1224 AN ACT CONCERNING THE DEPARTMENT OF ENERGY AND ENVIRONMENTAL PROTECTION'S AUTHORITY TO DESIGNATE ADDITIONAL STORMWATER SEWER SYSTEMS OUTSIDE OF URBAN AREAS.

1426 Be it enacted by the Senate and House of Representatives in General Assembly convened:

16-Section 1. (NEW) (Effective from passage) Notwithstanding the provisions of sections 22a-430 and 22a-430b of the general statutes, the Commissioner of Energy and Environmental Protection shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to establish all requirements, terms and conditions for any stormwater discharge permit required of a municipality that is not: (1) Already required to comply with the requirements of such a permit as of the effective date of this section, or (2) located in an urban area, as described in subsection (c) of section 22a-497 of the general statutes, and such a requirement is not otherwise prescribed by federal law. The commissioner shall adopt such regulations prior to requiring any such municipality to comply with the requirements of such a stormwater discharge permit.
28+Section 1. (NEW) (Effective from passage) On and after the effective date of this section, the Commissioner of Energy and Environmental Protection shall not require any municipality to comply with the requirements of a permit issued pursuant to section 22a-430 or 22a-430b of the general statutes for the discharge of stormwater if such municipality is not: (1) Required to comply with the requirements of such a permit as of the effective date of this section, or (2) located in an urban area, as described in subsection (c) of section 22a-497 of the general statutes, and such a requirement is not otherwise prescribed by federal law.
