Create and maintain a resource bank for research, intervention methods, treatment resources, information on crisis services, awareness programs, and educational resources regarding disordered eating prevention and care in Colorado; ! Collaborate with the office of suicide prevention, the behavioral health administration, and organizations within the health-care industry to close gaps in care and provide support to individuals with disordered eating who transition out of inpatient care, facilitate public outreach, and increase awareness regarding disordered eating prevention and care with a focus on impacted communities, such as youth, people of color, and lesbian, gay, bisexual, and transgender individuals; ! Create outreach resources directing youth on how to seek care for disordered eating and how to report concerns for other youth, with a focus on impacted communities, such as lesbian, gay, bisexual, and transgender youth and youth of color; ! Partner with the department of education to inform teachers, administrators, school staff, students, and parents on disordered eating preventions and treatment for youth; ! Collaborate with advocacy groups, including faith-based organizations, to support a shift in public perception regarding health-care systems and disordered eating treatment and prevention; ! Coordinate the disordered eating prevention research grant program; and ! Prepare written information for primary care offices and providers throughout the state. The information must be culturally specific concerning how to recognize and respond to a patient with disordered eating and include separate written information for providers and information that may be shared with an adult patient or a youth patient and the caregivers of the youth patient. The bill creates the disordered eating prevention commission (commission) in the department. The commission will have 17 members with professional or personal connections to disordered eating prevention. The purpose of the commission is to: ! Provide public and private leadership on disordered eating prevention in Colorado; ! Set statewide, data-driven, evidence-based, and clinically informed priorities for disordered eating prevention in Colorado; 014 -2- ! Serve as the advisor to the office of disordered eating prevention; ! Establish and lead subgroups to set strategy and implementation plans for the office; ! Provide a forum for government agencies, community members, and lawmakers to examine the current status of disordered eating prevention policies; ! Provide a voice for youth and focus on youth issues; ! Provide a forum for diverse perspectives to support and inform diverse communities; and ! Provide a forum for perspectives from rural communities to support and inform rural communities. The bill creates the disordered eating prevention research grant program (grant program) in the department. The purpose of the grant program is to provide financial assistance to eligible applicants to conduct research on risk factors for disordered eating, the impact disordered eating has on Colorado, or public health interventions that examine and address the root causes of disordered eating. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add part 20 to article2 20.5 of title 25 as follows:3 PART 204 DISORDERED5 EATING PREVENTION PROGRAM6 25-20.5-2001. Legislative declaration. (1) T HE GENERAL7 ASSEMBLY FINDS AND DECLARES THAT :8 (a) E ATING DISORDERS ARE INCREASINGLY RECOGNIZED AS A9 LEADING CAUSE OF MORBIDITY AND MORTALITY ;10 (b) I N 2015, COLORADO HAD THE FIFTH-HIGHEST RATE OF EATING11 DISORDERS IN THE COUNTRY AMONG YOUTH ;12 13 (c) PEOPLE OF COLOR; LESBIAN, GAY, BISEXUAL, OR TRANSGENDER14 INDIVIDUALS; YOUTH; AND OLDER COLORADANS ARE MORE LIKELY TO15 014-3- SUFFER FROM DISORDERED EATING BUT LESS LIKELY TO RECEIVE EATING1 DISORDER