1224 AN ACT CONCERNING REVENUE RETENTION BY NONPROFIT HEALTH AND HUMAN SERVICES PROVIDERS.

1426 Be it enacted by the Senate and House of Representatives in General Assembly convened:

16-Section 1. (NEW) (Effective July 1, 2013) (a) Any nonprofit provider organization that is a party to a contract with a state agency pursuant to section 4-70b of the general statutes for the provision of health or human services shall retain one hundred per cent of the difference between the actual expenditures incurred by such organization and the amount it receives under the contract that is not otherwise restricted by federal grant requirements, provided such organization (1) has met the performance requirements of such contract, and (2) is in compliance with the regulatory requirements and standards developed by the contracting state agency.

1830 (b) Not later than ninety days after the end of each fiscal year, any state agency which contracts with a nonprofit provider organization for the provision of health or human services shall determine if such organization is in compliance with the performance requirements of such contract and the regulatory requirements and standards developed by the agency. The contracting state agency shall promptly notify such organization of its determination.
