The bill creates the Colorado disability opportunity office (CDOO) within the department of labor and employment (department) as a type 1 entity. The executive director of the department is required to appoint the director of the CDOO. The CDOO is required to: ! Serve as a resource for contact for state agencies, private and nonprofit organizations, and the public concerning disability issues in Colorado; ! Ensure that goals of full societal inclusion for individuals with disabilities are met by meeting with stakeholders from entities around the state related to disabilities and with state agencies to develop recommendations on the administration of grants, restructuring of disability related entities, and collaboration on overlapping aging and disability issues; and ! Submit the recommendations to the governor and state agencies. The CDOO is also required to: ! Implement a statewide strategy to facilitate economic stability for individuals with disabilities and promote successful economic, social, and community integration and to identify and address issues related to integration; ! Work towards enhanced inclusion and equitable opportunities for individuals with disabilities, as well as address concerns raised by disability populations; ! Coordinate with other entities to identify and eliminate barriers to prosperity and the integration of individuals with disabilities into their communities; ! Make recommendations to the governor and state agencies on ways to improve policies and programs to support the integration of individuals with disabilities across the state; ! As funding allows, undertake other projects, including analyzing economic and demographic trends, gathering insight and formulating and presenting recommendations to the governor and state agencies related to issues of concern and importance to individuals with disabilities in Colorado; and ! Promote integration among individuals with disabilities with the goal of implementing disability support through community-based initiatives and nonprofit organizations, which promotion includes economic opportunities, increased access to resources, and state education and outreach. 1360 -2- The bill also transfers the Colorado disability funding committee (committee) from the department of personnel to the CDOO. The transfer includes a transfer of the committee's responsibilities, including: ! The program to assist persons to obtain disability benefits; ! The program to investigate, fund, and pilot projects or programs to benefit individuals with disabilities; and ! The buying and selling of select registration numbers for license plates to raise funds for the disability support fund. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Legislative declaration. (1) The general assembly2 finds and declares that:3 (a) Approximately twenty percent of Coloradans live with one or4 more disabilities;5 (b) The poverty rate of Coloradans with disabilities is6 approximately twice that of Coloradans without disabilities;7 (c) Students with disabilities in Colorado drop out of high school8 at twice the rate as their peers without disabilities and have a college9 graduation rate that is half that of students without disabilities;10 (d) The employment rate of Coloradans with disabilities is11 approximately forty percent that of Coloradans without disabilities;12 (e) Two-thirds of Colorado's unhoused population have one or13 more disabilities;14 (f) Individuals with disabilities are often subject to discrimination15 in the areas of telecommunication, public services, public16 accommodations operated by private entities, and employment;17 (g) The federal "Americans with Disabilities Act of 1990", 4218 U.S.C. sec. 12101 et seq., as amended; the federal "Rehabilitation Act of19 1973", 29 U.S.C. sec. 701 et seq., as amended; and the "Individuals with20 Disabilities Education Act", 20 U.S.C. sec. 1400 et seq., as amended,21 1360-3- establish principles and guidelines regarding individuals with disabilities;1 (h) Colorado's disability and aging populations are growing as a2 proportion of the total population; and3 (i) Colorado is committed to:4 (I) Protecting the civil rights of individuals with disabilities;5 (II) Creating opportunities for individuals with disabilities to6 thrive; and7 (III) Ensuring individuals with disabilities have adequate:8 (A) Health care, including community-based long-term services9 and supports;10 (B) Affordable and accessible housing integrated into11 communities statewide;12 (C) Transportation;13 (D) Employment supports, including benefits counseling.14 (E) Education, from early intervention through higher education;15 (F) Emergency and disaster planning and preparedness; and 16 (G) Recreational opportunities; and17 (IV) Ensuring that individuals with disabilities have a voice in18 governing.19 (2) Therefore, the general assembly finds that it is in the best20 interest of the state of Colorado to strive to achieve equality of21 opportunity, education, health, independent living, mobility, and22 economic self-sufficiency for individuals with disabilities and that the23 creation of the Colorado disability opportunity office is vital to achieving24 these goals.25 (3) It is in the best interest of the state to transfer the Colorado26 disability funding committee (committee) to the Colorado disability27 1360 -4- opportunity office (office), which is created in this act, given the1 alignment of the purpose of the committee and the intent of the office, to2 ensure there is a focus on opportunities for Coloradans with disabilities3 in the grant and contract