15-Be it enacted by the General Assembly of the State of Colorado:
16-SECTION 1. Legislative declaration. (1) The general assembly
17-finds and declares that it is the intent of the general assembly in creating the
18-independent state elected official pay commission that the initial
19-commission and each subsequent commission thereafter be established as
20-an independent and temporary commission comprised of Coloradans who
21-reflect the state's diversity with regard to geography, ethnicity, race, gender,
22-sexual orientation, gender identity, disability, age, and socioeconomic

31-SECTION 2. In Colorado Revised Statutes, 2-2-317, amend (1)(a)
32-introductory portion, (1)(b)(II) introductory portion, (1)(b)(II)(A), (1)(c)(II),
33-(2)(a), and (2)(b); and add (1)(b.5) as follows:
34-2-2-317. Expense, subsistence, and travel allowance - definitions.
35-(1) (a) Except as provided in paragraph (b) of this subsection (1),
36-SUBSECTION (1)(b) OF THIS SECTION, each member of the general assembly
37-shall be IS entitled to receive up to forty-five dollars per legislative day
38-UNTIL JUNE 30, 2025, for expenses incurred during the sessions of the
39-general assembly. Such allowance shall be considered as salary pursuant to
40-section 24-51-101 (42). C.R.S.
41- Each member of the general assembly who
42-is serving on July 1, 1997, and who is entitled to such allowance may elect
43-to have all of such allowance that was paid to the member during the period
44-from January 1, 1992, through May 31, 1994, be considered salary pursuant
45-to section 24-51-101 (42), C.R.S.,
46- subject to the following conditions:
47-(b) (II) In lieu of the expenses allowed in subsection (1)(a) of this
48-section, if a member does not reside in the Denver metropolitan area, which
49-area shall be designated in guidelines established by the executive
50-committee of legislative council, the member shall be

45+of the general assembly. Beginning with state fiscal year 2025-26, and for
46+each state fiscal year thereafter, a member who resides within the Denver
47+metropolitan area is entitled to an amount equal to 25% of the federal per
48+diem rate for the city and county of Denver as of October 1 of the
49+calendar year immediately preceding the fiscal year the rate is used in,
50+rounded up to the nearest whole dollar, and a member who does not
51+reside within the Denver metropolitan area is entitled to an amount equal
52+to 90% of that rate, rounded up to the nearest whole dollar.
53+Section 2 creates the independent state elected official pay
54+commission (commission) which shall set compensation for members of
55+the general assembly, the governor, the lieutenant governor, the attorney
56+general, the secretary of state, and the state treasurer (state elected
57+officials). The initial commission will:
58+! Be appointed on or before July 31, 2025;
59+! Hold its first meeting on or before September 1, 2025; and
60+! Submit its report on or before December 15, 2025.
61+The compensation set by the initial commission, unless rejected or
62+modified by the general assembly, will go into effect on January 1, 2027.
63+After a commission submits its report, the commission expires.
64+After the initial commission, subsequent commissions will meet every 4
65+years after 2025 so that the effective date of future recommendations is
66+in alignment with the election cycle of the governor, the lieutenant
67+governor, the attorney general, the secretary of state, and the state
68+treasurer. A subsequent commission will:
69+! Be appointed on or before July 31 of each year in which the
70+commission meets;
71+! Hold its first meeting on or before September 1 of each
72+year in which the commission meets; and
73+! Submit its report on or before December 15 of each year in
74+which the commission meets.
75+The compensation set by commissions subsequent to the initial
76+commission, unless rejected or modified by the general assembly, will go
77+into effect on January 1 of the first year of each subsequent 4-year
78+gubernatorial term.
79+Additionally, the director of research of the legislative council
80+must annually adjust the compensation levels set by the commission for
81+inflation except in the year in which a commission's recommendations
82+take effect.
83+Sections 3 and 4 make conforming changes in accordance with the
84+commission setting compensation for state elected officials beginning on
85+and after January 1, 2027.
