211 (2)(b)(I)
153		-	SECTION 42-1-211 (2).
154		-	SECTION 7. In Colorado Revised Statutes, 42-2-107, amend
155		-	(1)(a)(I) as follows:
156		-	42-2-107. Application for license or instruction permit -
157		-	anatomical gifts - donations to Emily Keyes - John W. Buckner organ
158		-	and tissue donation awareness fund - legislative declaration - rules -
159		-	annual report - repeal. (1) (a) (I) To be acceptable, every application for
160		-	an instruction permit or for a driver's or minor driver's license must be made
161		-	upon forms furnished by the department and accompanied by the required
162		-	fee. The department shall set the fee in accordance with section 42-2-114.5
163		-	(2). The department shall transfer the fee to the state treasurer, who shall
164		-	credit it to the licensing services cash fund created in section 42-2-114.5 (1)
165		-	COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED IN SECTION
166		-	42-1-211 (2). Every applicant shall submit with the application proof of age
167		-	or proof of identity, or both, as the department may require.
168		-	SECTION 8. In Colorado Revised Statutes, amend 42-2-113 as
169		-	follows:
170		-	42-2-113. License examiners appointed. The department may
171		-	appoint license examiners for any county in this state to conduct local
172		-	examinations for all types of drivers' licenses. The officers of the
173		-	department shall conduct the examination as prescribed by law for all
174		-	drivers in the county and collect the fees as provided in section 42-2-114
175		-	and remit the same to the department, which shall transfer the same to the
176		-	credit of the highway users tax fund. except that, for fiscal years 2012-13
177		-	through 2014-15, to the state treasurer, who shall credit the fees to the
178		-	licensing services cash fund created in section 42-2-114.5.
179		-	SECTION 9. In Colorado Revised Statutes, 42-2-114, amend
180		-	(2)(b), (2)(c) introductory portion, (2)(c)(I), (2)(c)(II), (2)(e), and (4)(a) as
181		-	follows:

184		-	the fee to the state treasurer, who shall credit the fee to the licensing

186		-	VEHICLE SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2).
187		-	(c) Notwithstanding paragraph (b) of this subsection (2) SUBSECTION
188		-	(2)(b) OF THIS SECTION:
189		-	(I) If the driver's license is issued by the office of a county clerk and
190		-	recorder in a county with a population of at least one hundred thousand
191		-	individuals, the county clerk and recorder shall retain the sum set forth in
192		-	subparagraph (I.5) of this paragraph (c)
193		-	SUBSECTION (2)(c)(I.5) OF THIS
194		-	SECTION
195		-	and forward the remainder to the department for transmission to
196		-	the state treasurer, who shall credit the remainder of the fee to the licensingservices cash fund COLORADO DRIVES VEHICLE SERVICES ACCOUNT
197		-	CREATED IN SECTION
198		-	42-1-211 (2).
199		-	(II) If the driver's license is issued by an office of a county clerk and
200		-	recorder in a county with a population of fewer than one hundred thousand
201		-	individuals, the county clerk and recorder shall retain the sum set forth in
202		-	subparagraph (II.5) of this paragraph (c)

205		-	and forward the remainder to the department for transmission to

209		-	(e) In addition to the fee established in paragraph (a) of thissubsection (2) SUBSECTION (2)(a) OF THIS SECTION, a surcharge is added for
210		-	issuance of a driver's or minor driver's license, or instruction permit, when
211		-	an applicant retakes either the examination of knowledge of the traffic laws
212		-	of this state or the demonstration of the applicant's ability to exercise
213		-	ordinary and reasonable care and control in the operation of a motor
214		-	vehicle. The surcharge applies regardless of whether the applicant retakes
215		-	the examination or demonstration with the department or a vendor approved
216		-	by the department. The department shall set the surcharge by rule in an
217		-	amount to offset the direct and indirect cost of giving the failed examination
218		-	or demonstration. The department shall transfer the surcharge to the state

222		-	(4) (a) A fee is required for the issuance of a minor driver's license,
223		-	which expires twenty days after the twenty-first birthday of the licensee.
224		-	The department shall set the fee in accordance with section 42-2-114.5 (2).
225		-	The department shall transfer the fee to the state treasurer, who shall credit
226		-	it to the licensing services cash fund created in section 42-2-114.5 (1)