work done by the committee. It is the intent of4 the general assembly for the office to advise the committee on disability5 issues, to help state agencies coordinate their efforts concerning disability6 issues, and to not supplant the work or responsibilities or statutory7 authority of state agencies.8 SECTION 2. In Colorado Revised Statutes, add with amended9 and relocated provisions article 88 to title 8 as follows:10 ARTICLE 8811 Support of Coloradans with Disabilities12 PART 113 COLORADO DISABILITY OPPORTUNITY OFFICE14 8-88-101. [Formerly 24-30-2202] Definitions. As used in this part15 22, unless the context otherwise requires ARTICLE 88:16 (1) "CDOO" MEANS THE COLORADO DISABILITY OPPORTUNITY17 OFFICE CREATED IN SECTION 8-88-102.18 (1) (2) "Committee" means the Colorado disability funding19 committee created in section 24-30-2203 8-88-202.20 (2) (3) "Contract entity" means the AN entity the committee21 contracts with PURSUANT TO SECTION 8-88-206 (5) to implement sections 22 24-30-2206 to 24-30-2210 SECTION 8-88-206.23 (4) "D EPARTMENT" MEANS THE DEPARTMENT OF LABOR AND24 EMPLOYMENT CREATED IN SECTION 24-1-121.25 (5) "D ISABILITY" HAS THE SAME MEANING AS SET FORTH IN26 SECTION 24-34-301 (7).27 1360 -5- (3) (6) "Disability benefits" means THE FOLLOWING SERVICES1 PROVIDED TO AN INDIVIDUAL WITH A DISABILITY :2 (a) Cash payments from social security disability insurance under3 Title II of the federal "Social Security Act", 42 U.S.C. sec. 401 et seq., as4 amended;5 (b) Cash payments made by the federal government to persons6 who are aged, blind, or disabled under Title XVI of the federal "Social7 Security Act", 42 U.S.C. sec. 401 et seq., as amended; and8 (c) A ID TO THE NEEDY DISABLED PURSUANT TO SECTION 26-2-119;9 (d) M EDICAL CARE, INCLUDING long-term care under the10 "Colorado Medical Assistance Act", articles 4 to 6 of title 25.5, C.R.S. 11 AND THE HOME CARE ALLOWANCE PROGRAM ADMINISTERED PURSUANT TO12 SECTION 26-2-122.3;13 (e) T AX FILING ASSISTANCE;14 (f) R EBATES FOR PROPERTY TAX, RENT, AND HEAT;15 (g) E ARNED INCOME TAX CREDITS AND STATE TAX CREDITS16 APPLICABLE TO INDIVIDUALS WITH DISABILITIES; AND17 (h) A NY OTHER FEDERAL, STATE, OR LOCAL BENEFITS THAT18 IMPROVE THE QUALITY OF LIFE AND INDEPENDENCE OF INDIVIDUALS WITH19 DISABILITIES AS DETERMINED BY THE COMMITTEE .20 (7) "F ULL SOCIETAL INTEGRATION" MEANS INCLUSIVE LIVING IN21 THE COMMUNITY OF AN INDIVIDUAL'S CHOOSING, WITH OPTIONS TO WORK,22 LIVE, RECREATE, LEARN, TRAVEL, AND RECEIVE SERVICES.23 (4) (8) "Fund" means the disability support fund created in section24 24-30-2205.5 8-88-205.25 (5) (9) "Nonprofit entity" means an entity incorporated under the26 "Colorado Revised Nonprofit Corporation Act", articles 121 to 137 of27 1360 -6- title 7, C.R.S., or a tax-exempt entity under 26 U.S.C. sec. 501 (c)(3) of1 the federal "Internal Revenue Code of 1986".2 (6) (10) "Recipient" means a person who receives disability3 benefits. or long-term care services.4 (7) (11) "Registration number" means the unique combination of5 letters and numbers assigned to a vehicle by the department OF REVENUE6 under section 42-3-201 C.R.S., and required to be displayed on the A7 license plate by section 42-3-202. C.R.S.8 (8) (12) "Vehicle" means a vehicle required to be registered9 pursuant to part 1 of article 3 of title 42. C.R.S.10 8-88-102. Colorado disability opportunity office - creation -11 duties - legislative intent. (1) (a) (I) T HERE IS CREATED IN THE12 DEPARTMENT THE COLORADO DISABILITY OPPORTUNITY OFFICE, THE HEAD13 OF WHICH IS THE DIRECTOR OF THE COLORADO DISABILITY OPPORTUNITY14 OFFICE. THE EXECUTIVE DIRECTOR OF THE DEPARTMENT, IN15 CONSULTATION WITH THE OFFICE OF THE GOVERNOR, SHALL APPOINT THE16 DIRECTOR OF THE CDOO.17 (II) T HE CDOO IS A TYPE 1 ENTITY, AS DEFINED IN SECTION18 24-1-105, AND EXERCISES ITS POWERS AND PERFORMS ITS DUTIES AND19 FUNCTIONS UNDER THE DEPARTMENT .20 (III) T HE DIRECTOR OF THE CDOO HAS REGULAR ACCESS TO THE21 OFFICE OF THE GOVERNOR AND SHALL COLLABORATE WITH STATE22 AGENCIES.23 (b) T HE DIRECTOR OF THE CDOO SHALL STAFF THE CDOO IN24 ORDER TO EFFECTIVELY MEET THE GOALS AND INTENTIONS SET FORTH IN25 THIS ARTICLE 88 AND TO MEET THE FUTURE NEEDS OF COLORADO'S26 DISABILITY COMMUNITY. IN ORDER TO SUCCESSFULLY CARRY OUT THE27 1360 -7- CDOO'S PURPOSE, IT IS THE GENERAL ASSEMBLY'S INTENT THAT LIVED1 EXPERIENCE AS AN INDIVIDUAL WITH A DISABILITY BE CONSIDERED WHEN2 HIRING DECISIONS ARE MADE FOR THE CDOO STAFF. THE CDOO SHALL3 SERVE AS A RESOURCE FOR STATE AGENCIES , PRIVATE AND NONPROFIT4 ORGANIZATIONS, AND THE PUBLIC ABOUT THE FULL SPECTRUM OF5 DISABILITY ISSUES IN COLORADO.6 (2) T O ENSURE THE CDOO'S DISABILITY INTEGRATION GOALS ARE7 MET, THE CDOO SHALL:8 (a) C ONVENE AND COORDINATE A DISABILITY TECHNICAL9 ADVISORY COMMITTEE COMPRISED OF REPRESENTATIVES FROM THE10 DEPARTMENT, THE OFFICE OF INFORMATION TECHNOLOGY , THE11 DEPARTMENT OF HUMAN SERVICES , THE DEPARTMENT OF HEALTH CARE12 POLICY AND FINANCING , THE DEPARTMENT OF LOCAL AFFAIRS , THE13 DEPARTMENT OF TRANSPORTATION , THE DEPARTMENT OF EARLY14 CHILDHOOD, THE DEPARTMENT OF EDUCATION , THE DEPARTMENT OF15 HIGHER EDUCATION, THE BEHAVIORAL HEALTH ADMINISTRATION , THE16 DEPARTMENT OF MILITARY AND VETERANS AFFAIRS , THE DEPARTMENT OF17 PUBLIC SAFETY, THE DEPARTMENT OF CORRECTIONS, THE DEPARTMENT OF18 PUBLIC HEALTH AND ENVIRONMENT , AND THE DEPARTMENT OF PERSONNEL19 TO:20 (I) D ISCUSS AND MAKE RECOMMENDATIONS TO THE CDOO ON21 CROSS-AGENCY EFFORTS , INCLUDING REPORTS FROM AGENCIES ,22 IMPACTING COLORADANS WITH DISABILITIES;23 (II) U NDERSTAND THE ISSUES IMPACTING STATE AGENCIES '24 ABILITY