11-Be it enacted by the General Assembly of the State of Colorado:
12-SECTION 1. In Colorado Revised Statutes, 42-3-204, amend
13-(3)(b)(I)(B); and add (1)(g.5) as follows:

24+Current law exempts an individual with a remuneration-exempt
25+identifying placard from paying at a parking device. The bill defines
26+"parking device" as a single- or multi-space meter, kiosk, pay station,
27+pay-by-space, pay-by-plate, pay-by-card, or other payment system or
28+methodology for the parking of vehicles.

37-SECTION 2. In Colorado Revised Statutes, 42-4-1212, amend (1)
38-as follows:
39-42-4-1212. Pay parking access for persons with disabilities.
40-(1) A person who owns, operates, or manages a parking space,
41-INCLUDING
42-A PARKING SPACE WITHIN A PARKING LOT
43-, that requires remuneration PAID
44-THROUGH A PARKING DEVICE
45- shall not tow, boot, or otherwise take adverse
46-action against an individual or motor vehicle parking in the space for failure
47-to pay the remuneration if the motor vehicle bears a remuneration-exempt
48-identifying placard issued pursuant to section 42-3-204.
49-SECTION 3. Appropriation. (1) For the 2024-25 state fiscal year,
50-$10,447 is appropriated to the department of revenue. This appropriation is
51-from the Colorado DRIVES vehicle services account in the highway users
52-tax fund created in section 42-1-211 (2), C.R.S. To implement this act, the
53-department may use this appropriation as follows:
54-(a) $7,936 for DRIVES maintenance and support;
55-(b) $384 for personal services related to vehicle services;
56-(c) $840 for personal services related to administration and support;
57-and
58-(d) $1,287 for payments to OIT.
59-(2) For the 2024-25 state fiscal year, $335 is appropriated to the
60-department of revenue for use by the division of motor vehicles. This
61-appropriation is from the license plate cash fund created in section 42-3-301
62-(1)(b), C.R.S. To implement this act, the division may use this appropriation
63-for license plate ordering.
64-SECTION 4. Act subject to petition - effective date. This act
65-takes effect November 1, 2024; except that, if a referendum petition is filed
66-pursuant to section 1 (3) of article V of the state constitution against this act
67-PAGE 2-SENATE BILL 24-019 or an item, section, or part of this act within the ninety-day period after final
68-adjournment of the general assembly, then the act, item, section, or part will
69-not take effect unless approved by the people at the general election to be
70-held in November 2024 and, in such case, will take effect on the date of the
71-official declaration of the vote thereon by the governor.
