9-Be it enacted by the General Assembly of the State of Colorado:
10-SECTION 1. In Colorado Revised Statutes, 2-3-1304, repeal (3)
11-as follows:
12-2-3-1304. Powers and duties of capital development committee
13-- definition. (3) (a) Not later than October 15, 2019, each state agency and
14-state institution of higher education shall submit to the capital development
15-committee a list of all nondeveloped real property owned by or under the
16-control of the agency or institution. Not later than October 15 of each year
17-thereafter, each agency or institution shall submit to the capital development
18-committee any additions or deletions to the list identifying any
19-nondeveloped real property the agency has acquired or disposed of during
20-the preceding state fiscal year. The capital development committee shall
21-include this information in an annual report published on the website of the
22-general assembly. The division of housing within the department of local

31-division of parks and wildlife in the department of natural resources is
32-exempt from the requirements of this subsection (3).
33-(b) For purposes of this subsection (3), "nondeveloped real
34-property" means unimproved real property that is not otherwise protected
35-for or dedicated to another use such as an access or a conservation
36-easement.
37-SECTION 2. In Colorado Revised Statutes, 24-32-705, repeal (4)
38-as follows:
39-24-32-705. Functions of division. (4) On a page on the website
40-maintained by the department of local affairs that is dedicated to the
41-division of housing, the division shall provide a link to the annual report
42-that includes information on nondeveloped real property owned by or under
43-the control of each state agency or institution of higher education pursuant
44-to section 2-3-1304 (3). Not later than once annually by December 31 of
45-each year, the division shall update the link it is required to maintain by this
46-subsection (4).
47-SECTION 3. In Colorado Revised Statutes, 24-82-102.5, repeal
48-(3)(b) as follows:
49-24-82-102.5. Unused state-owned real property - cash fund -
50-legislative declaration - definitions - repeal. (3) (b) The department may
51-request the list provided to the capital development committee under section
52-2-3-1304 (3) as a basis for the department's inventory, but the department
53-shall independently ascertain the inventory for the department's purposes
54-under this section.
55-SECTION 4. Act subject to petition - effective date. This act
56-takes effect at 12:01 a.m. on the day following the expiration of the
57-ninety-day period after final adjournment of the general assembly; except
58-that, if a referendum petition is filed pursuant to section 1 (3) of article V
59-of the state constitution against this act or an item, section, or part of this act
60-within such period, then the act, item, section, or part will not take effect
61-unless approved by the people at the general election to be held in
62-PAGE 2-SENATE BILL 24-178 November 2024 and, in such case, will take effect on the date of the official
63-declaration of the vote thereon by the governor.

23+Capital Development Committee. Current law requires each state
24+agency and state institution of higher education to annually submit to the
25+capital development committee (committee) a list of all nondeveloped
26+real property owned by or under the control of the agency or institution
27+(nondeveloped real property list). The committee is required to include

49+Current law also requires the department of personnel to maintain
50+and annually update an inventory of unused state-owned real property and
51+to post a list of the inventory on its website. The department of personnel
52+may request the nondeveloped real property list as a basis for its inventory
53+but is required to independently ascertain the inventory for its purposes.
54+The information collected, maintained, updated, and posted as
55+required by these laws is duplicative. To address this, the bill repeals the
56+statutory provisions that require the annual submittal to the committee and
57+posting of the nondeveloped real property list and the provision that
58+allows the department of personnel to request the nondeveloped real
59+property list for its inventory of unused state-owned real property.
60+Be it enacted by the General Assembly of the State of Colorado:1