TO BEST SERVE INDIVIDUALS WITH DISABILITIES; AND25 (III) O BTAIN THE RECOMMENDATIONS OF INDIVIDUALS WITH26 DISABILITIES ON HOW TO ADDRESS AGENCY ISSUES ;27 1360 -8- (b) COORDINATE WITH THE DISABILITY TECHNICAL ADVISORY1 COMMITTEE TO DEVELOP, MAINTAIN, AND MAKE PUBLICLY AVAILABLE ON2 THE CDOO WEBSITE A COLLECTION OF RESOURCES AVAILABLE TO3 C OLORADANS WITH DISABILITIES AND LINKS TO THE AGENCIES OR OTHER4 BODIES THAT ADMINISTER THOSE RESOURCES ;5 (c) C OLLABORATE WITH STATE AGENCIES AND THE STATEWIDE6 EQUITY OFFICE CREATED IN SECTION 24-50-146 TO CREATE AND MAINTAIN7 AN INDIVIDUALS WITH DISABILITIES EQUITY PLAN FOR THE DEVELOPMENT8 OF SHARED DASHBOARDS THAT MEASURE PERFORMANCE AGAINST SHARED9 GOALS WITHIN THOSE PLANS THAT ACHIEVE THE SHARED GOALS AND10 VISION OF THE CDOO;11 (d) C OLLABORATE WITH STAKEHOLDERS FROM THE DISABILITY12 COMMUNITY, INCLUDING REPRESENTATIVES FROM BOARDS AND13 COMMISSIONS THAT ADVISE ON DISABILITY ISSUES ; EXCEPT THAT THE14 CDOO SHALL NOT COLLABORATE WITH ANY BOARD OR COMMISSION THAT15 EXERCISES QUASI-JUDICIAL AUTHORITY IN RELATION TO DISABILITY16 DISCRIMINATION COMPLAINTS , INCLUDING ANY STATE AGENCY THAT17 CONDUCTS, AND ANY STATE AGENCY PERSONNEL WHO CONDUCT ,18 INVESTIGATIVE OR OTHER ACTIVITIES RELATED TO A BOARD 'S OR19 COMMISSION'S QUASI-JUDICIAL AUTHORITY IN RELATION TO DISABILITY20 DISCRIMINATION COMPLAINTS . THE COLLABORATION MUST BE ON A21 RECURRING BASIS TO ALLOW THE CDOO AND THE DISABILITY TECHNICAL22 ADVISORY COMMITTEE TO UNDERSTAND THE ISSUES COLORADANS WITH23 DISABILITIES WANT PRIORITIZED AND THEIR RECOMMENDATIONS ON HOW24 TO ADDRESS THOSE ISSUES.25 (e) C OLLABORATE WITH THE STATE OFFICE ON AGING IN THE26 DEPARTMENT OF HUMAN SERVICES AND ADVOCATES FOR THE AGING27 1360 -9- POPULATION AND MAKE RECOMMENDATIONS FOR ADDRESSING AGING AND1 DISABILITY INTERSECTING ISSUES TO ENSURE COORDINATION WITH THE2 DISABILITY TECHNICAL ADVISORY COMMITTEE ;3 (f) C ONSIDER RECOMMENDATIONS MADE IN RELEVANT REPORTS4 AND AUDITS, INCLUDING:5 (I) T HE TASK FORCE ON THE RIGHTS OF COLORADANS WITH6 DISABILITIES, CREATED IN SECTION 24-34-1003;7 (II) T HE FINAL REPORT OF THE COMMUNITY LIVING ADVISORY8 GROUP, CREATED IN THE OFFICE OF COMMUNITY LIVING PURSUANT TO THE9 GOVERNOR'S EXECUTIVE ORDER D 2012-027;10 (III) T HE COLORADO COMMUNITY LIVING PLAN ;11 (IV) T HE REPORT ISSUED BY THE EMPLOYMENT FIRST ADVISORY12 PARTNERSHIP IN ACCORDANCE WITH SECTION 8-84-303 (7); AND13 (V) T HE STRATEGIC ACTION PLANNING GROUP ON AGING FINAL14 REPORT; AND15 (g) A CT AS LEAD COORDINATOR ON MULTIAGENCY REPORTS AND16 PLANS FOCUSED ON COLORADANS WITH DISABILITIES BY COORDINATING17 WITH ALL RELEVANT AGENCIES AND STAKEHOLDER GROUPS .18 (3) T HE CDOO SHALL PROVIDE GUIDANCE TO THE OFFICE OF THE19 GOVERNOR AND STATE AGENCIES ON MATTERS RELATED TO COLORADANS20 WITH DISABILITIES, TO:21 (a) I MPLEMENT A STATEWIDE STRATEGY TO FACILITATE FULL22 SOCIETAL INTEGRATION BY INVESTING IN THE SUCCESS OF INDIVIDUALS23 WITH DISABILITIES IN COLORADO;24 (b) F OSTER ENHANCED INCLUSION FOR INDIVIDUALS WITH25 DISABILITIES;26 (c) E NSURE EQUITABLE OPPORTUNITIES AND ACCESS TO SERVICES27 1360 -10- FOR INDIVIDUALS WITH DISABILITIES;1 (d) E LIMINATE BARRIERS TO PROSPERITY FOR INDIVIDUALS WITH2 DISABILITIES; AND3 (e) C OORDINATE WITH AND MAKE RECOMME NDATIONS TO THE4 GOVERNOR AND STATE AGENCIES ON WAYS TO IMPROVE POLICIES ,5 PROGRAMS, AND OPERATIONS TO SUPPORT FULL SOCIETAL INTEGRATION6 OF INDIVIDUALS WITH DISABILITIES ACROSS THE STATE .7 (4) A S FUNDING ALLOWS, THE CDOO SHALL PROMOTE FULL8 SOCIETAL INTEGRATION OF INDIVIDUALS WITH DISABILITIES , WITH THE9 GOAL OF IMPLEMENTING DISABILITY SUPPORT THR OUGH10 COMMUNITY-BASED INITIATIVES AND NONPROFIT OR GANIZATIONS11 THROUGH WHICH INDIVIDUALS WITH DISABILITIES AND THEIR FAMILIES12 CAN ACCESS FORMAL AND INFORMAL SUPPORT TO PROMOTE THEIR13 HEALTH, ECONOMIC WELL-BEING, AND FULL SOCIETAL INTEGRATION. THE14 PROMOTION MUST INCLUDE :15 (a) I MPLEMENTING STUDIES, SYMPOSIA, AND RESEARCH AND THE16 REVIEW OF FACTUAL REPORTS IN COORDINATION WITH OTHER STATE17 AGENCIES TO GATHER INSIGHT AND TO FORMULATE AND PRESENT18 RECOMMENDATIONS TO THE GOVERNOR AND STATE AGENCIES RELATED TO19 ISSUES OF CONCERN AND IMPORTANCE TO INDIVIDUALS WITH DISABILITIES20 IN COLORADO;21 (b) A NALYZING ECONOMIC AND DEMOGRAPHIC TRENDS IN ORDER22 TO MAKE POLICY AND PROGRAMMATIC RECOMMENDATIONS TO THE23 GOVERNOR AND STATE AGENCIES ;24 (c) C REATING ECONOMIC OPPORTUNITIES , SUCH AS:25 (I) W ORKFORCE DEVELOPMENT , SKILLS RECOGNITION, AND26 BARRIER REDUCTION;27 1360 -11- (II) INITIATIVES THAT INCREASE ECONOMIC STABILITY ; AND1 (III) E NTREPRENEURSHIP AND HIGHER EDUCATION ATTAINMENT ;2 (d) C ONNECTING INDIVIDUALS WITH DISABILITIES TO LOCAL ,3 STATE, AND FEDERAL RESOURCES, AND TO OTHER RESOURCES AS THEY ARE4 AVAILABLE OR RELEVANT, TO MEET THEIR INDIVIDUAL NEEDS; AND5 (e) E DUCATING AND REACHING OUT TO PEOPLE IN THE STATE BY :6 (I) P ROMOTING AND CELEBRATING THE SUCCESS AND7 CONTRIBUTIONS OF COLORADO'S DISABILITY COMMUNITY; AND8 (II) E NGAGING WITH THE COMMUNITY AS A WHOLE IN ORDER TO9 FOSTER INCLUSIVITY AND INTEGRATION BY BUILDING AWARENESS ,10 PROMOTING MUTUAL UNDERSTANDING , AND INCREASING SOCIAL BRIDGING11 OPPORTUNITIES.12 (5) O N OR BEFORE NOVEMBER 1, 2025, AND ON OR BEFORE13 N OVEMBER 1 EACH YEAR THEREAFTER, THE DIRECTOR OF THE COLORADO14 DISABILITY OPPORTUNITY OFFICE, OR THE DIRECTOR'S DESIGNEE, SHALL15 SUBMIT A REPORT TO THE GOVERNOR . THE REPORT MUST INCLUDE A16 REVIEW AND SUMMARY OF THE ACTIVITY OF , INFORMATION ON, AND DATA17 ON THE PROGRAMS THAT THE CDOO ADMINISTERED DURING THE PRIOR18 STATE FISCAL YEAR.19 8-88-103. Appropriation - gifts, grants, and