2424 AN ACT CONCERNING THE COLLECTION OF SEXUAL ASSAULT EVIDENCE FROM AN INTOXICATED OR INCAPACITATED VICTIM.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (Effective from passage) (a) The Commission on the Standardization of the Collection of Evidence in Sexual Assault Investigations created pursuant to section 19a-112a of the general statutes shall consider whether the provisions of said section should be amended to permit the timely collection of sexual assault evidence from an apparent victim of a sexual assault who is unable to provide the consent required by said section because such victim is intoxicated or otherwise incapacitated.

3030 (b) Not later than February 1, 2014, the commission shall submit a report on its recommendations to the joint standing committee of the General Assembly having cognizance of matters relating to the judiciary in accordance with section 11-4a of the general statutes. If the commission recommends that amendments to said section be enacted to permit such collection of sexual assault evidence from an apparent victim of a sexual assault who is unable to provide such consent, the commission shall recommend such other amendments to the general statutes that the commission deems necessary to permit such collection.

48+To require the Commission on the Standardization of the Collection of Evidence in Sexual Assault Investigations to study whether to amend the sexual assault evidence collection protocol to permit the collection of forensic evidence from a victim of a sexual assault who is unable to provide consent because such victim is intoxicated or otherwise incapacitated in order to ensure that evidence is collected in a timely manner and not lost.
