2424 AN ACT CONCERNING EMERGENCY REPAIR OF UTILITY POLES.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

28-Section 1. Section 16-246f of the general statutes is amended by adding subsection (d) as follows (Effective October 1, 2015):

30-(NEW) (d) Notwithstanding any provision of the general statutes or any special act, or any limitation imposed by its charter, a domestic electric company or contractor of such domestic electric company shall repair or replace a utility pole damaged as a result of a storm or emergency regardless of such utility pole ownership. The owner of such utility pole shall be responsible to pay such domestic electric company or contractor of such domestic electric company fair market value for the materials used and the labor performed to repair or replace such utility pole.