donations. T HE20 GENERAL ASSEMBLY SHALL APPROPRIATE MONEY FROM THE FUND OR21 FROM ANY OTHER AVAILABLE SOURCE TO THE DEPARTMENT FOR USE BY22 THE CDOO FOR THE PURPOSES SPECIFIED IN THIS ARTICLE 88. ALL CONTRACTS ENTERED INTO BY THE24 DEPARTMENT OF PERSONNEL PRIOR TO JULY 1, 2024, IN CONNECTION WITH25 THE DUTIES AND FUNCTIONS ARE HEREBY VALIDATED , WITH THE CDOO26 SUCCEEDING TO ALL RIGHTS AND OBLIGATIONS UNDER SUCH CONTRACTS .27 1360 -13- AS OF JULY 1, 2024, ANY CASH FUNDS, CUSTODIAL FUNDS, TRUSTS,1 GRANTS, AND APPROPRIATIONS OF FUNDS FROM PRIOR STATE FISCAL YEARS2 OPEN TO SATISFY OBLIGATIONS INCURRED UNDER SUCH CONTRACTS ARE3 TRANSFERRED AND APPROPRIATED TO THE DEPARTMENT FOR ALLOCATION4 TO THE CDOO FOR THE PAYMENT OF SUCH OBLIGATIONS .5 (c) The committee consists of thirteen members appointed by the6 governor, the majority of whom are persons INDIVIDUALS with7 disabilities, persons INDIVIDUALS with immediate family members who8 are persons INDIVIDUALS with disabilities, or persons INDIVIDUALS who9 are caregivers to a family member who is a person AN INDIVIDUAL with10 disabilities A DISABILITY. In making the appointments, the governor shall11 ensure that the committee has members with experience in or knowledge12 of:13 (I) Business and business management;14 (II) Nonprofit entities and managing nonprofit entities;15 (III) Advocacy for persons INDIVIDUALS with disabilities;16 (IV) The practice of medicine, WITH EXPERIENCE WORKING WITH17 INDIVIDUALS WITH DISABILITIES; and18 (V) The practice of law, with experience working with persons 19 INDIVIDUALS with disabilities.20 (2) Members of the committee serve three-year terms; except that21 the terms shall be staggered so that no more than five members' terms22 expire in the same year. The governor shall not appoint a member for23 more than two consecutive terms.24 (3) An act of the committee is void unless a majority of the25 appointed members has voted in favor of the act.26 (4) The committee shall implement this part 22 PART 2 using the27 1360 -14- fund.1 (5) The committee is authorized to seek and accept GIFTS, grants,2 or donations from private or public sources for the purposes of this part 3 22 PART 2; except that the committee shall not accept a gift, grant, or4 donation that is subject to conditions that are inconsistent with this part5 22 PART 2 or part 13 of article 75 of this title TITLE 24 regarding the status6 of GIFTS, grants, and donations made to state agencies.7 (6) The committee has the following duties and powers:8 (a) To sue and be sued and otherwise assert or defend the9 committee's legal interests;10 (b) To prepare and sign contracts;11 (c) To have and exercise all rights and powers necessary or12 incidental to, or implied from, the specific powers granted in this part 22 13 PART 2;14 (d) To fix the time and place at which meetings may be held;15 (e) To adopt and use a seal and to alter the same at its pleasure;16 (f) To authorize an auctioneer or other seller of a registration17 number to retain a reasonable commission as determined by the18 committee;19 (g) (f) To make business decisions to implement this part 22 PART20 2;21 (h) (g) To create incentives for holders to turn in currently issued22 registration numbers if any actual costs are reimbursed to the state from23 the sale;24 (i) (h) To authorize and sell license plates made of alternative25 materials if approved by the department of revenue; and26 (j) (i) To sell the right to use additional license plate options, such27 1360 -15- as historically issued backgrounds, for a fee if the option is approved by1 the department of revenue and the Colorado state patrol.2 (7) (a) The committee may obtain CONTRACT FOR the services of3 professional advisors or contract with employees to handle the conduct4 of all meetings OR carry out its administrative functions for meetings and5 committee business. or handle the committee's auctions.6 (b) The department of personnel may hire employees to handle the7 administrative aspects of supporting the committee. resulting from the8 committee being within the department of personnel.9 (8) The attorney general is the legal counsel for the committee.10 (9) Committee members do not receive compensation for11 performing official duties of the committee but may receive a per diem12 or reimbursement for travel and other reasonable and necessary expenses13 for performing official duties of the committee. The per diem or14 reimbursement is paid from the fund.15 (10) The department of public safety may prohibit any action of16 the committee or its agents that concerns the sale of license plates or17 registration numbers if the decision would affect the policy of the state of18 Colorado as it relates to the use or display of license plates or registration19 numbers.20 8-88-203. [Formerly 24-30-2204] Program to assist individuals21 to obtain disability benefits. (1) When adequate funding is available,22 The committee shall invite nonprofit entities, COUNTY DEPARTMENTS OF23 HUMAN SERVICES, AND COUNTY DEPARTMENTS OF SOCIAL SERVICES to24 submit a proposal for a program PROPOSALS FOR PROGRAMS to aid persons25 INDIVIDUALS with disabilities in accessing disability benefits. To qualify26 the FOR CONSIDERATION UNDER SUBSECTION (2) OF THIS SECTION, A27 1360 -16- nonprofit organization must be based in Colorado and:1 (a) B E governed by a board: that: 2 (a) (I) THAT is composed of persons with a demonstrated3 commitment to improving the lives of recipients with disabilities;4 (b) (II) Contains THAT INCLUDES members who understand a5 range of disabilities; and6 (c) (III) Contains A