AN ACT CONCERNING THE RIGHT TO REPURCHASE PROPERTY ACQUIRED BY EMINENT DOMAIN BY A MUNICIPALITY.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to provide that if a municipality acquires property by eminent domain for a public use and does not use the real property for the purpose for which it was acquired or for some other public use and the municipality seeks to sell the property, the municipality shall first offer the real property for sale to the person from whom the property was acquired, or the person's heir, in the same manner as currently provided for acquisitions for redevelopment and economic development purposes.

Statement of Purpose: 

To require municipalities to offer a right of first refusal to any person from whom property was acquired by eminent domain if the property is not used for a public purpose and subsequently resold, as currently provided for acquisitions for redevelopment and economic development purposes.
