2623 Be it enacted by the Senate and House of Representatives in General Assembly convened:

28-Section 1. (NEW) (Effective October 1, 2011) (a) The Departments of Transportation and Public Works and the Office of Policy and Management may, under a competitive sealed proposals procurement process, solicit proposals and enter into contracts with the private sector for design-build-finance-operate-maintain or design-build-operate-maintain services involving the sale, lease, operation and maintenance of transportation facilities. As used in this section, "transportation facilities" means infrastructure, including roads, airports, seaports, parking facilities, rail facilities or similar facilities that are open to the public and are used for the transportation of persons or goods. The Departments of Transportation and Public Works and the Office of Policy and Management may consider unsolicited proposals in accordance with a competitive bidding process.

30-(b) The Department of Transportation, in consultation with the Department of Public Works and the Office of Policy and Management, shall adopt regulations in accordance with the provisions of chapter 54 of the general statutes, establishing such proposals procurement process and competitive bidding process.