majority of THE members who OF WHICH are7 persons INDIVIDUALS with disabilities, persons INDIVIDUALS with8 immediate family members who are persons INDIVIDUALS with9 disabilities, or persons INDIVIDUALS who are caregivers to a family10 member who is a person AN INDIVIDUAL with disabilities A DISABILITY;11 or12 (I) and (II) (Deleted by amendment, L. 2022.)13 (III) (b) Has HAVE a contract with an organization that meets the14 above criteria IN SUBSECTION (1)(a) OF THIS SECTION to assume the15 disability perspective APPROVED BY THE COMMITTEE .16 (1.5) TO QUALIFY FOR CONSIDERATION UNDER SUBSECTION (2) OF17 THIS SECTION, A COUNTY DEPARTMENT OF HUMAN SERVICES OR A COUNTY18 DEPARTMENT OF SOCIAL SERVICES MUST MEET THE REQUIREMENT OF19 SUBSECTION (1)(b) OF THIS SECTION.20 (2) (a) (I) The committee shall review the proposed programs and21 shall award a contract to one or more entities that best meet the22 requirements of this section in accordance with the "Procurement Code",23 articles 101 to 112 of this title 24, OR GRANT TO ONE OR MORE OF THE24 ENTITIES THAT BEST MEET THE REQUIREMENTS OF THIS SECTION .25 (II) The term of each contract OR GRANT is up to three years. The26 committee shall include evaluation criteria in the contract with metrics27 1360 -17- that must be met at least once a year to continue funding.1 (III) (Deleted by amendment, L. 2022.)2 (b) The committee shall not award a contract OR GRANT unless the3 proposal includes:4 (I) A system for evaluating whether a person AN INDIVIDUAL with5 a disability is reasonably able to navigate the application process to obtain6 disability benefits, health care, and employment;7 (II) A system for prioritizing the need of applicants based upon8 the evaluations;9 (III) A plan for assisting persons INDIVIDUALS with disabilities in10 navigating the processes of obtaining and retaining disability benefits,11 health care, and employment;12 (IV) A plan for establishment of ESTABLISHING working13 relationships with state agencies, county departments of human or social14 services, health-care providers, the United States social security15 administration, and the business community;16 (V) A policy of preferential hiring of persons INDIVIDUALS with17 disabilities;18 (VI) Reasonable standards for accounting control of expenditures;19 and20 (VII) Metrics to evaluate the program's quality and21 cost-effectiveness.22 (VIII) Repealed.23 (c) The committee shall not discriminate against a contracting24 entity for AN APPLICANT BASED ON THE APPLICANT'S advocacy concerning25 persons INDIVIDUALS with disabilities.26 (d) To the greatest extent possible, the committee shall ensure,27 1360 -18- through one or more contracts OR GRANTS pursuant to this section, that1 persons INDIVIDUALS with disabilities are served statewide.2 (3) The AN entity awarded a contract OR GRANT under this section3 shall make quarterly reports of expenditures to the committee. The4 committee shall include in the contract OR GRANT a method and format5 for making the reports.6 8-88-204. [Formerly 24-30-2204.5] Program to investigate,7 fund, and pilot projects or programs to benefit individuals with8 disabilities. (1) W HEN ADEQUATE FUNDING IS AVAILABLE , the committee9 shall accept and review proposals to fund projects or programs, or both,10 that study or pilot new and innovative ideas that will lead to an improved11 quality of life or increased independence for persons INDIVIDUALS with12 disabilities. Proposals may be accepted throughout the year, and grants or13 loans may be made by the committee at its regular meetings. The fund14 created in section 24-30-2205.5 shall be IS the sole source to fund OF15 MONEY FOR any grants or loans made pursuant to this section.16 (2) To be eligible for funding pursuant to this section, a project or17 program must:18 (a) Demonstrate a capability to be self-sustaining or otherwise be19 able to develop long-term independent funding; AND20 (b) (I) Have a governing body, A board, or ownership that is21 composed of persons INDIVIDUALS with a demonstrated commitment to22 improving the lives of persons INDIVIDUALS with disabilities, the majority23 of whom are persons INDIVIDUALS with disabilities, persons INDIVIDUALS24 with immediate family members who are persons INDIVIDUALS with25 disabilities, or persons INDIVIDUALS who are caregivers to a family26 member who is a person AN INDIVIDUAL with disabilities; and A27 1360 -19- DISABILITY;1 (II) FOR ORGANIZATIONS THAT DO NOT MEET THE GOVERNANCE2 REQUIREMENTS OF SUBSECTION (2)(b)(II) OF THIS SECTION, HAVE A GRANT3 OVERSIGHT COMMITTEE APPROVED BY THE COMMITTEE , THAT IS4 RESPONSIBLE FOR ALL OVERSIGHT OF THE GRANT AND IS COMPRISED OF5 INDIVIDUALS WITH A DEMONSTRATED COMMITMENT TO IMPROVING THE6 LIVES OF INDIVIDUALS WITH DISABILITIES, THE MAJORITY OF WHOM ARE7 INDIVIDUALS WITH DISABILITIES, INDIVIDUALS WITH IMMEDIATE FAMILY8 MEMBERS WHO ARE INDIVIDUALS WITH DISABILITIES , OR INDIVIDUALS WHO9 ARE CAREGIVERS TO A FAMILY MEMBER WHO IS AN INDIVIDUAL WITH A10 DISABILITY; OR11 (c) (III) In the case of a sole proprietorship, have an owner who12 is a person with a demonstrated commitment to improving the lives of13 persons with disabilities, who:14 (A) Is a person AN INDIVIDUAL with a disability, a person AN15 INDIVIDUAL with an immediate family member who is a person AN16 INDIVIDUAL with a disability, or a person AN INDIVIDUAL who is a17 caregiver to a family member who is a person AN INDIVIDUAL with a18 disability; AND19 (B) H AS DEMONSTRATED COMMITMENT TO IMPROVING THE LIVES20 OF INDIVIDUALS WITH DISABILITIES.21 8-88-205. [Formerly 24-30-2205.5] Disability