2424 AN ACT CONCERNING THE STATE'S INDUSTRIAL HEMP INDUSTRY.

2626 Be it enacted by the Senate and House of Representatives in General Assembly convened:

2828 Section 1. (NEW) (Effective from passage) Not later than July 1, 2018, the Commissioner of Agriculture shall adopt regulations, in accordance with the provisions of chapter 54 of the general statutes, to establish an agricultural pilot program for the purpose of growing or cultivating industrial hemp in accordance with the provisions of section 7 USC 5940, as amended from time to time. Such pilot program shall be established for the purpose of studying the growth, cultivation and marketing of industrial hemp in a manner that ensures that only such department grows or cultivates such industrial hemp through the use of sites that are certified by, and registered with, the Department of Agriculture. In developing the regulations required by this section, the commissioner shall review and incorporate the provisions of the Kentucky Department of Agriculture Industrial Hemp Research Pilot Program 2017 Policy Guide, as the commissioner deems appropriate and consistent with the provisions of 7 USC 5940, as amended from time to time. For the purposes of this section, "industrial hemp" means the plant Cannabis sativa L. and any part of such plant, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 per cent on a dry weight basis.
