4138 of regulatory agencies (department) regarding the motorcycle operator
4239 training program (MOST program), as contained in the department's
4340 sunset review of the MOST program, as follows:

5249 of money from the MOST fund (section 4); and
5350 ! Makes a technical change to align with the placement of
5451 the MOST program within the Colorado state patrol rather
5552 than the department of transportation (section 5).
5653 Be it enacted by the General Assembly of the State of Colorado:1
5754 SECTION 1. In Colorado Revised Statutes, 24-34-104, repeal2
5855 (26)(a)(XII); and add (35)(a)(VI) as follows:3
5956 24-34-104. General assembly review of regulatory agencies4
6057 and functions for repeal, continuation, or reestablishment - legislative5
6158 declaration - repeal. (26) (a) The following agencies, functions, or both,6
6259 are scheduled for repeal on September 1, 2025:7
6360 (XII) The motorcycle operator safety training program created in

6562 part 5 of article 5 of title 43.9

7168 SECTION 2. In Colorado Revised Statutes, amend 43-5-507 as14

7370 43-5-507. Repeal of part. This part 5 is repealed, effective16
7471 187-2- September 1, 2025 SEPTEMBER 1, 2034. Before the repeal, this part 5 is1
7572 scheduled for review in accordance with section 24-34-104.2
7673 SECTION 3. In Colorado Revised Statutes, 43-5-503, amend3
7774 (2)(a) as follows:4
7875 43-5-503. MOST instructor requirements and training. (2) To5
7976 be eligible, each applicant for an instructor certificate must:6
8077 (a) Be at least twenty-one EIGHTEEN years of age; and7
8178 SECTION 4. In Colorado Revised Statutes, 43-5-505, amend8
8279 (2)(b) and (2)(c); and repeal (2)(d) as follows:9
8380 43-5-505. Advisory board. (2) The board shall meet to:10
8481 (b) Recommend training methods to increase program11
8582 effectiveness;

8784 (c) Recommend improvements to the program and training. and

8986 (d) Make recommendations on expenditures of fund moneys.14
9087 SECTION 5. In Colorado Revised Statutes, 43-5-501, amend15
9188 (3.6) as follows:16
9289 43-5-501. Definitions. As used in this part 5, unless the context17
9390 otherwise requires:18
9491 (3.6) "MOST vendor" means a person that offers a motorcycle19
9592 operator safety training program that meets standards promulgated by the20
9693 department of transportation STATE PATROL.21
9794 SECTION 6. Act subject to petition - effective date. This act22
9895 takes effect at 12:01 a.m. on the day following the expiration of the23
9996 ninety-day period after final adjournment of the general assembly; except24
10097 that, if a referendum petition is filed pursuant to section 1 (3) of article V25
10198 of the state constitution against this act or an item, section, or part of this26
10299 act within such period, then the act, item, section, or part will not take27

104101 -3- effect unless approved by the people at the general election to be held in1
105102 November 2026 and, in such case, will take effect on the date of the2
106103 official declaration of the vote thereon by the governor.3