support fund.22 (1) There is hereby created in the state treasury the disability support23 fund, which shall consist CONSISTS of money transferred to the fund in24 accordance with section 25.5-5-308 (8); C.R.S., MONEY from the sale of25 registration numbers under this part 22, PART 2; any money that may be26 appropriated OR TRANSFERRED to the fund by the general assembly; and27 1360 -20- any gifts, grants, or donations received by the department of personnel for1 the purpose of implementing this part 22 PART 2.2 (2) The money in the fund is subject to annual appropriation by3 the general assembly for the direct and indirect costs associated with the4 implementation of this part 22 PART 2. Any money in the fund not5 expended for the purpose of this section may be invested by the state6 treasurer as provided by law. All interest and income derived from the7 investment and deposit of money in the fund must be credited to the fund.8 Any unexpended and unencumbered money remaining in the fund at the9 end of a fiscal year must remain in the fund for use as provided in this10 part 22 PART 2 and MUST not be credited or transferred to the general fund11 or another fund. If this section is repealed, prior to its repeal, all12 unexpended and unencumbered money remaining in the fund must be13 transferred to the general fund.14 (3) Any money used to implement additional license plate options15 shall not be transferred to the department of revenue. The committee or16 contract entity shall transfer the money directly to the division of17 correctional industries.18 (4) The committee shall evaluate the cost of implementing section19 24-30-2204 at least once annually and, if it is financially feasible to20 implement that section, shall implement section 24-30-2204 before21 implementing section 24-30-2204.5.22 8-88-206. Sale of registration numbers for license plates -23 license to buy and sell - market for - royalty payment -24 administration - third-party contracting entity. (1) (a) [Formerly25 24-30-2206 (1)] The state or a person may sell, and the state or a person26 may purchase, the exclusive right to use a registration number selected by27 1360 -21- the committee under section 24-30-2208 SUBSECTION (2) OF THIS SECTION1 for the purpose of registering a vehicle under article 3 of title 42. C.R.S.2 (b) [Formerly 24-30-2206 (2)] The right to use a registration3 number is a license, the use of which is subject to compliance with this4 part 22 PART 2. The duration of the license is determined by the5 committee.6 (2) (a) [Formerly 24-30-2208 (1)] The committee shall raise7 money by selling to a buyer the right to use valuable letter and number8 combinations for a registration number. The committee shall auction9 registration numbers that are likely to be worth substantially more than10 the average value of a registration number.11 (b) (I) [Formerly 24-30-2208 (2)(a)] The committee shall study12 the market and determine which registration numbers are the most13 valuable, including both the types of plates currently issued and any type14 of plate that has been historically issued, TO DETERMINE WHICH15 REGISTRATION NUMBERS ARE THE MOST VALUABLE . Based on the study,16 the committee shall select the most valuable registration numbers and17 request the department of revenue to verify whether plates with the18 registration numbers are currently issued. The committee and the19 department of revenue shall enter into an agreement establishing a20 process for requesting registration numbers, that specifies INCLUDING21 SPECIFYING the frequency of these requests.22 (II) [Formerly 24-30-2208 (2)(b)] Upon receiving the committee's23 request, the department of revenue shall verify whether the plates are24 currently issued. For purposes of this subsection (2)(b), and subsection25 (2)(c) of this section, a plate that expires due to the operation of section26 42-3-115 (5)(a) is considered currently issued until THE EXPIRATION OF27 1360 -22- the right of the owner of the motor vehicle to which the expired plate was1 affixed to apply to use the registration number of the expired plate when2 registering another motor vehicle. expires. If the plate is not currently3 issued, the department OF REVENUE shall reserve the registration number4 until the committee notifies the department OF REVENUE to release the5 registration number.6 (III) T HE COMMITTEE SHALL ESTABLISH A PROCESS FOR7 DETERMINING VALUE OF ALL CONFIGURATIONS OF REGISTRATION8 NUMBERS RESERVED BY THE COMMITTEE . THE PRICING AND MANNER OF9 SALE MUST FOLLOW THE ESTABLISHED PROCESS .10 (IV) [Formerly 24-30-2208 (2)(c)] If a registration number is not11 currently issued, the committee may sell the right to use the registration12 number in a manner calculated to bring the highest price; except that the13 department of revenue may deny the sale or use of a registration number14 that is offensive or inappropriate.15 (3) (a) [Formerly 24-30-2209 (1)] The committee shall raise16 money REVENUE by creating a market, which may include an online site,17 for THE RESALE OF LICENSE PLATE CONFIGURATIONS OF registration18 numbers using methods that are commercially reasonable, account for19 expenditures, and ensure the collection of the state's approval and transfer20 royalty.21 (b) [Formerly 24-30-2209 (2)] The royalty for the state's approval22 and transfer of the right to use a registration number is twenty-five23 percent of the sale price of the transfer. At the time of sale, the purchaser24 shall pay the royalty to the committee. This payment is in addition to and25 not in lieu of the normal registration