238		-	this article is lost, stolen, or destroyed, the person to whom it was issued,
239		-	upon request and the payment of a fee to the department, may obtain a
240		-	duplicate or substitute upon furnishing satisfactory proof to the department
241		-	that the permit or minor license was lost, stolen, or destroyed and that the
242		-	applicant is qualified to have a permit or license. The department shall set
243		-	the fees for a first duplicate and for any subsequent duplicate in accordance
244		-	with section 42-2-114.5. The department shall transfer either fee to the state
245		-	treasurer, who shall credit it to the licensing services cash fund created in
246		-	section 42-2-114.5 COLORADO DRIVES VEHICLE SERVICES ACCOUNT

249		-	SECTION 11. In Colorado Revised Statutes, 42-2-118, amend

	210	+	application proof of age or proof of identity, or both, as the department11

	212	+	SECTION 8. In Colorado Revised Statutes, amend 42-2-113 as13

	214	+	42-2-113. License examiners appointed. The department may15
	215	+	appoint license examiners for any county in this state to conduct local16
	216	+	examinations for all types of drivers' licenses. The officers of the17
	217	+	department shall conduct the examination as prescribed by law for all18
	218	+	drivers in the county and collect the fees as provided in section 42-2-11419
	219	+	and remit the same to the department, which shall transfer the same to the20
	220	+	credit of the highway users tax fund. except that, for fiscal years 2012-1321
	221	+	through 2014-15, to the state treasurer, who shall credit the fees to the22
	222	+	licensing services cash fund created in section 42-2-114.5.23
	223	+	SECTION 9. In Colorado Revised Statutes, 42-2-114, amend24

	259	+	when an applicant retakes either the examination of knowledge of the26
	260	+	traffic laws of this state or the demonstration of the applicant's ability to27

	262	+	-8- exercise ordinary and reasonable care and control in the operation of a1
	263	+	motor vehicle. The surcharge applies regardless of whether the applicant2
	264	+	retakes the examination or demonstration with the department or a vendor3
	265	+	approved by the department. The department shall set the surcharge by4
	266	+	rule in an amount to offset the direct and indirect cost of giving the failed5
	267	+	examination or demonstration. The department shall transfer the6
	268	+	surcharge to the state treasurer, who shall credit it to the licensing7
	269	+	services cash fund, created in section 42-2-114.5 COLORADO DRIVES8
	270	+	VEHICLE SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2).9
	271	+	(4) (a) A fee is required for the issuance of a minor driver's10
	272	+	license, which expires twenty days after the twenty-first birthday of the11

346		-	42-3-107. Taxable value of classes of property - rate of tax -
347		-	when and where payable - department duties - apportionment of tax
348		-	collections - definitions - rules - repeal. (22) Each authorized agent shall
349		-	retain, out of the amount of annual specific ownership tax collected on each
350		-	item of classified personal property, the sum of fifty cents which sum shall
351		-	constitute AS remuneration for the collection of such tax. The sums so
352		-	retained shall be transmitted to the county treasurer and credited in the
353		-	manner provided by law. In addition, each authorized agent shall retain, out
354		-	of the amount of annual specific ownership tax collected on each item of
355		-	classified personal property, the sum of fifty cents, which sum

371		-	SECTION 18. In Colorado Revised Statutes, amend 42-3-312 as
372		-	follows:
373		-	42-3-312. Special license plate surcharge. In addition to any other
374		-	fee imposed by this article 3, an applicant for a special license plate created
375		-	PAGE 10-HOUSE BILL 22-1339 by rule in accordance with section 42-3-207, as the section existed when the
376		-	plate was created, or special license plates issued pursuant to sections
377		-	42-3-211 to 42-3-214, sections 42-3-217 to 42-3-218, sections 42-3-221 to
378		-	42-3-234, sections 42-3-237 to 42-3-258, and section 42-3-260 shall pay an
379		-	issuance fee of twenty-five dollars; except that the fee is not imposed on
380		-	special license plates exempted from additional fees for the issuance of a
381		-	military special license plate by section 42-3-213 (1)(b)(II). The department
382		-	shall transfer the fee to the state treasurer, who shall credit it to the licensing
383		-	services cash fund created in section 42-2-114.5 COLORADO DRIVES
384		-	VEHICLE SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2).
385		-	SECTION 19. In Colorado Revised Statutes, 42-6-110, amend
386		-	(1.7)(c) as follows:
387		-	42-6-110. Certificate of title - transfer - department records -
388		-	rules - definition. (1.7) (c) The department may charge the insurer, the
389		-	insurer's agent, the salvage pool, a motor vehicle dealer, a used motor
390		-	vehicle dealer, or a person approved by the department a fee in an amount
391		-	not to exceed the lesser of five dollars or the direct and indirect costs of
392		-	implementing this subsection (1.7). The department shall deposit the fee in
393		-	the special purpose account created in section 42-1-211
394		-	COLORADO

