of regulatory agencies (department) regarding the motorcycle operator
training program (MOST program), as contained in the department's
sunset review of the MOST program, as follows:
! Continues the MOST program in the office of the chief of
the state patrol in the department of public safety for 9
years, until September 1, 2034 (sections 1 and 2 of the
bill);
! Lowers the required minimum age to be a MOST instructor
from 21 to 18 years of age (section 3);
! Removes the authority of the motorcycle operator safety
advisory board to make recommendations on expenditures
of money from the MOST fund (section 4); and
! Makes a technical change to align with the placement of
the MOST program within the Colorado state patrol rather
than the department of transportation (section 5).
Be it enacted by the General Assembly of the State of Colorado:1
SECTION 1. In Colorado Revised Statutes, 24-34-104, repeal2
(26)(a)(XII); and add (35)(a)(VI) as follows:3
24-34-104.  General assembly review of regulatory agencies4
and functions for repeal, continuation, or reestablishment - legislative5
declaration - repeal. (26) (a)  The following agencies, functions, or both,6
are scheduled for repeal on September 1, 2025:7
(XII)  The motorcycle operator safety training program created in

part 5 of article 5 of title 43.9
(35) (a)  The following agencies, functions, or both, are scheduled10
for repeal on September 1, 2034:11

CREATED IN PART 5 OF ARTICLE 5 OF TITLE 43.13
SECTION 2. In Colorado Revised Statutes, amend 43-5-507 as14
follows:15
43-5-507.  Repeal of part. This part 5 is repealed, effective16
187-2- September 1, 2025 SEPTEMBER 1, 2034. Before the repeal, this part 5 is1
scheduled for review in accordance with section 24-34-104.2
SECTION 3. In Colorado Revised Statutes, 43-5-503, amend3
(2)(a) as follows:4
43-5-503.  MOST instructor requirements and training. (2)  To5
be eligible, each applicant for an instructor certificate must:6
(a)  Be at least twenty-one EIGHTEEN years of age; and7
SECTION 4. In Colorado Revised Statutes, 43-5-505, amend8
(2)(b) and (2)(c); and repeal (2)(d) as follows:9
43-5-505.  Advisory board. (2)  The board shall meet to:10
(b)  Recommend training methods to increase program11
effectiveness;

(c)  Recommend improvements to the program and training. and

(d)  Make recommendations on expenditures of fund moneys.14
SECTION 5. In Colorado Revised Statutes, 43-5-501, amend15
(3.6) as follows:16
43-5-501.  Definitions. As used in this part 5, unless the context17
otherwise requires:18
(3.6)  "MOST vendor" means a person that offers a motorcycle19
operator safety training program that meets standards promulgated by the20
department of transportation STATE PATROL.21
SECTION 6. Act subject to petition - effective date. This act22
takes effect at 12:01 a.m. on the day following the expiration of the23
ninety-day period after final adjournment of the general assembly; except24
that, if a referendum petition is filed pursuant to section 1 (3) of article V25
of the state constitution against this act or an item, section, or part of this26
act within such period, then the act, item, section, or part will not take27

-3- effect unless approved by the people at the general election to be held in1
November 2026 and, in such case, will take effect on the date of the2
official declaration of the vote thereon by the governor.3
