1224 AN ACT CONCERNING PRIVATE DUTY NURSING FOR SEVERELY DISABLED CHILDREN.

1426 Be it enacted by the Senate and House of Representatives in General Assembly convened:

16-Section 1. (Effective from passage) (a) Not later than November 1, 2013, the Commissioner of Social Services shall survey persons on the waiting list for the waiver program established pursuant to section 17b-283 of the general statutes to identify (1) the number of such persons with severe disabilities; (2) the number of such persons living in an institution; (3) the type of each person's disability or medical condition; (4) the person's age; (5) the length of time the person has been on the waiting list; (6) whether the person has private medical insurance; (7) the monthly cost of the person's care; and (8) whether the person may qualify for any other Medicaid waiver program and which such program the person may qualify for. For purposes of this section, (A) "severe disabilities" means one or more disabilities or medical conditions requiring life-supportive medical devices and skilled nursing care, and (B) "institution" means a hospital or nursing home.
28+Section 1. Section 17b-283 of the general statutes is repealed and the following is substituted in lieu thereof (Effective July 1, 2013):

18-(b) Not later than January 1, 2014, the Commissioner of Social Services shall submit a report, in accordance with the provisions of section 11-4a of the general statutes, to the joint standing committee of the General Assembly having cognizance of matters relating to human services on the waiver program established pursuant to section 17b-283 of the general statutes. The report shall include, but not be limited to: (1) The number of waiver program recipients who have severe disabilities; (2) the type of each recipient's disability or medical condition; (3) the number of persons on the waiting list for the waiver program with severe disabilities; (4) the number of persons on the waiting list who are in institutions; (5) whether waiver program recipients and persons on the waiting list qualify for any other Medicaid waiver program and what program they may qualify for; and (6) a plan to expand the number of persons with severe disabilities who receive services under the waiver program established pursuant to section 17b-283 of the general statutes. The plan shall include (A) a recommendation on the number of new waiver slots needed to serve those with severe disabilities; (B) an analysis of any eligibility criteria changes which may be needed to ensure that those in need of services receive them; (C) recommendations on other Medicaid waiver programs the state may apply for or utilize for the provision of services to current recipients and those on the waiting list for the program established pursuant to section 17b-283 of the general statutes; and (D) a study of cost-sharing options in use in other states that may be utilized in Connecticut to help fund the waiver program established pursuant to section 17b-283 of the general statutes.
30+The Commissioner of Social Services shall administer and, within available appropriations, [administer] expand a Medicaid waiver program pursuant to Section 1915(c) of the Social Security Act to provide home and community-based services for persons who are institutionalized or at risk of institutionalization and who (1) are twenty-one years of age or younger; (2) have a physical disability and may also have a co-occurring developmental disability; and (3) meet the financial eligibility criteria established in the waiver.

20-Sec. 2. (Effective from passage) The sum of ____ dollars is appropriated to the Department of Social Services from the General Fund, for the fiscal year ending June 30, 2014, for the purpose of expanding the Medicaid waiver program established pursuant to section 17b-283 of the general statutes in a manner consistent with subsection (b) of section 1 of this act.
32+Sec. 2. (Effective July 1, 2013) (a) The Commissioner of Social Services, in consultation with the Commissioner of Public Health and the Insurance Commissioner, shall study public and private health-care coverage options for providing home and community-based services, including private duty nursing, to children with severe disabilities. Such study shall include, but not be limited to: (1) Coverage options successfully implemented in other states to provide such services without impoverishing parents and caregivers, (2) limits placed on coverage of such services by private insurers licensed to operate in the state, and (3) the potential cost of providing state-subsidized private duty nursing for children with severe disabilities, pursuant to section 17b-294a of the general statutes, with family incomes exceeding three hundred per cent of the federal poverty level.

34+(b) Not later than January 1, 2014, the Commissioner of Social Services shall submit, in accordance with the provisions of section 11-4a of the general statutes, a report with recommendations to expand home and community-based services for children with severe disabilities to the joint standing committees of the General Assembly having cognizance of matters relating to human services, insurance and real estate, public health and appropriations and the budgets of state agencies.