TREATMENT, CREATING A DISPROPORTIONATE GAP IN EATING2 DISORDER PREVENTION AND CARE ; AND3 (d) THERE IS LIMITED STATE-SPECIFIC RESEARCH ON DISORDERED4 EATING AND ITS IMPACTS ON THE STATE OF COLORADO.5 (2) T HE GENERAL ASSEMBLY FINDS , THEREFORE, THAT TO6 UNDERSTAND DISORDERED EATING AND ITS IMPACTS ON COLORADANS,7 THE STATE MUST FOCUS ON DEVELOPING RESEARCH AND RESOURCES TO8 EDUCATE COLORADANS ON THE SEVERITY OF DISORDERED EATING , 9 PREVENT DISORDERED EATING IN COLORADO, AND SUPPORT COLORADANS10 WHO DEVELOP DISORDERED EATING . IT IS ALSO IMPORTANT TO RECOGNIZE11 THAT DISORDERED EATING HARMS AND INCREASES THE MORTALITY RATE12 OF PEOPLE OF COLOR; LESBIAN, GAY, BISEXUAL, OR TRANSGENDER13 INDIVIDUALS; YOUTH; AND OLDER COLORADANS.14 25-20.5-2002. Definitions. A S USED IN THIS PART 20, UNLESS THE15 CONTEXT OTHERWISE REQUIRES :16 17 (1) "D ISORDERED EATING" MEANS A RANGE OF IRREGULAR EATING18 DISORDERS THAT MAY WARRANT A DIAGNOSIS .19 (2) "D ISORDERED EATING PREVENTION PROGRAM " OR "PROGRAM" 20 MEANS THE DISORDERED EATING PREVENTION PROGRAM CREATED IN21 SECTION 25-20.5-2003.22 (3) "DISORDERED EATING PREVENTION RESEARCH GRANT23 PROGRAM" OR "GRANT PROGRAM" MEANS THE DISORDERED EATING24 PREVENTION RESEARCH GRANT PROGRAM CREATED IN SECTION25 25-20.5-2005.26 27 014 -4- (4) "YOUTH" MEANS AN INDIVIDUAL WHO IS LESS THAN1 TWENTY-FIVE YEARS OF AGE.2 25-20.5-2003. Disordered eating prevention program -3 creation - reports. (1) O N OR BEFORE JULY 1, 2024, THE DISORDERED 4 EATING PREVENTION PROGRAM IS CREATED IN THE DEPARTMENT WITHIN5 THE PREVENTION SERVICES DIVISION , ESTABLISHED IN SECTION6 25-20.5-103.7 (2) T HE DIVISION SHALL: 8 (a) C REATE AND MAINTAIN AN EXTERNAL -FACING RESOURCE THAT 9 IS UPDATED ANNUALLY AND INCLUDES KEY INFORMATION ABOUT10 DISORDERED EATING, INCLUDING RISK FACTORS AND PREVENTION11 FACTORS. THE EXTERNAL-FACING RESOURCE MUST BE CULTURALLY12 SENSITIVE, AND, WHEN POSSIBLE, AVAILABLE IN BOTH ENGLISH AND13 S PANISH. 14 (b) C OLLABORATE WITH THE OFFICE OF SUICIDE PREVENTION , 15 CREATED IN SECTION 25-1.5-101 (1)(w), AND OTHER PROGRAMS WITHIN16 THE DIVISION TO ALIGN WORK FOCUSED ON DISORDERED EATING ,17 FACILITATE PUBLIC OUTREACH, AND INCREASE AWARENESS REGARDING18 DISORDERED EATING PREVENTION WITH A FOCUS ON IMPACTED19 COMMUNITIES, SUCH AS YOUTH, OLDER COLORADANS, PEOPLE OF COLOR,20 AND LESBIAN, GAY, BISEXUAL AND TRANSGENDER INDIVIDUALS ;21 (c) P ARTNER WITH THE DEPARTMENT OF EDUCATION TO INFORM 22 TEACHERS, ADMINISTRATORS, SCHOOL STAFF, STUDENTS AND PARENTS ON23 DISORDERED EATING PREVENTION ; AND24 (d) C OORDINATE THE DISORDERED EATING PREVENTION RESEARCH 25 GRANT PROGRAM.26 (3) T HE DIVISION MAY: 27 014 -5- (a) CONTRACT WITH A THIRD-PARTY TO CONDUCT FOCUS GROUPS ,1 INTERVIEW KEY INDIVIDUALS , CONDUCT SURVEYS, AND ESTABLISH A2 COLLABORATIVE GROUP TO DISCUSS KEY ISSUES REGARDING DISORDERED3 EATING PREVENTION;4 (b) P ARTNER WITH THE BEHAVIORAL HEALTH ADMINISTRATION , 5 CREATED IN SECTION 27-50-102; AND6 (c) I DENTIFY DISORDERED EATING PREVENTION STRATEGIES , 7 INCLUDING DISMANTLING DISCRIMINATION AND BIAS WITH REGARD TO8 WEIGHT. 9 (1) THE DIVISION MAY SEEK, ACCEPT, AND EXPEND GIFTS, GRANTS,10 OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE PURPOSES OF11 THIS SECTION.12 (2) NOTWITHSTANDING SECTION 24-1-136 (11)(a)(I), ON OR13 BEFORE NOVEMBER 1, 2025, AND EVERY NOVEMBER 1 THEREAFTER, THE14 DIVISION SHALL SUBMIT TO THE HEALTH AND HUMAN SERVICES15 COMMITTEE OF THE SENATE AND THE PUBLIC AND BE HAVIORAL HEALTH16 AND HUMAN SERVICES COMMITTEE OF THE HOUSE OF REPRESENTATIVES ,17 OR ANY SUCCESSOR COMMITTEES , A REPORT THAT SUMMARIZES THE18 RECOMMENDATIONS FROM THE INFORMATION THE DIVISION RECEIVES19 REGARDING THE DISORDERED EATING PREVENTION RESEARCH GRANT20 PROGRAM PURSUANT TO SECTION 25-20.5-2005 (3)(b). THE DIVISION21 SHALL INCLUDE IN THE REPORT ANY FINDINGS AND RECOMMENDATIONS