AN ACT TOLLING THE TIME LIMIT FOR FILING AN ACTION REGARDING A DEFECTIVE HIGHWAY, BRIDGE, SIDEWALK, ROAD OR RAILING PENDING THE COMPLETION OF A POLICE INVESTIGATION REPORT.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That sections 13a-144, 13a-149 and 13a-152 of the general statutes be amended to (1) increase the time by which a person who is injured on a defective highway, bridge, sidewalk, road or railing shall provide written notice of such injury to the applicable state, town, city, corporation, borough or party, in order to recover damages for such injury, from ninety days following the date of such injury to one hundred eighty days following the injured person's receipt of a completed police investigation report concerning the cause of such injury; and (2) provide that if a person dies or is cognitively impaired as a result of such injury, the notice may be given within one year of receipt of a completed police investigation report concerning the cause of such injury by the conservator of the person or estate or executor or administrator of the deceased person's estate.

Statement of Purpose: 

To provide a person who is injured, or the executor or administrator of the estate of a person who dies because of injuries, as a result of the failure to maintain a highway, bridge, sidewalk, road, railing or fence by the state or a town, city, corporation, borough or other party, with more time to file a claim pending a completed police investigation report in order to determine whether a cause of action exists.
