16 | - | Section 1. (NEW) (Effective July 1, 2013) (a) Any nonprofit provider organization that is a party to a contract with a state agency | |

(NEW) (Effective July 1, 2013) (a) Any nonprofit provider organization that is a party to a contract with a state agency for the provision of health or human services shall retain one hundred per cent of the difference between the actual expenditures incurred by such organization and the amount received by such organization under such contract, provided such organization (1) has met the performance requirements of such contract, and (2) is in compliance with the regulatory requirements and standards developed by the contracting state agency. | |

18 | 30 | (b) Not later than ninety days after the end of each fiscal year, any state agency which contracts with a nonprofit provider organization for the provision of health or human services shall determine if such organization is in compliance with the performance requirements of such contract and the regulatory requirements and standards developed by the agency. The contracting state agency shall promptly notify such organization of its determination. | |
