ONCERNING THE AUTHORITY OF HISTORY COLORADO TO DISPOSE OF THREE
PROPERTIES
, AND, IN CONNECTION THEREWITH, AUTHORIZING THE
DISPOSAL OF THE REAL PROPERTIES KNOWN AS THE 
MCFARLANE
HOUSE IN CENTRAL CITY, THE PEARCE-MCALLISTER COTTAGE IN
DENVER, AND THE PUEBLO MUSEUM SUPPORT CENTER IN PUEBLO.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1.  Legislative declaration. (1)  The general assembly
finds and declares that:
(a)  In 1976, the state historical society, also known as history
Colorado, acquired property known as the McFarlane House in Central
City, Colorado, when the property was gifted to history Colorado by the
then-manager of the Central City Opera. The property has primarily been
used by the Central City Opera, which has leased the building since it was
gifted to history Colorado.
NOTE:  This bill has been prepared for the signatures of the appropriate legislative
officers and the Governor.  To determine whether the Governor has signed the bill
or taken other action on it, please consult the legislative status sheet, the legislative
history, or the Session Laws.

the act. (b)  In 1972, history Colorado acquired the Pearce-McAllister
Cottage in Denver, Colorado. The facility was the Denver Museum of
Miniatures, Dolls and Toys for 30 years until 2018. The facility is
challenging to maintain because it is currently vacant.
(c)  In 1955, history Colorado acquired the Pueblo Museum Support
Center in Pueblo, Colorado, which is a building adjacent to the state
fairgrounds. The facility has been used for storage; however, artifacts that
were at the facility have been moved to a storage facility in Denver for
easier access by history Colorado staff.
(d)  History Colorado has determined that these three properties no
longer fit within its mission and that disposing of the properties would be
in the best interests of the organization. The disposition of the properties
also aligns with the goal of finding beneficial uses of unused or
underutilized state properties and supports the goals of reducing the
footprint of state government and responsible management of the state
budget and state facilities.
SECTION 2.  History Colorado authority to dispose of real
property. (1)  The state of Colorado, acting by and through the state
historical society, also known as history Colorado, is authorized to dispose
of real property located at the following locations:
(a)  217 Eureka Street, Central City, Colorado, 80427, lot 10, block
11, City of Central, State of Colorado;
(b)  1880 Gaylord Street, Denver, Colorado, 80206, lots 7-10
inclusive, block 5, Park Side Subdivision, City and County of Denver, State
of Colorado; and
(c)  905 South Prairie Avenue, Pueblo, Colorado, 81005, lot 16,
block 1, Sunset Park 1st Sunset Park Subdivision, City of Pueblo, State of
Colorado.
(2)  The capital development committee and the state controller must
approve all agreements relating to the disposition of the real property
described in subsection (1) of this section prior to closing.
PAGE 2-HOUSE BILL 23-1141 (3)  The proceeds of the disposition of the real property described in
subsection (1) of this section must be credited to the state museum cash
fund created in section 24-80-214, Colorado Revised Statutes, to be used in
connection with the acquisition or construction of a consolidated collections
care and storage facility or for controlled maintenance.
SECTION 3. Safety clause. The general assembly hereby finds,
determines, and declares that this act is necessary for the immediate
preservation of the public peace, health, or safety.
