The Attorney General shall develop such form for use by hospitals and medical professionals in this state when obtaining patient authorization and information with respect to mental health services. At a minimum, such form shall meet the standards set forth in state and federal privacy laws, including, but not limited to, the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191 (HIPAA), as from time to time amended, and regulations adopted thereunder. Not later than January 15, 2012, the Attorney General shall submit any proposed legislation that the Attorney General deems necessary to implement the use of such form to the joint standing committee of the General Assembly having cognizance of matters relating to public health. | |
