AN ACT CONCERNING THE AWARD OF ATTORNEY'S FEES IN LAND USE APPEALS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That section 8-8 of the general statutes be amended to provide that in the event that an appellee successfully defends against an appeal of a decision rendered by a local zoning board which has been brought to the Superior Court, the appellee shall be entitled to recover reasonable costs and attorney's fees from the appellant, provided no municipality shall be responsible for the payment of reasonable costs and attorney's fees.
Statement of Purpose:
To allow an appellee to recover reasonable costs and attorney's fees when the appellee successfully defends against a land use appeal brought to the Superior Court.
