AN ACT CONCERNING PARENTAL IMMUNITY.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

That the general statutes be amended to provide that the common-law doctrine of parental immunity shall not apply to protect a parent from liability when the parent engages in reckless misconduct consisting of knowingly providing a child with alcoholic beverages or illegal drugs and the child dies after consuming such alcoholic beverages or illegal drugs, thereby reversing the decision in the case of Specyalski, ADMR v. Specyalski.

Statement of Purpose: 

To eliminate parental immunity in circumstances where a parent knowingly provides alcohol or drugs to a child and the consumption of such alcohol or drugs causes the death of such child.
