In current law, if a service member's driver's license expires while they are serving on active duty outside of Colorado, the driver's license expiration date is extended for 3 years or until 90 days after the service member returns to the state. The bill designates the service member's dependents as also subject to the extension of their driver's license expiration date. In Colorado Revised Statutes, 42-2-118, amend (2);2 and add (6) as follows:3 42-2-118. Renewal of license in person, by mail, or4 electronically - donations to Emily Keyes - John W. Buckner organ5 and tissue donation awareness fund - rules - report - definitions -6 repeal. (2) Every license referred to in this section which is at the time7 of its expiration, as provided in subsection (1) of this section, held by a8 SERVICE member, of the armed forces of the United States, then serving9 on active duty outside of this state, shall OR THEIR DEPENDENT, DOES not10 expire as provided in subsection (1) of this section, but such THE11 expiration date shall be IS extended for a period of three years or until12 ninety days after such THE licensee returns to this state, whichever occurs13 first.14 (6) A S USED IN THIS SECTION:15 (a) "D EPENDENT" MEANS:16 (I) A SERVICE MEMBER'S SPOUSE;17 (II) A SERVICE MEMBER'S CHILD; AND18 (III) A N INDIVIDUAL FOR WHOM A SERVICE MEMBER HAS PROVIDED19 MORE THAN ONE-HALF OF THE INDIVIDUAL'S SUPPORT FOR AT LEAST ONE20 HUNDRED EIGHTY DAYS IMMEDIATELY PRECEDING THE EXPIRATION OF A21 LICENSE REFERRED TO IN THIS SECTION.22 (b) "S ERVICE MEMBER" MEANS A MEMBER OF THE UNITED STATES23 ARMED FORCES.24 SECTION 2. Act subject to petition - effective date. This act25 takes effect January 1, 2027; except that, if a referendum petition is filed26 1083-2- pursuant to section 1 (3) of article V of the state constitution against this1 act or an item, section, or part of this act within the ninety-day period2 after final adjournment of the general assembly, then the act, item,3 section, or part will not take effect unless approved by the people at the4 general election to be held in November 2026 and, in such case, will take5 effect January 1, 2027, or on the date of the official declaration of the6 vote thereon by the governor, whichever is later. 7 1083 -3-
