2323 The bill establishes a process for a person to voluntarily waive the
2424 right to purchase a firearm (voluntary waiver). The Colorado bureau of
2525 investigation (bureau) shall deny a firearm transfer to the person while the
2626 voluntary waiver is in effect. The bureau shall develop an online portal
2727 for a person to electronically file for a voluntary waiver, update contact
2828 information, and revoke a voluntary waiver. The bureau is required to

4440 The bureau shall enter a voluntary waiver into the national instant
4541 criminal background check system and any other federal or state
4642 computer-based systems used to identify prohibited purchasers of

4844 A person may revoke the voluntary waiver by filing for revocation
4945 with the bureau. The waiver remains in effect for 30 days after the bureau
5046 accepts the revocation.
5147 The person filing the voluntary waiver form may provide the name
5248 and contact information of a person who will be contacted if the person
5349 attempts to purchase a firearm while the voluntary waiver is in effect or
5450 if the filer revokes the voluntary waiver.
5551 The bill prohibits attempting to purchase a firearm while subject
5652 to a voluntary waiver. Attempting to purchase a firearm while subject to
5753 a voluntary waiver is a civil infraction, punishable by a maximum $25
5854 fine.
5955 Be it enacted by the General Assembly of the State of Colorado:1
6056 SECTION 1. Short title. The short title of this act is the2
6157 "Colorado Voluntary Do-Not-Sell Act".3
6258 SECTION 2. Legislative declaration. (1) The general assembly4
6359 finds and declares that:5
6460 (a) There were 27,032 firearm suicide deaths in the United States6
6561 in 2022;7
6662 (b) In 2023, Colorado had among the highest suicide rates in the8
6763 United States. The state was ranked eighth overall for suicide deaths and9
6864 thirteenth for suicide deaths by firearm.10
6965 (c) By far the largest number of firearm deaths in Colorado in11
7066 2023 were suicides: 717 Coloradans died by self-inflicted gunshot wound,12
7167 which accounted for 70 percent of all firearm deaths. Firearms were used13
7268 in 56 percent of all suicides in the state.14
7369 (d) Buying a firearm is associated with an increased risk of suicide15
7470 because, as one study found, the suicide rate among recent firearm16
7571 034-2- purchasers was 57 times the overall rate;1
7672 (e) Many suicide attempts are impulsive. One study of survivors2
7773 of firearm suicide attempts found that a majority had suicidal thoughts for3
7874 less than a day.4
7975 (f) Research shows that delaying access to firearms significantly5
8076 reduces gun suicide, without increasing non-gun suicide;6
8177 (g) With firearms, there are very few second chances because7
8278 approximately 85 percent of gun suicide attempts result in death;8
8379 (h) Surviving one suicide attempt usually makes all the difference.9
8480 Only around 10 percent of serious suicide attempt survivors eventually10
8581 die by suicide. Most people take advantage of their second chance, which11
8682 they will rarely get if they use a firearm.12
8783 (i) By delaying access to firearms for those who chose to13
8884 voluntarily participate on a do-not-sell list, it is reasonable to expect a14
8985 reduction in overall suicide risk.15
