21 | 21 | AN ACT CONCERNING TIME LIMITS FOR ACTIONS REGARDING DEFECTIVE HIGHWAYS, BRIDGES AND SIDEWALKS. | |

23 | 23 | Be it enacted by the Senate and House of Representatives in General Assembly convened: | |

25 | 25 | That section 13a-144 of the general statutes be amended to (1) increase the amount of time within which notice shall be filed with the Commissioner of Transportation by a person injured in person or property, or the executor or administrator of a person who has died, through the neglect or default of the state or any of its employees by means of any defective highway, bridge or sidewalk which it is the duty of the Commissioner of Transportation to keep in repair, or by reason of the lack of any railing or fence on the side of such bridge or part of such road so as to be unsafe for travel, (2) provide that such notice be filed not later than one hundred eighty days following the availability of a completed police investigation report concerning the injury or death, rather than ninety days after the injury or death as currently provided, and (3) provide that in cases where the injured party dies or becomes cognitively impaired because of such injury, notice shall be filed by the executor or administrator of the person or estate not later than one year after the availability of a completed police investigation report concerning the injury or death. | |
