46+(department) uses the fund primarily to fund the issuance of those
47+documents.
48+The Colorado DRIVES vehicle services account (DRIVES
49+account) of the highway users tax fund consists mainly of vehicle title and
50+registration fees and specific ownership tax transaction fees. The
51+department uses the DRIVES account for the development and operation
52+of the department's driver and motor vehicles services software platform
53+commonly known as Colorado DRIVES.
54+Effective July 1, 2022, the bill merges the fund into the DRIVES
55+account, which involves:
56+! Repealing the fund and requiring all money in the fund to
57+be credited to the DRIVES account;
58+! Requiring all fees that had been credited to the fund to
59+instead be credited to the DRIVES account; and
60+! Requiring all functions that had been funded from the fund
61+to instead be funded from the DRIVES account.
62+The bill also requires DRIVES account investment earnings to be
63+credited to the account.
64+Sections 1, 2, and 21 of the bill contain its substantive provisions.
65+Sections 3 through 20 make conforming amendments.
66+Be it enacted by the General Assembly of the State of Colorado:1
67+SECTION 1. In Colorado Revised Statutes, 42-1-211, amend (2)2

17-(b) (I) There is hereby created the Colorado DRIVES vehicle
18-services account in the highway users tax fund for the purpose of providing
19-funds for the development and operation of Colorado DRIVES, including
20-operations performed under articles 2, 3, 4, 6, 7, and 12 of this title 42, to
21-cover the costs of administration and enforcement of the motorist insurance

56-SECTION 2. In Colorado Revised Statutes, 42-2-114.5, amend (1)

58-42-2-114.5. Fees for drivers' licenses, identification cards, and
59-related services - crediting to DRIVES account - fee setting procedures
60-- rules - repeal. (1) The licensing services cash fund is hereby created in
61-the state treasury. The general assembly shall appropriate moneys in the
62-fund to the department for the cost of implementing this article ALL NET
63-REVENUE RECEIVED BY THE DEPARTMENT FROM THE FEES SPECIFIED IN
64-SUBSECTION
65-(2) OF THIS SECTION, AS SUCH FEES MAY BE RAISED OR
66-LOWERED BY THE DEPARTMENT IN ACCORDANCE WITH SUBSECTION
67-(3) OF
68-THIS SECTION
69-, SHALL BE CREDITED TO THE COLORADO DRIVES VEHICLE
70-SERVICES ACCOUNT CREATED IN SECTION
71-42-1-211 (2).
72-(3) (a) Except as set forth in paragraph (b) of this subsection (3),
73-beginning July 1, 2015, The department may raise or lower the fees listed
74-PAGE 2-HOUSE BILL 22-1339 in subsection (2) of this section, but the department shall not increase the
75-fee by more than twenty percent before July 1, 2016, or by more than five
76-percent per year. on or after July 1, 2016.
77-(b) The department shall not raise or lower the fees listed in
78-paragraphs (a), (b), (f), (g), (n), and (o) of subsection (2) of this section
79-before July 1, 2017, and the fee listed in paragraph (d) of subsection (2) of
80-this section before July 1, 2019.
81-(5) (a) ON JULY 1, 2022, THE STATE TREASURER SHALL TRANSFER

128-SECTION 5. In Colorado Revised Statutes, 42-1-206, amend (2)(a)
129-as follows:
130-42-1-206. Records open to inspection - furnishing of copies -
131-rules. (2) (a) Except as provided in subsection (6) of this section, upon
132-written application and the payment of a fee per copy, or a record search for
133-each copy requested, the department shall furnish to any person a
134-photostatic copy of any specified record or accident report specifically made
135-a public record by this title and shall, if requested, certify the same. The
136-department shall set the fee in accordance with section 42-2-114.5. The
137-department shall transfer the fee to the state treasurer, who shall credit the
138-fee to the licensing services cash fund; except that the treasurer shall credit:
139-(I) Ten cents of each fee collected by the authorized agent to the
140-special purpose account established under section 42-1-211; and
141-(II) The entire fee for vehicle and manufactured home records, if
142-collected directly by the department, to the special purpose account
143-established under section 42-1-211 COLORADO DRIVES VEHICLE SERVICES

146-SECTION 6. In Colorado Revised Statutes, 42-1-233, amend

159-annual report - repeal. (1) (a) (I) To be acceptable, every application for
160-an instruction permit or for a driver's or minor driver's license must be made
161-upon forms furnished by the department and accompanied by the required
162-fee. The department shall set the fee in accordance with section 42-2-114.5
163-(2). The department shall transfer the fee to the state treasurer, who shall
164-credit it to the licensing services cash fund created in section 42-2-114.5 (1)
165-COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED IN SECTION
166-42-1-211 (2). Every applicant shall submit with the application proof of age
167-or proof of identity, or both, as the department may require.
168-SECTION 8. In Colorado Revised Statutes, amend 42-2-113 as
169-follows:
170-42-2-113. License examiners appointed. The department may
171-appoint license examiners for any county in this state to conduct local
172-examinations for all types of drivers' licenses. The officers of the
173-department shall conduct the examination as prescribed by law for all
174-drivers in the county and collect the fees as provided in section 42-2-114
175-and remit the same to the department, which shall transfer the same to the
176-credit of the highway users tax fund. except that, for fiscal years 2012-13
177-through 2014-15, to the state treasurer, who shall credit the fees to the
178-licensing services cash fund created in section 42-2-114.5.
179-SECTION 9. In Colorado Revised Statutes, 42-2-114, amend
180-(2)(b), (2)(c) introductory portion, (2)(c)(I), (2)(c)(II), (2)(e), and (4)(a) as
181-follows:

209-(e) In addition to the fee established in paragraph (a) of thissubsection (2) SUBSECTION (2)(a) OF THIS SECTION, a surcharge is added for
210-issuance of a driver's or minor driver's license, or instruction permit, when
211-an applicant retakes either the examination of knowledge of the traffic laws
212-of this state or the demonstration of the applicant's ability to exercise
213-ordinary and reasonable care and control in the operation of a motor
214-vehicle. The surcharge applies regardless of whether the applicant retakes
215-the examination or demonstration with the department or a vendor approved
216-by the department. The department shall set the surcharge by rule in an
217-amount to offset the direct and indirect cost of giving the failed examination
218-or demonstration. The department shall transfer the surcharge to the state
219-treasurer, who shall credit it to the licensing services cash fund, created in
220-section 42-2-114.5 COLORADO DRIVES VEHICLE SERVICES ACCOUNT

222-(4) (a) A fee is required for the issuance of a minor driver's license,
223-which expires twenty days after the twenty-first birthday of the licensee.
224-The department shall set the fee in accordance with section 42-2-114.5 (2).
225-The department shall transfer the fee to the state treasurer, who shall credit
226-it to the licensing services cash fund created in section 42-2-114.5 (1)
227-COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED IN SECTION
228-42-1-211 (2). In the case of the issuance of any minor driver's license by the
229-office of the county clerk and recorder, the fee for the minor driver's license
230-is apportioned in the same manner as for the issuance of a driver's license
231-in accordance with paragraph (c) of subsection (2)

233-this section.
234-SECTION 10. In Colorado Revised Statutes, 42-2-117, amend (1)
235-as follows:
236-42-2-117. Duplicate permits and minor licenses - replacement
237-licenses. (1) If an instruction permit or a minor driver's license issued under
238-this article is lost, stolen, or destroyed, the person to whom it was issued,
239-upon request and the payment of a fee to the department, may obtain a
240-duplicate or substitute upon furnishing satisfactory proof to the department
241-that the permit or minor license was lost, stolen, or destroyed and that the
242-applicant is qualified to have a permit or license. The department shall set
243-the fees for a first duplicate and for any subsequent duplicate in accordance
244-with section 42-2-114.5. The department shall transfer either fee to the state
245-treasurer, who shall credit it to the licensing services cash fund created in
246-section 42-2-114.5 COLORADO DRIVES VEHICLE SERVICES ACCOUNT

249-SECTION 11. In Colorado Revised Statutes, 42-2-118, amend
250-(1)(b)(I)(C) and (1.5)(b) as follows:

271+(4) (a) A fee is required for the issuance of a minor driver's10
272+license, which expires twenty days after the twenty-first birthday of the11
273+licensee. The department shall set the fee in accordance with section12
274+42-2-114.5 (2). The department shall transfer the fee to the state treasurer,13
275+who shall credit it to the licensing services cash fund created in section14
276+42-2-114.5 (1) COLORADO DRIVES VEHICLE SERVICES ACCOUNT15

414+retirement. (1) (b) (IV) One dollar of each additional fee collected from3
415+purchasers of license plates issued under subsections (4) and (5) of this4
416+section shall be retained by the authorized agent, and one dollar and5
417+fifteen cents of each additional fee shall be credited to the special purpose6
418+account established under section 42-1-211 COLORADO DRIVES VEHICLE7
419+SERVICES ACCOUNT CREATED IN SECTION 42-1-211 (2).8
420+SECTION 18. In Colorado Revised Statutes, amend 42-3-312 as9
421+follows:10
422+42-3-312. Special license plate surcharge. In addition to any11
423+other fee imposed by this article 3, an applicant for a special license plate12
424+created by rule in accordance with section 42-3-207, as the section existed13
425+when the plate was created, or special license plates issued pursuant to14
426+sections 42-3-211 to 42-3-214, sections 42-3-217 to 42-3-218, sections15
427+42-3-221 to 42-3-234, sections 42-3-237 to 42-3-258, and section16
428+42-3-260 shall pay an issuance fee of twenty-five dollars; except that the17
429+fee is not imposed on special license plates exempted from additional fees18
430+for the issuance of a military special license plate by section 42-3-21319
431+(1)(b)(II). The department shall transfer the fee to the state treasurer, who20
432+shall credit it to the licensing services cash fund created in section21
433+42-2-114.5 COLORADO DRIVES VEHICLE SERVICES ACCOUNT CREATED22

435+SECTION 19. In Colorado Revised Statutes, 42-6-110, amend24
436+(1.7)(c) as follows:25
437+42-6-110. Certificate of title - transfer - department records -26
438+rules - definition. (1.7) (c) The department may charge the insurer, the27

440+-14- insurer's agent, the salvage pool, a motor vehicle dealer, a used motor1
441+vehicle dealer, or a person approved by the department a fee in an amount2
442+not to exceed the lesser of five dollars or the direct and indirect costs of3
443+implementing this subsection (1.7). The department shall deposit the fee4
444+in the special purpose account created in section 42-1-211 COLORADO5
445+DRIVES

447+SECTION 20. In Colorado Revised Statutes, 42-6-138, amend7

412-cents shall be retained by the authorized agent and disposition made as

433-SECTION 21. Effective date. (1) Except as otherwise provided in
434-this section, this act takes effect July 1, 2022.
435-(2) Section 4 of this act takes effect only if House Bill 22-1338 does
436-not become law.
437-SECTION 22. Safety clause. The general assembly hereby finds,