fees, sales or use taxes, or specific26 ownership tax.27 1360 -23- (c) [Formerly 24-30-2209 (3)] A person shall not sell a1 registration number, and the department of revenue shall not assign a2 registration number, as a result of the right to use the number being sold3 to a vehicle unless the registration number was sold using the market4 created by the committee.5 (4) (a) [Formerly 24-30-2210 (1)] The committee shall notify the6 department of revenue when the right to use a registration number has7 been sold and the committee has collected the state's sale proceeds or8 approval and transfer royalty. Upon receiving the notice, the department9 of revenue shall create a record in Colorado DRIVES, created in section10 42-1-211, containing the name of the buyer; the vehicle identification11 number, if applicable; and the corresponding registration number.12 (b) [Formerly 24-30-2210 (2)] If the registration number consists13 of a combination of letters and numbers that is not within the normal14 format of A license plate currently produced for the department of15 revenue, the department of revenue shall issue the plates as personalized16 plates under section 42-3-211; C.R.S.; except that, notwithstanding17 section 42-3-211, C.R.S., the committee may sell, and the buyer or any18 subsequent buyer may use:19 (I) A registration number or letter of one position; or20 (II) Any symbol on the standard American keyboard or approved21 by the committee.22 (c) [Formerly 24-30-2210 (3)] The committee shall transfer the23 money collected under this part 22 PART 2 to the state treasurer, who shall24 credit the money to the fund. created in section 24-30-2205.5.25 (d) [Formerly 24-30-2210 (4)] The committee may contract with26 one or more public or private entities to implement this part 22 PART 2.27 1360 -24- (e) [Formerly 24-30-2210 (5)] Any money REVENUE received by1 the committee from the sale of registration numbers shall be deposited in2 the fund.3 4 8-88-207. [Formerly 24-30-2212] Sunset review - repeal of part.5 This part 22 PART 2 is repealed, effective September 1, 2026 SEPTEMBER6 1, 2029. Before the repeal, this part 22 PART 2 is scheduled for review in7 accordance with section 24-34-104.8 SECTION 3. Repeal of relocated and nonrelocated provisions9 in this act. In Colorado Revised Statutes, repeal part 22 of article 30 of10 title 24; except that 24-30-2211 is not relocated.11 SECTION 4. In Colorado Revised Statutes, 24-34-104, repeal12 (27)(a)(XVIII); and add (30)(a)(IX) as follows:13 24-34-104. General assembly review of regulatory agencies14 and functions for repeal, continuation, or reestablishment - legislative15 declaration - repeal. (27) (a) The following agencies, functions, or both,16 are scheduled for repeal on September 1, 2026:17 (XVIII) The assistance program for disability benefits under part18 22 of article 30 of this title 24.19 (30) (a) The following agencies, functions, or both, are scheduled20 for repeal on September 1, 2029:21 (IX) THE ASSISTANCE PROGRAM FOR DISABILITY BENEFITS UNDER22 ARTICLE 88 OF TITLE 8.23 SECTION 5. In Colorado Revised Statutes, 24-1-121, add (3)(n)24 as follows:25 24-1-121. Department of labor and employment - creation.26 (3) The department of labor and employment consists of the following27 1360 -25- divisions and programs:1 (n) T HE COLORADO DISABILITY OPPORTUNITY OFFICE , OR2 "CDOO", CREATED IN SECTION 8-88-102, THE HEAD OF WHICH IS THE3 DIRECTOR OF THE CDOO. THE CDOO IS A TYPE 1 ENTITY, AS DEFINED IN4 SECTION 24-1-105, AND EXERCISES ITS POWERS AND PERFORMS ITS DUTIES5 AND FUNCTIONS UNDER THE DEPARTMENT OF LABOR AND EMPLOYMENT .6 SECTION 6. In Colorado Revised Statutes, 24-75-402, amend7 (5)(yy) as follows:8 24-75-402. Cash funds - limit on uncommitted reserves -9 reduction in the amount of fees - exclusions - definitions.10 (5) Notwithstanding any provision of this section to the contrary, the11 following cash funds are excluded from the limitations specified in this12 section:13 (yy) The disability support fund created in section 24-30-2205.5 14 (1) 8-8-205 (1);15 SECTION 7. In Colorado Revised Statutes, 25-1-801, amend16 (5)(c)(II)(A) as follows:17 25-1-801. Patient records in custody of health-care facility -18 definitions. (5) As used in this part 8, unless the context otherwise19 requires:20 (c) (II) Notwithstanding any other provision of this part 8:21 (A) If a patient record is requested by a third-party entity that is22 performing duties under the "Laura Hershey Disability Support Act", part23 22 of article 30 of title 24, C.R.S. PART 2 OF ARTICLE 88 OF TITLE 8, the24 third party may obtain one free copy of the record for the application25 process or for an appeal or reapplication when required by the disability26 benefit administrator;27 1360 -26- SECTION 8. In Colorado Revised Statutes, 25.5-5-308, amend1 (8)(b.5) as follows:2 25.5-5-308. Breast and cervical cancer prevention and3 treatment program - creation - legislative declaration - definitions -4 funds - repeal. (8) (b.5) Until section 24-30-2204.5 8-88-205 is5 repealed, the state treasurer shall transfer any interest or income earned6 on moneys MONEY in the fund to the disability support fund created in7 section 24-30-2205.5 8-88-205.8 SECTION 9. In Colorado Revised Statutes, repeal 26-2-119.7.9 SECTION 10. In Colorado Revised Statutes, 39-22-535, amend10 (1) as follows:11 39-22-535. Credit for purchase of uniquely valuable motor12 vehicle registration numbers. (1) For tax years commencing on or after13 January 1, 2013, a person who buys the right to use a registration number14 under section 24-30-2206 