41	38		of regulatory agencies (department) regarding the motorcycle operator
42	39		training program (MOST program), as contained in the department's
43	40		sunset review of the MOST program, as follows:
44	41		! Continues the MOST program in the office of the chief of
45	42		the state patrol in the department of public safety for 9
46	43		years, until September 1, 2034 (sections 1 and 2 of the
47	44		bill);
48	45		! Lowers the required minimum age to be a MOST instructor
49	46		from 21 to 18 years of age (section 3);
50	47		! Removes the authority of the motorcycle operator safety
51	48		advisory board to make recommendations on expenditures
52	49		of money from the MOST fund (section 4); and
53	50		! Makes a technical change to align with the placement of
54	51		the MOST program within the Colorado state patrol rather
55	52		than the department of transportation (section 5).
56	53		Be it enacted by the General Assembly of the State of Colorado:1
57	54		SECTION 1. In Colorado Revised Statutes, 24-34-104, repeal2
58	55		(26)(a)(XII); and add (35)(a)(VI) as follows:3
59	56		24-34-104. General assembly review of regulatory agencies4
60	57		and functions for repeal, continuation, or reestablishment - legislative5
61	58		declaration - repeal. (26) (a) The following agencies, functions, or both,6
62	59		are scheduled for repeal on September 1, 2025:7
63	60		(XII) The motorcycle operator safety training program created in
64	61		8
65	62		part 5 of article 5 of title 43.9
66	63		(35) (a) The following agencies, functions, or both, are scheduled10
67	64		for repeal on September 1, 2034:11

70	67		CREATED IN PART 5 OF ARTICLE 5 OF TITLE 43.13
71	68		SECTION 2. In Colorado Revised Statutes, amend 43-5-507 as14
72	69		follows:15
73	70		43-5-507. Repeal of part. This part 5 is repealed, effective16
74	71		187-2- September 1, 2025 SEPTEMBER 1, 2034. Before the repeal, this part 5 is1
75	72		scheduled for review in accordance with section 24-34-104.2
76	73		SECTION 3. In Colorado Revised Statutes, 43-5-503, amend3
77	74		(2)(a) as follows:4
78	75		43-5-503. MOST instructor requirements and training. (2) To5
79	76		be eligible, each applicant for an instructor certificate must:6
80	77		(a) Be at least twenty-one EIGHTEEN years of age; and7
81	78		SECTION 4. In Colorado Revised Statutes, 43-5-505, amend8
82	79		(2)(b) and (2)(c); and repeal (2)(d) as follows:9
83	80		43-5-505. Advisory board. (2) The board shall meet to:10
84	81		(b) Recommend training methods to increase program11
85	82		effectiveness;
86	83		AND12
87	84		(c) Recommend improvements to the program and training. and
88	85		13
89	86		(d) Make recommendations on expenditures of fund moneys.14
90	87		SECTION 5. In Colorado Revised Statutes, 43-5-501, amend15
91	88		(3.6) as follows:16
92	89		43-5-501. Definitions. As used in this part 5, unless the context17
93	90		otherwise requires:18
94	91		(3.6) "MOST vendor" means a person that offers a motorcycle19
95	92		operator safety training program that meets standards promulgated by the20
96	93		department of transportation STATE PATROL.21
97	94		SECTION 6. Act subject to petition - effective date. This act22
98	95		takes effect at 12:01 a.m. on the day following the expiration of the23
99	96		ninety-day period after final adjournment of the general assembly; except24
100	97		that, if a referendum petition is filed pursuant to section 1 (3) of article V25
101	98		of the state constitution against this act or an item, section, or part of this26
102	99		act within such period, then the act, item, section, or part will not take27

104	101		-3- effect unless approved by the people at the general election to be held in1
105	102		November 2026 and, in such case, will take effect on the date of the2
106	103		official declaration of the vote thereon by the governor.3
