15-Be it enacted by the General Assembly of the State of Colorado:
16-SECTION 1. In Colorado Revised Statutes, add 22-1-129.5 as
17-follows:
18-22-1-129.5. Instruction in cardiopulmonary resuscitation and
19-the use of automated external defibrillators - guidelines and content

21+The bill encourages each public school in the state to provide
22+instruction on cardiopulmonary resuscitation and the use of an automated
23+external defibrillator to students in grades 9 through 12. The bill requires
24+the instruction to meet certain requirements.
25+The bill requires the instruction of cardiopulmonary resuscitation
26+and the use of an automated external defibrillator to be included in the
27+curriculum for a high school that participates in the Colorado
28+comprehensive health education program.

76-22-25-105. Review of local comprehensive health education
77-programs and local student wellness programs - allocation of funds by
78-the state board of education. (3) (a) The state board of education shall
79-establish a review and prioritization process for the allocation of available
80-funds to school districts, boards of cooperative services, and facility schools
81-based upon applications submitted to the department of education and
82-giving due consideration to the guidelines developed pursuant to section
83-22-25-104 (3)(a) SECTION 22-25-104 (3). Funding may be made available
84-to districts or facility schools to implement portions of a comprehensive
85-health education program or portions of a local student wellness program
86-that are coordinated with health education, according to the needs of the
87-individual school district or facility school. Pursuant to the review and
88-prioritization process, the state board of education shall allocate available
89-funds to the applying school districts, boards of cooperative services, and
90-facility schools based on whether the state board of education finds that a
91-school district, a board of cooperative services, or a facility school has
92-planned or developed a local comprehensive health education program or
93-a local school wellness program that will serve the objectives of this article.
94-Funding for local comprehensive health education programs and local
95-school wellness programs may include, but shall not be limited to, the
96-implementation of training programs, in-service education institutes, and
97-curriculum development programs for staff who shall instruct in
98-comprehensive health education or for staff who shall instruct in or
99-otherwise provide services through student wellness programs that are
100-coordinated with health education. The state board of education shall not
101-allocate funds to school districts, boards of cooperative services, or facility
102-schools pursuant to the provisions of this subsection (3) until the department
103-determines the amount of money that will be available for allocation.
104-SECTION 4. In Colorado Revised Statutes, 22-25-106, amend (3)
105-introductory portion as follows:
106-22-25-106. Local comprehensive health education programs -
107-local student wellness programs - establishment of comprehensive
108-health education advisory councils. (3) In addition to the requirements of
109-section 22-25-104 (3)(b)
110- SECTION 22-25-104 (3), each school district and
111-board of cooperative services is encouraged to include instruction in its
112-local comprehensive health education program which:

114-takes effect at 12:01 a.m. on the day following the expiration of the
115-ninety-day period after final adjournment of the general assembly; except
116-that, if a referendum petition is filed pursuant to section 1 (3) of article V
117-of the state constitution against this act or an item, section, or part of this act
118-within such period, then the act, item, section, or part will not take effect
119-unless approved by the people at the general election to be held in
120-November 2024 and, in such case, will take effect on the date of the official
121-declaration of the vote thereon by the governor.
