15-Be it enacted by the General Assembly of the State of Colorado:
16-SECTION 1. Legislative declaration. (1) The general assembly
17-hereby finds and declares that:
18-(a) Since 1998, the public safety communications network program,
19-in partnership with local government infrastructure owners, has provided a
20-statewide wireless system, called the digital trunked radio system, that
21-enables direct communications between first responders and public safety
22-agencies across jurisdictional and regional boundaries;
23-NOTE: This bill has been prepared for the signatures of the appropriate legislative
24-officers and the Governor. To determine whether the Governor has signed the bill
25-or taken other action on it, please consult the legislative status sheet, the legislative
26-history, or the Session Laws.

31-program from the governor's office of information technology to the

35-users and stakeholders is imperative to ensure that the state continues to
36-have a reliable public safety communications network that ensures the
37-well-being of all Coloradans; and
38-(d) The governor's office of information technology and the
39-Colorado department of public safety will prioritize maintaining complete
40-network reliability and operational efficiency as they coordinate the transfer
41-of the digital trunked radio system.
42-SECTION 2. In Colorado Revised Statutes, 2-3-1704, repeal (3)
43-as follows:
44-2-3-1704. Powers and duties of the joint technology committee.
45-(3) The committee oversees any telecommunications coordination within
46-state government that the chief information officer performs pursuant to
47-part 5 of article 37.5 of title 24, C.R.S.

49+pursuant to the "State Measurement for Accountable, Responsive, and
50+Transparent (SMART) Government Act".
51+Currently, the chief information officer in the office of information
52+technology exercises the powers, duties, and functions related to public
53+safety telecommunications coordination within state government (public
54+safety communications). On July 1, 2022, the bill transfers these powers,
55+duties, and functions to the department of public safety (department). The
56+transferred powers, duties, and functions are allocated to the division of
57+homeland security and emergency management (division) in the
58+department. In addition, the bill transfers employees, property, and
59+policies of the office of information technology related to public safety
60+communications to the division.
61+The bill creates the office of public safety communications in the
62+division (office) and creates the director of the office. The bill relocates
63+the existing state public safety communications network in the office and
64+specifies the duties and responsibilities of the director of the office that
65+were formerly the duties and responsibilities of the chief information
66+officer of the office of information technology. The duties and
67+responsibilities include:
68+! Formulating recommendations for a current and long-range
69+public safety communications plan and administering the
70+plan;
71+! Reviewing all existing and future state-owned public safety
72+communications applications, planning, networks, systems,
73+programs, equipment, and facilities and establishing
74+priorities for those applications;
75+! Approving the acquisition of public safety communications
76+equipment by any state entity;
77+! Establishing and enforcing public safety communications
78+policies, procedures, standards, and records for
79+management of public safety communications networks
80+and facilities for all state entities;
81+! Reviewing, assessing, and ensuring compliance with
82+federal and state public safety communications regulations
83+pertaining to the needs and functions of state entities;
84+! Advising the governor and general assembly on public
85+safety communications matters;
86+! Administering the public safety communications trust fund;
87+! Adopting recommended standards for the replacement of
88+analog-based radio equipment with digital-based radio
89+equipment for purposes of dispatching and related
90+functions within the department of public safety; and
91+! For purposes of serving the radio communications needs of
92+1353
93+-2- state departments, adopting standards and policies and
94+setting a recommended timetable for the replacement of
95+existing radio public safety communications equipment
96+with a system that satisfies the requirements of the federal
97+communications commission public safety national plan.
98+The director of the office may enter into contracts, formerly
99+entered into by the chief information officer, with specified public entities
100+and may act as a public safety communications network provider to
101+provide public safety radio communications between or among 2 or more
102+counties or state agencies.
103+The bill specifies when users of public safety radio systems,
104+including public entities and privately owned businesses, will be charged
105+fees for the service, including the cost of material, labor, and overhead.
106+The executive director of the department is required to exercise the
107+powers, duties, and functions regarding the existing tactical and long-term
108+interoperable communications plan to improve the ability of the public
109+safety agencies of state government to communicate with public safety
110+agencies of the federal government, regions, local governments, and other
111+states. The director of the office is required to update and revise the
112+tactical and long-term interoperable communications plan at least once
113+every 3 years.
114+The bill relocates the existing public safety communications trust
115+fund, specifies the sources of money in the fund, and specifies the
116+purposes for which money in the fund must be used.
117+Be it enacted by the General Assembly of the State of Colorado:1
