11-ONCERNING HVAC INFRASTRUCTURE IMPROVEMENT PROJECTS IN

15-Be it enacted by the General Assembly of the State of Colorado:
16-SECTION 1. Legislative declaration. (1) The general assembly
17-finds that:
18-(a) Students and staff in Colorado's public schools deserve access
19-to clean, healthy air along with proper heating and cooling to improve their
20-opportunities to learn;
21-(b) Indoor air quality is one of several toxic threats to students in

25-history, or the Session Laws.

30-(c) The condition of inadequate school facilities can expose students
31-and staff to mold and legacy toxins such as lead, asbestos, and industrial
32-products and chemicals known as PCBs; poor air quality and temperature
33-control; inadequate lighting; and excessive noise; and
34-(d) Improving the air quality in schools can result in higher
35-attendance, better cognitive function, less asthma and other respiratory
36-health problems, and improved academic performance.
37-(2) The general assembly further finds that:
38-(a) In Colorado, many of the conditions that cause unhealthy indoor
39-air and environmental quality impact Colorado school buildings;
40-(b) Various Colorado schools have been featured in news stories
41-profiling funding shortages, heating and cooling issues, and the need for
42-facility improvements;
43-(c) The department of education's own Facility Insight Dashboard
44-reports the average age of school infrastructure to be forty years; and
45-(d) State school buildings receive a poor score on the department of
46-education's Facility Condition Index.
47-(3) The general assembly further finds that:
48-(a) Despite efforts by state agencies and school districts to improve
49-indoor environmental quality in classrooms and other school buildings,
50-many of Colorado's school districts lack the funding and staff to improve
51-facility conditions and thereby improve school health outcomes;
52-(b) According to the American Society of Civil Engineers' 2020
53-infrastructure report card, Colorado schools have an approximately $14
54-billion funding gap between the need for infrastructure replacements,
55-repairs, or upgrades and money available from regular funding and budget
56-processes;
57-(c) The current funding sources for schools do not equitably
58-PAGE 2-HOUSE BILL 24-1307 distribute funds, leaving many schools in rural and disproportionately
59-impacted communities unable to pay for necessary retrofits and updates;
60-(d) The passage of the federal "Inflation Reduction Act of 2022" and
61-"Bipartisan Infrastructure Law", which was enacted in the federal
62-"Infrastructure Investment and Jobs Act", have made billions of dollars in
63-federal money available to combine with current and planned state or local
64-funding that can help public schools improve air quality, improve student
65-performance and staff retention, and realize significant energy savings for
66-school districts;
67-(e) Accessing this federal money would not only improve air quality
68-in schools but also bring billions of dollars in economic investments in
69-quality projects to Colorado communities and workers; and
70-(f) Unfortunately, many of the schools with the most pressing
71-infrastructure improvement needs lack the staff capacity to track, apply for,
72-and manage grant funding available at the state and federal level.
73-(4) Therefore, the general assembly declares that, in order to help
74-schools address health concerns and energy efficiency needs, this act:
75-(a) Makes local education providers, including the Colorado school
76-for the deaf and the blind, eligible to receive grants from the "Infrastructure
77-Investment and Jobs Act" cash fund created in Senate Bill 22-215, which
78-was enacted in 2022;
79-(b) Authorizes the governor's office to coordinate with outside
80-entities to provide local education providers, including the Colorado school
81-for the deaf and the blind, with project planning, grant writing, and other
82-technical assistance, such as school ventilation and energy efficiency
83-verification, as needed;
84-(c) Ensures that school districts' federal funding applications remain
85-competitive by requiring the use of certified contractors or the negotiation
86-of a project labor agreement to complete HVAC infrastructure improvement
87-projects receiving federal funding and requiring compliance with the labor
88-standards outlined in federal funding opportunities;
89-(d) Will save schools money by ensuring that facility improvement
90-PAGE 3-HOUSE BILL 24-1307 projects are completed by a highly skilled workforce and result in
91-measurable energy efficiency improvements and health improvements for
92-students and staff; and
93-(e) Allows Colorado's school districts to choose to undergo an
94-HVAC assessment and find a pathway to fund any improvements identified
95-without mandating that any school must undergo an assessment or HVAC
96-improvements.
97-SECTION 2. In Colorado Revised Statutes, add 22-32-152 as
98-follows:

53+The requirements established in the bill concern:
54+! Ventilation verification assessments, which include
55+assessments of an HVAC system's filtration, ventilation
56+exhaust, economizers, demand control ventilation, air
57+distribution and building pressurization, general
58+maintenance requirements, operational controls, and carbon
59+dioxide output;
60+! The preparation of HVAC assessment reports;
61+! The review of HVAC assessment reports by mechanical
62+engineers, who make recommendations regarding
63+necessary repairs and improvements and estimate
64+associated costs;
65+! HVAC adjustments, repairs, upgrades, and replacements;
66+! The preparation of HVAC verification reports and the
67+submission of the reports to the state board of education;
68+and
69+! Periodic inspections and ongoing maintenance.
70+The bill establishes mandatory criteria that an HVAC contractor
71+must satisfy in order to perform work described in the bill. A school
72+administrative entity that undertakes HVAC infrastructure improvements
73+using money made available by a federal government source or by a
74+federal government source in combination with a state government source
75+must do so using only contractors on the certified contractor list
76+established by the department of labor and employment.
77+The bill allows a school administrative entity to apply for grants
78+to pay for HVAC infrastructure improvement projects and establishes
79+requirements for school administrative entities that apply for grants from
80+federal and state government sources.
81+The bill allows the governor's office to expend money from the
82+"Infrastructure Investment and Jobs Act" cash fund to provide grant
83+writing support and project planning support to school administrative
84+entities that are undertaking HVAC infrastructure improvement projects.
85+Be it enacted by the General Assembly of the State of Colorado:1
