1224 AN ACT CONCERNING THE DEVELOPMENT OF A UNIFORM TREATMENT AUTHORIZATION FORM FOR MENTAL HEALTH SERVICES.

1426 Be it enacted by the Senate and House of Representatives in General Assembly convened:

16-Section 1. (Effective from passage) Not later than January 1, 2012, the Attorney General shall develop a "Uniform Treatment Authorization Form for Mental Health Services". The Attorney General shall develop such form for use by hospitals and medical professionals in this state when obtaining patient authorization and information with respect to mental health services. The Attorney General shall develop such form after consultation with the Commissioner of Public Health, the Commissioner of Mental Health and Addiction Services, the Insurance Commissioner and a representative of the Connecticut Hospital Association. At a minimum, such form shall meet the standards set forth in state and federal privacy laws, including, but not limited to, the Health Insurance Portability and Accountability Act of 1996, P.L. 104-191 (HIPAA), as from time to time amended, and regulations adopted thereunder. Not later than January 15, 2012, the Attorney General shall submit any proposed legislation that the Attorney General deems necessary to implement the use of such form to the joint standing committee of the General Assembly having cognizance of matters relating to public health.
