2121 Wildfire Matters Review Committee. Section 1 of the bill
2222 creates the prescribed fire claims cash fund (fund) in the state treasury
2323 and requires the treasurer to transfer $1 million to the fund. The division
2424 of fire prevention and control (division) shall expend money from the
2525 fund to pay claims that are certified by the division in accordance with
2626 new guidelines as specified in the bill and as adopted by the director of
2727 the division. The division shall authorize a payment in the amount
2828 certified in a claim; except that the maximum payment that the division

3737 The division shall certify a claim that meets the following
3838 guidelines:
3939 ! The claim demonstrates, in sufficient detail, the costs or
4040 damages that resulted from the prescribed burn;
4141 ! The prescribed burn that resulted in the costs or damages
4242 was conducted in full compliance with statutory and
4343 regulatory requirements for prescribed burning;
4444 ! Before conducting the prescribed burn, the certified
4545 prescribed burn manager registered the written prescription
4646 plan for the prescribed burn with the division and paid an
4747 administrative fee; and
4848 ! No more than 60 days have passed between the completion
4949 of the prescribed burn and the date upon which costs and
5050 damages were incurred.
5151 The bill gives rule-making authority to the director of the division
5252 to adopt rules and guidelines for the implementation and administration
5353 of the program and permits the division to contract with a third-party to
5454 administer, certify, and pay the claims. The bill also requires a claimant
5555 who accepts a payment that covers the full amount certified in the claim
5656 to waive all future claims related to the prescribed burn.
5757 Sections 2 and 3 expand the definition of a "certified burner" in
5858 the state to include an individual who has not completed the Colorado
5959 division's training and certification program but who meets reciprocity
6060 requirements and possesses a valid Colorado certification number. An
6161 individual seeking certification through reciprocity may receive a
6262 certification number from the division by:
6363 ! Applying for certification to the division, according to the
6464 rules and standards of the division, including the payment
6565 of any associated fee; and
6666 ! Submitting evidence to the division, according to the rules
6767 and standards of the division, that the individual holds a
6868 valid certification from a state government or other entity.
6969 The director of the division, in consultation with the Colorado state
7070 forest service, is required to adopt rules and standards pertaining to the
7171 qualification for and the terms and durations of certification, including
7272 through reciprocity.

227227 (10) Notwithstanding any other provision of law:14
228228 (a) In performing the duties assigned to him or her

230230 under subsections (5) and (6) of this section, the director shall consult16
231231 with the Colorado state forest service as described in part 3 of article 3117
232232 of title 23. C.R.S.18
233233 (b) The prescribed burning standards adopted by the director19
234234 pursuant to sub-subparagraph (B) of subparagraph (II) of paragraph (a)20
235235 of subsection (5) SUBSECTION (5)(a)(II)(B) of this section shall MUST be21
236236 consistent with existing laws and processes that ban, regulate, or have22
237237 developed recommendations concerning open burning, including sections23
238238 18-13-109, 18-13-109.5, 23-31-312, 23-31-313 (6)(a)(II) and (6)(a)(III),24
239239 25-7-106 (7) and (8), 25-7-123, 29-20-105.5, and 30-11-124. C.R.S.25
240240 (c) Nothing in this section or section 24-33.5-1217.5 or26
241241 24-33.5-1217.7 shall be construed to affect AFFECTS the authority of a27

243243 -7- county government to develop or administer an open burning permit1
244244 system for the purpose of safely disposing of slash in accordance with the2
245245 provisions of section 30-15-401 (1)(n.5). C.R.S.3
246246 SECTION 4. Safety clause. The general assembly finds,4
247247 determines, and declares that this act is necessary for the immediate5
248248 preservation of the public peace, health, or safety or for appropriations for6
249249 the support and maintenance of the departments of the state and state7
250250 institutions.8