8-88-206 is allowed a credit against the income15 taxes imposed by this article 22 for twenty percent of the purchase price16 of the right to use the registration number that is paid to the Colorado17 disability funding committee created in section 24-30-2203 8-88-202.18 SECTION 11. In Colorado Revised Statutes, 42-1-227, amend19 (1) introductory portion as follows:20 42-1-227. Disabled parking education program. (1) Subject to21 the availability of money appropriated to the department of personnel22 DEPARTMENT OF LABOR AND EMPLOYMENT , pursuant to section 42-1-226,23 the Colorado disability funding committee, created in section 24-30-220324 8-88-202:25 SECTION 12. In Colorado Revised Statutes, 42-3-115, amend26 (5)(b)(II) as follows:27 1360 -27- 42-3-115. Registration upon transfer - rules - definitions.1 (5) (b) Subsection (5)(a) of this section does not apply to the transfer or2 assignment of an owner's title or interest in Class B, Class C, and Class3 D personal property that has number plates:4 (II) That have a valuable registration number that has been5 reserved for use under the "Laura Hershey Disability Support Act", part6 22 of article 30 of title 24 PART 2 OF ARTICLE 88 OF TITLE 8.7 SECTION 13. In Colorado Revised Statutes, 42-3-206.5, amend8 (1); and add (7) as follows:9 42-3-206.5. Issuance of plates in a retired style authorized -10 additional fee - rules. (1) (a) Beginning January 1, 2023, or when the11 department is able to issue license plates pursuant to section 24-30-220312 (6)(j) 8-88-202 (6)(i), whichever is earlier, the department shall issue13 license plates in previously retired styles for motorcycles, passenger cars,14 trucks, or noncommercial or recreational motor vehicles that do not15 exceed sixteen thousand pounds empty weight that had:16 (a) (I) White letters and numbers on a background of green17 mountains and a white sky;18 (II) White letters and numbers on a background of black with a19 white border;20 (III) White letters and numbers on a background of blue with a21 white border; or22 (IV) White letters and numbers on a background of red with a23 white border.24 (b) The amount of the taxes and fees for license plates in the25 previously retired style is the same as the amount of the taxes and fees26 specified for regular motor vehicle plates plus an annual fee of27 1360 -28- twenty-five dollars, which shall be credited to the disability support fund1 created in section 24-30-2205.5 8-88-205.2 (7) ON OR BEFORE JANUARY 1, 2027, IF AN APPLICANT FOR A3 RETIRED LICENSE PLATE THAT WAS ISSUED PURSUANT TO THIS SECTION4 DEMONSTRATES A PHYSICAL IMPAIRMENT THAT AFFECTS THE APPLICANT 'S5 MOBILITY UNDER THE STANDARDS DESCRIBED IN SECTION 42-3-204 (1)(a),6 THE DEPARTMENT SHALL ISSUE THE PREVIOUSLY RETIRED LICENSE PLATE7 TO THE APPLICANT WITH AN IDENTIFYING FIGURE AS DEFINED IN SECTION8 42-3-204 (1)(e) TO INDICATE THAT THE VEHICLE IS AUTHORIZED TO9 TRANSPORT AN INDIVIDUAL WHO IS ELIGIBLE TO USE RESERVED PARKING10 PURSUANT TO SECTION 42-4-1208.11 SECTION 14. In Colorado Revised Statutes, 42-3-211, amend12 (3)(a) as follows:13 42-3-211. Issuance of personalized plates authorized.14 (3) (a) Personalized license plates must be the same color and design as15 regular motor vehicle license plates, must consist of any combination of16 numbers or letters not exceeding seven positions and not less than two17 positions except as otherwise provided in section 24-30-2210, C.R.S. 18 8-88-206 (4), and must not conflict with existing passenger, commercial,19 trailer, motorcycle, or other special license plates series; except that20 personalized license plates bearing the words "street rod" shall be of a21 design determined by the executive director of the department, which22 design shall be different from those used by the state for regular motor23 vehicle license plates.24SECTION 15. Appropriation. For the 2024-25 state fiscal year,25 $5,538,925 is appropriated to the department of labor and employment for26 use by the executive director's office. This appropriation is from the27 1360 -29- disability support fund created in section 24-30-2205.5 (1), C.R.S., and1 is based on an assumption that the office will require an additional 6.02 FTE. To implement this act, the office may use this appropriation for the3 Colorado disability opportunity office.4 SECTION 16. Appropriation - adjustments to 2024 long bill.5 To implement this act, appropriations made in the annual general6 appropriation act for the 2024-25 state fiscal year to the department of7 personnel for use by the executive director's office are adjusted as8 follows:9 (a) The cash funds appropriation from the disability support fund10 created in section 24-30-2205.5 (1), C.R.S., for personal services related11 to department administration is decreased by $128,584, and the related12 FTE is decreased by 2.0 FTE;13 (b) The cash funds appropriation from the disability support fund14 created in section 24-30-2205.5 (1), C.R.S., for the disability funding15 committee is decreased by $5,975,976; and16 (c) The cash funds appropriation from the disabled parking17 education and enforcement fund created in section 42-1-226, C.R.S., for18 the disability funding committee is decreased by $100,000.19 SECTION 17. Effective date. This act takes effect July 1, 2024.20 SECTION 18. Safety clause. The general assembly finds,21 determines, and declares that this act is necessary for the immediate22 preservation of the public peace, health, or safety or for appropriations for23 the support and maintenance of the departments of the state and state24 institutions.25 1360 -30-
