24	24		AN ACT CONCERNING THE REVIVAL OF APPROVED ECONOMIC ASSISTANCE AND ENCOURAGEMENT OF ECONOMIC COMPETITIVENESS.

26	26		Be it enacted by the Senate and House of Representatives in General Assembly convened:

28	28		Section 1. Subsection (a) of section 16-243i of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2011):

30	30		(a) (1) The Department of Public Utility Control shall, not later than January 1, 2006, establish a program to grant awards to retail end use customers of electric distribution companies to fund the capital costs of obtaining projects of customer-side distributed resources, as defined in section 16-1. Any project shall receive [a one-time, nonrecurring] an award in an amount of not less than two hundred dollars and not more than five hundred dollars per kilowatt of capacity for such customer-side distributed resources, recoverable from federally mandated congestion charges, as defined in section 16-1. No such award may be made unless the projected reduction in federally mandated congestion charges attributed to the project for such distributed resources is greater than the amount of the award. The amount of an award shall depend on the impact that the customer-side distributed resources project has on reducing federally mandated congestion charges, as defined in section 16-1.

32	32		(2) The Department of Public Utility Control may grant an additional award to retail end-use customers of electric distribution companies that received an award pursuant to subdivision (2) of this subsection. Such additional award shall be an amount of not less than two hundred dollars and not more than five hundred dollars per kilowatt of capacity for such customer-side distributed resources, recoverable from federally mandated congestion charges, as defined in section 16-1. No such award may be made unless the projected reduction in federally mandated congestion charges is greater than the amount of the award.

34	34		(3) Not later than October 1, 2005, the department shall conduct a contested case proceeding, in accordance with chapter 54, to establish additional standards for the amount of such awards and additional criteria and the process for making such awards.

36	36		Sec. 2. Section 16-243k of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2011):

38	38		Not later than January 1, 2007, and annually thereafter, the Department of Public Utility Control shall assess the number and types of customer-side and grid-side distributed resources, as defined in section 16-1, projects financed pursuant to the provisions of public act 05-1 of the June special session, and section 16-243i, as amended by this act, and such projects' contributions to achieving fuel diversity, transmission support, and energy independence in the state. Not later than January 1, 2007, and biennially thereafter, the department shall collect the information in such annual assessments and report, in accordance with the provisions of section 11-4a, on the effectiveness of the award program established in section 16-243i and on its findings to the joint standing committee of the General Assembly having cognizance of matters relating to energy.