IT22 HAS TO IMPROVE DISORDERED EATING PREVENTION IN THE STATE .23 24 25 26 25-20.5-2004. Disordered eating prevention research grant27 014 -6- program - creation - process - reporting requirements - definitions -1 repeal. (1) A S USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE2 REQUIRES:3 (a) "E LIGIBLE APPLICANT" MEANS AN INDIVIDUAL, NONPROFIT4 ORGANIZATION, OR FOR-PROFIT ORGANIZATION THAT C ONDUCTS5 RESEARCH ON DISORDERED EATING AND PREVENTION IN YOUTH , ADULTS, 6 AND OLDER COLORADANS OR SERVES YOUTH , ADULTS, AND OLDER7 C OLORADANS WHO HAVE DISORDERED EATING TRAITS.8 (b) "G RANT RECIPIENT" MEANS AN ELIGIBLE APPLICANT THAT THE9 DIVISION SELECTS TO RECEIVE MONEY THROUGH THE GRANT PROGRAM .10 (2) (a) T HERE IS CREATED IN THE DIVISION THE DISORDERED11 EATING PREVENTION RESEARCH GRANT PROGRAM . THE PURPOSE OF THE12 GRANT PROGRAM IS TO PROVIDE FINANCIAL ASSISTANCE TO ELIGIBLE13 APPLICANTS TO CONDUCT RESEARCH ON THE ROOT CAUSES OF DISORDERED14 EATING AND EXAMINE THE RISK FACTORS AND PROTECTIVE FACTORS FOR15 DISORDERED EATING IN YOUTH, ADULTS, AND OLDER COLORADANS.16 (b) O N OR BEFORE OCTOBER 1, 2024, THE DIVISION SHALL ADOPT 17 GUIDELINES FOR THE GRANT PROGRAM. THE GUIDELINES MUST INCLUDE:18 (I) A PPLICATION PROCEDURES BY WHICH ELIGIBLE APPLICANTS19 MAY APPLY FOR A GRANT PURSUANT TO THIS SECTION ;20 (II) C RITERIA TO USE IN SELECTING ELIGIBLE APPLICANTS TO21 RECEIVE GRANT MONEY AND DETERMINING THE AMOUNT OF GRANT22 MONEY TO BE AWARDED TO EACH GRANT RECIPIENT ; 23 (III) P ROCEDURES FOR THE ADMINISTRATION OF THE GRANT24 PROGRAM, INCLUDING THE DATES THE DEPARTMENT AND THE OFFICE OF25 DISORDERED EATING PREVENTION ANNOUNCE THE GRANT PROGRAM ,26 BEGIN ACCEPTING APPLICATIONS, ALLOW ELIGIBLE APPLICANTS TO SUBMIT27 014 -7- APPLICATIONS, AND BEGIN DISTRIBUTING GRANT MONEY TO THE1 GRANTEES; AND2 (IV) R EPORTING PROCEDURES FOR GRANT RECIPIENTS . 3 4 (3) (a) E ACH GRANT RECIPIENT SHALL SUBMIT A WRITTEN REPORT5 TO THE DIVISION. THE REPORT MUST INCLUDE A SUMMARY OF THE6 RESEARCH MADE POSSIBLE BY THE GRANT MONEY .7 (b) T HE DIVISION SHALL INCLUDE IN THE REPORT REQUIRED8 PURSUANT TO SECTION 25-20.5-2003 (4) THE FOLLOWING INFORMATION9 REGARDING THE ADMINISTRATION OF THE GRANT PROGRAM DURING THE10 PRECEDING YEAR:11 (I) T HE NUMBER OF GRANT RECIPIENTS THAT RECEIVED MONEY12 FROM THE GRANT PROGRAM ;13 (II) T HE AMOUNT OF EACH GRANT AWARD TO EACH GRANT14 RECIPIENT;15 (III) A SUMMARY OF GRANT RECIPIENTS ' WRITTEN REPORTS16 DESCRIBED IN SUBSECTION (3)(a) OF THIS SECTION.17 (4) T HE DIVISION MAY SEEK, ACCEPT, AND EXPEND GIFTS, GRANTS,18 OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE PURPOSES OF19 THIS SECTION.20 (5) T HIS SECTION IS REPEALED, EFFECTIVE JULY 1, 2027.21 22 23 SECTION 2. Appropriation. For the 2023-24 state fiscal year,24 $26,679 is appropriated to the department of public health and25 environment for use by the prevention services division. This26 appropriation is from the general fund and is based on an assumption that27 014 -8- the division will require an additional 0.2 FTE. To implement this act, the1 division may use this appropriation for the disordered eating prevention2 program related to family and community health.3 SECTION 3. Act subject to petition - effective date. This act4 takes effect at 12:01 a.m. on the day following the expiration of the5 ninety-day period after final adjournment of the general assembly; except6 that, if a referendum petition is filed pursuant to section 1 (3) of article V7 of the state constitution against this act or an item, section, or part of this8 act within such period, then the act, item, section, or part will not take9 effect unless approved by the people at the general election to be held in10 November 2024 and, in such case, will take effect on the date of the11 official declaration of the vote thereon by the governor.12 014 -9-