396		-	SECTION 20. In Colorado Revised Statutes, 42-6-138, amend

	384	+	-12- SECTION 15. In Colorado Revised Statutes, 42-2-508, amend1
	385	+	(1) as follows:2
	386	+	42-2-508. Fees - operations - rule. (1) The department may3
	387	+	promulgate a rule imposing an additional fee for issuance of a document4
	388	+	issued under this part 5 to cover the direct and indirect cost of5
	389	+	implementing this part 5. The department shall set the fee in accordance6
	390	+	with section 42-2-114.5 (2). The department shall transfer the fees to the7
	391	+	state treasurer, who shall credit the fees to the licensing services cash8
	392	+	fund, created in section 42-2-114.5 (1) COLORADO DRIVES VEHICLE9
	393	+	SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2).10
	394	+	SECTION 16. In Colorado Revised Statutes, 42-3-107, amend11
	395	+	(22) as follows:12
	396	+	42-3-107. Taxable value of classes of property - rate of tax -13
	397	+	when and where payable - department duties - apportionment of tax14
	398	+	collections - definitions - rules - repeal. (22) Each authorized agent15
	399	+	shall retain, out of the amount of annual specific ownership tax collected16
	400	+	on each item of classified personal property, the sum of fifty cents which17
	401	+	sum shall constitute AS remuneration for the collection of such tax. The18
	402	+	sums so retained shall be transmitted to the county treasurer and credited19
	403	+	in the manner provided by law. In addition, each authorized agent shall20
	404	+	retain, out of the amount of annual specific ownership tax collected on21
	405	+	each item of classified personal property, the sum of fifty cents, which22
	406	+	sum shall be transmitted to the state treasurer who shall credit the same23
	407	+	AND CREDITED to the special purpose account established under section24
	408	+	42-1-211 COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED IN25
	409	+	SECTION 42-1-211 (2).26
	410	+	SECTION 17. In Colorado Revised Statutes, 42-3-213, amend27

	412	+	-13- (1)(b)(IV) as follows:1

	414	+	retirement. (1) (b) (IV) One dollar of each additional fee collected from3

	416	+	section shall be retained by the authorized agent, and one dollar and5
	417	+	fifteen cents of each additional fee shall be credited to the special purpose6
	418	+	account established under section 42-1-211 COLORADO DRIVES VEHICLE7
	419	+	SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2).8
	420	+	SECTION 18. In Colorado Revised Statutes, amend 42-3-312 as9

408		-	(2) The authorized agent shall dispose of all fees collected under
409		-	section 42-6-137 (5) or 38-29-138 (5) C.R.S.,
410		-	as follows:
411		-	(a) For a copy of a recorded certificate of title, six dollars and fifty
412		-	cents shall be retained by the authorized agent and disposition made as
413		-	PAGE 11-HOUSE BILL 22-1339 provided by law; and one dollar and seventy cents shall be credited to the
414		-	special purpose account established by section 42-1-211 COLORADO
415		-	DRIVES VEHICLE SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2);

417		-	(b) For assignment of a new identifying number to a motor or
418		-	off-highway vehicle or manufactured home, the authorized agent shall
419		-	retain two dollars and fifty cents and dispose of it as provided by law and
420		-	shall credit one dollar to the special purpose account established by section
421		-	42-1-211 COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED IN

433		-	SECTION 21. Effective date. (1) Except as otherwise provided in
434		-	this section, this act takes effect July 1, 2022.
435		-	(2) Section 4 of this act takes effect only if House Bill 22-1338 does
436		-	not become law.
